March 2017 I-485 filers

INTERVIEW EXPERIENCE:

Has anybody experience this in your interview , What happens If attorney waiver is not signed, does it invalidate interview? MY IO forgot to make me sign one :(

Here is how it went:

Scheduled interview time: Jan 16 10:30am. I checked in at 10 am and was waiting , but was not called untill 11 am.
The officer who called me in shook my hand and said sorry about the wait but the officer who was handling your case had to leave coz she was not feeling well. I just got your case and have not been able to go through it.
He then took me to his office and said First we will do the oath and then fingerprints and attorney waiver. Then he asked me to put my index finger for fingerprints but there was a problem with the fingerpeint reader and from there he struggled 20-25 minutes to make it work. It didint work in the end , so he took me out of his office and we waited outside another officers office till he got free and then he took my fingerprints.
Once we came back to my IO's cabin, He asked me to explain what my job was and asked several follow up questions and also kept looking up something on his computer. He then asked me for supplement J, So I told him that it doesnt apply because I filed concurrent. He got confused and started looking up stuff in the computer. To be fair , he did say that , 'Sorry this is only my 2nd emplyment case , I am used to only handling family based cases before'. Then he called some supervisor/another officer n talked about supp J. He said that he is still not sure but if I didint bring a Supp J , that settles it , he will look into it after the interview. I asked if he wanted EVL in place of J or any other docs. He said he does not want anything else.
After that He asked me I 485 Yes/No questions. After that he said that priority for India is not current. I told him that EB1 India should be current as per Jan bulletin. He again started looking up stuff in the computer for a while , then said for some reason I cant see that now. But I will look after the interview.
I asked him if he sees any problems in approving the case. He said that since he just got my case he cant say anything yet but it should not take more than 60 days to know the result. He did not give me any paper.
After this he walked me out and said goodluck.

The IO was nice but I felt like he has clueless, the whole process took 2 hours , It was 1 10 when I came out. and to make it worse , as soon as I caught cab back to hotel, I realised, HE DIDINT MAKE ME SIGN THE ATTORNEY WAIVER, may be he forgot about it and I too forgot about it , I am so annoyed with myself :( I am so tensed now. I have not got any case status updates either, its been 5 days. I see everyone is getting updates in 2-3 days. I am very worried.

This nightmare will never stop. I had a bad experience too. Sorry for both of us.

What I think will happen: this clueless IO will give you RFE either for Supp J, Letter of Employment, Medical, or attorney waiver. Or even something else, seeing that EB1 is not as "easy" as EB2. I don't think he will "approve", as he probably missed many things.

I have just replied to my RFE (Medical... even if my RD is MARCH. During the interview, IO BSed me about the doctor making a mistake - which was actually NOT TRUE, so the RFE just says that medical will expire so I need a new medical).

There is nothing we can do but wait. Patiently. They make mistakes, but there is nothing we can do. Be prepared for an unfair RFE due to incompetence. Our fate is not in our hands.

Thanks for your reply, Yah I am sorry too for both of us. It just doesn't feel fair but you are right there is nothing we can do.
I guess I will prepare myself for this RFE. How many days after the interview did you receive your RFE?

I hope and pray that both our cases get resolved soon.

Interview was on Friday, RFE received on Tuesday. My lawyer will give them my RFEr tomorrow... hoping there is no mistake from doctor or IO this time. Lawyer said that IF everything goes well this time, I should be greened before March. But I have seen so many problems, that I am not expecting anything good at this point. Good luck !

So, is your lawyer submitting RFER to USCIS office today in-person or by mail? I am surprised the reason of RFE: expiring on Feb given that you have completed your interview on Jan. Was the RFE just due to missing "none" on remarks or doctor actually forgot to tick on gonorrhea test box on c (i.e negative gonorrhea) or missing the name/date of test ( a and b)? Do you actually have a copy of your last I-693 submitted, did you check what was the mistake that the doctor made ? Thanks

