Yeah. I was under the same impression as you guys. But i re-verified with the lawyer and he says that there is a provision to request to keep the same priority date for I140. I read one more forum about it and seems like whatever my lawyer is saying could be right.

Check Sec 204.5 (e) Retention of section 203(b) (1), (2), or (3) priority date. in USCIS website

I got email from my attorney for i-140 approval

EB1C India concurrent filing

PD : March 9 2017

approval date : Oct 10 2017

Waiting for 485 now

Any idea if 140 turn around time varies based on concurrent vs non-concurrent filing? Based on the limited data available on th tracker it seems non concurrent cases are touched/approved in 3 to 4 months (on an average). My Rd is 8/16 and I am wondering if I should give about a month or two more before submitting i485. Any inputs from anyone? As info, I have had all docs ready for I485 and my employer & attorney are already working on filing i485. If there is any concrete evidence (of course based on the probability) to prove that non concurrent cases are approved quickly, I would like to delay the process.

my friends who have done both conc & non-conc have got no difference if from India.

All took 8 to 18 months for 140 to get approved.

No difference if you file, concurrent or non-concurrent. it takes same amount of time to process your I140.

This is no new policy!!!

It is a policy memorandum of understanding therefore a written down guidance for officers how to apply the policy. In this case. It is based on an actual case where they denied i-140 the petitioning company appealed and the appeal was sustained, so they won.

Basically they outline and give guidance on what is to considered "essential" and "core" to the company...

Wow. Looks like lot of i140 approvals @ TSC yesterday(around 40). Not sure how many are eb1cs. Anyway, may I request everyone who got the approval or rfe to update the status on tracker please?

I wouldn't get too excited seems there is still a fair number of Dec 16 cases open. god knows how they process but maybe someone cam back from vacation got a bunch off his desk and now puts his feet up again for the rest of the year... i have little faith there is much going to happen between now and Jan 8th too many convenient excuses to not to work...

No, only I 140. I believe CTS stopped doing concurrent filing sometime ago. Have you heard of any cases being approved with filing date in july or august? USCIS still shows date as 16th April but the trackit tracker shows some july cases approved as well
