EB1A/B February 2016 NSC Applicants

Hi All,

Looks like EB1A/B applications to NSC done in February 2016 have gone in a black hole. I have been tracking EB1A mostly, and everyone before February has been given a green card, people who applied in March have started getting card post interview, and people from April have got interview calls, while February is a dark hole. Anyone has any inputs from their lawyers (anyone who did this through Victoria Chen? They may know more). Its obviously frustrating, but also kind of alarming that Feb no one has been processed.

My SR came with a reply which was not helpful. Did InfoPass work for anyone in the past to give more information.?

I assume you mean Feb 2017. Yes it appears Feb 2017 EB1 A/B has been the forgotten lot. I am in Feb 2017 too and my status has been stuck at "fingerprint fee received". No signs of any movement at all in my case! I wish I had put in my application a month or two later so that I could have gotten an interview. Interview cases seem to me moving much faster.

He also told me that there is a 40% increase in 485 applications compared to last year and the average approval time is 1.5 years.

I went to an InfoPass appointment today, and the officer told me that my file is in the "Visa Available" shelf! According to him it reached there just 2 days back. He further said there might be 1000's of application there. To try to make it positive, he said, atleast your file is not lost! Lol!

This kind of explains the "in line to be reviewed" which every Jan/Feb filer is getting. There seemed to be a big line and we just have to wait.

We ask that you allow additional time for this process to take place since we process these cases in the order received. Spoke to L2 officer on 24th Dec. i was told that the last action on my case was on "21st December 2017. but did not tell what action they have done.

can all EB1A/B unite against EB1C India scammers ? Else, soon retrogression will stop all EB1A/B GCs. Each EB1C eats 4-5 GCs because of huge families.

So I went to the Infopass appointment today. The officer was friendly, went into my case immediately and told me background check, FBI Namecheck was completed long back. And something on the lines of file is now in some "waiting for visa number to be made available" and mentioned that you are very close. He couldn't explain why it was that it was not still adjudicated. I dint press him much. It was good to get one bit more of information than the SR that my checks are all done. Now back to daily refreshes on my case status :)

while looking at the case he was also mumbling to himself something like "oh 5th Jan, that was very recent". He did not mention if this was a last date of action or something. I also had an SR filed which was answered on 6th jan, so it could have been that. but not sure!

Nice. It seems you are close. Though, based on my previous experience, I would take everything they say with a bit of salt. Though, hopefully, EB1 India would remain current for atleast sometime, so that we can make the cut :)

(it was august in 2016, june in 2017, so pessimistically speaking it could be moving up to april in 2018! which might also mean that if I don't get my GC in hand by march end, I should start planning for another year of bonded labor with my current company!)

According to the Feb 2018 bulletin (https://travel.state.gov/ content/travel/en/legal/visa- law0/visa-bulletin/2018/visa- bulletin-for-february-2018. html), the EB1 category "will remain “Current” for all countries for the next several months".

Does that statement means that there is less likelihood of EB1India retrogression this year?