I was not allowed to go along with my wife into the office for the interview however I made a request to officer to check on my case as I was primary applicant. Below are the details she discussed with my wife when she was with officer for the interview
- She was asked general questions about marriage, children etc.
- She checked and said my and my daughter’s papers/file is still in Texas service center hence they cannot do anything from local office
- She asked us to speak to our attorney to write to USCIS Texas Service Center
- She was under the impression that the I-140 approval was through previous employer (my current EB1 priority date that was supposed to be 14 March 2017 had automatically got updated to a date in 2007 due to previously approved Eb2 I-140 that was filed in 2007)
- She asked for previous company's pay stubs to which my wife mentioned that EB1 I-140 was based on filing done by current company and she handed over a copy of I-140 approval notice to the officer. Looks like officer was slightly confused on this one.
- Since my wife didn’t have the previous company's pay stubs( I left the previous company in Dec 2007), she asked for any experience letter/service certificate. My wife gave a copy of the previous company's experience certificate to the officer.
- Upon clarifying that the I-140 approval was through current company, the officer asked for a copy of current I-140 approval and pay stubs from current company. My wife handed over the pay stubs and latest W-2 copies . The officer retained only the W-2 copies.
- The officer said that there was no issue with my wife’s case and that she should receive her green card anywhere between two weeks to four months.
- My wife also asked the officer why was our case split? The officer had no idea why this has happened.
- My wife informed the officer that we had tried to figure out the status of AOS interviews for me and my daughter by calling 1-800 number and raising service requests, but we did not receive any concrete information. To this, she didn’t have anything to say. She insisted that our attorney write to the Texas Service Center to get a better understanding of the status of my and my daughter’s case. She said that they do respond to the attorney.
- The office confirmed from my wife if we all had filed i-485 together, to which my wife said yes. She also asked if we had received the I-485 receipt. The officer verified the I-485 receipt for my and my daughter’s case.

My attorney has now written to Texas Service Center to know about the status of mine and my daughter's cases and why my wife's case was split, why we were not called for interview etc.

Overall a very strange experience where dependent spouses are expected to know almost everything about GC process, previous employment of primary applicant and understand every documentation.

Does your local field office impact your i485 approval timeline (i.e. interview slot availability etc.)?

I filed my i485 at NSC EB1B with PD on March 29, 2017. My field office is in Detroit, MI.

Guys, I had my interview today at Houston Field Office and I had a wonderful experience. Whole process took may be half an hour tops. My wife and I were interviewed together even though our interviews were scheduled one after the other. We waited for about half an hour for Interview. My interview time was at 8am 01.22.2018. We went in by 08:30s and were out before 9.

Officer was very cool and familiar with process. She was satisfied with our EB1B case and at the end she said I am approving your case subject to you clear criminal background check. To our pleasant surprise, my wife received a call about 11 am from the same officer letting us know that we cleared background check and we should receive email or text confirmation by evening if we were signed up for Alerts. Or check uscis check my case status for next few hours. If we don’t get our cards in 2 months time she asked us to go back and see her. By 04:20 pm we received alert about New Cards in Production.

She was super nice, Cool and very knowledgeable about process. No trick questions were asked. She verified 485 info and my job profile and what I do. I have multiple approved I-140s so she teasingly asked which one do I want to go by as rest all are under EB2. I laughed and requested to go by EB1 as it is current.

The lawyer gave the RFEr in-person to the director of the local office.

I did have a copy. I am still confused.

The IO said the doctor forgot to write something (NONE) in the remarks section, but I went back to the doctor to get new medical and he said it was BS, and on the updated form he did not write anything again... I insisted, he said NO.

The RFE says the medical is expired (my RD is... March, come on ! My interview was beginning of January). I think the IO made a mistake. Unfortunately.

Interview Experience: (1/22)- West Coast

Completed my interview today, went together with family& attorney, had a noon appointment but got delayed by 30 mins. officer interviewed together and finished in 20 mins. IO is a senior in his profession and extremely knowledgeable. Very friendly with my kids as well. Asked only my latest pay stubs. Approved on the spot. Overall Good Experience! As soon as I walked out got text as well as emails that Card is in production. Took total of 11 months from the time I-485 filed.

Tips:

Keep your documentation straight

Prep well with your Job description

I raised a service request on 01/10 and hot generic response in email as under, no other update:
I have requested this case for further review and processing. You will be notified by mail when a decision is made or if further information is required to process your case. You should expect an action on your case within 60 days.

I raised SR for my spouse’s I 485 to which I got the following response in email:
Your case is currently in line for processing and adjudication. Cases are processed in the order in which they were received.

Still waiting for next update..

1/23: I spoke to uscis customer service L2 officer over the phone. He said he does not see any updated information on my case other than address change request in Oct 2017. He asked if any background check is in process or any other reason for no progress on my case. He had no more information whatsoever... No idea what to expect and how long to wait.
