Hi everyone,

My case is EB1C, I am Brazillian and I just got an email from my lawyer with my I-140 approval, I filled January 30th both I-140 and I-485 concurrently.

The system still shows case received, the approval letter dated September 6th. Now I know that the system may be not updated as we would like.

I really hope the approval on the I-485 comes before they start the interview process otherwise, we can have long delays.

My lawyer says that its best to wait for I140 to be approved to proceed for I485 filing, but on other threads people are suggesting there is no harm in applying 485 as its current, the only con is if 140 gets denied i will loose out on fees of the lawyer.
Please suggest whats the best thing to do?

Ideally you should wait for 140 approval before filing 485. But in today's scenario where retrogression hits anyone anytime, better to get in que with 485 as well. If chances of 140 approval are high, I would suggest to file both 140 and 485 together. Also 485 gives you EAD/AP which helps if you don't have any other status or set lose any status in near future that allows you to work and travel outside.

I filed for EB1C TSC on May 25th and below are my details. Any idea when can i expect my I-140 result.

Can people update status who belong to EB1C and filed in Texas.

Here are my details.

Category - EB1C (concurrent)
Filed date - May 25th, 2017
USCIS receive date - May 26th, 2017
Finger printing - June 22nd, 2017
EAD/AP - Pending (received AP for my daughter on 07/21/17)
I-485 approval - pending
I-140 approval - pending

my timeline is very similar to yours. I-140 RD is May 15th. looking at processing times on USCIS website, we are up for long wait time my friend and that's killing me. dates moved backwards for EB1C TSC cases. someone with RD in second week of Febrary is still waiting.

Yes that's correct.

Even I am waiting from 2/17 and just now user zenoms confirmed that his RD was 1/30 and he got approval on 9/6 tells me that I have some more time to wait.

I don't understand why suddenly I-140 for only EB1C is taking this long while EB2 and other categories are getting approved quickly given that they are all on 1-April-2017 processing dates.

For all EB1C January applicants, as I said yesterday my lawyer sent me the I-140 approval (still not in the system) and today my I-485 and my wife's were updated with an RFE, still don't know what the RFE is about, I am hoping something silly as vaccination supplement J or even gonorrhea as weird as it sounds :P

Does anybody have any idea how long after sending the response to the RFE USCIS has been taking to a final decision?

Any idea if things will get better. I notice, things are pending for about 8 months of I140 application now. Do you think it will get better. What would be the best option - FIle I485 or wait for some more time to file I485.

Experts - Pls suggest. I have not received any response for any of my queries till now :D

My case - EB1C, Texas SC, Date of receipt 8/Sep/2017

My suggestion is that you should go ahead and file I485. What is the downside to it?
In the worst case scenario, should I-140 gets denied you would lose lawyer money but I'd say that is still better than some other executive order coming in while you wait to file I-485 and then you lose this chance.

With new administration and the way USCIS is delaying the EB1 process which used to complete in 4-6 months from concurrent filing to receiving GC in hand, my suggestion is that you should not wait and file your I-485.

Yes, if the dates are current then you can file I485 anytime. Concurrent or later as long as the i485 filing dates are current.

Gurus.. need some suggestion.
EB1C I140 is pending and I had previous Eb3-I140 approved when i was earlier in this country which is still active. I am on H1-B Visa.
My lawyer is filing I485 and he is suggesting me to go ahead for porting I140 priority date too. My company had not requested to have the same priority date , so he is suggesting that its the best thing to do considering the fact that retro could happen at any point in time.
Please suggest if there is any harm to proceed with his suggestion.

Are you sure your lawyer said that. There is nothing called porting I140 for EB1. Porting works for EB2, EB3 but not in case of EB1. How can a immigration lawyer not know that.

There is no perm process for EB1 then how is lawyer trying to port I-140 for EB3 that was based on a perm...

I am not very sure about porting priority date for EB1. But, i believe the retrogression to 2012 for EB1 earlier this year took place only because people with older priority date are ported to EB1. Again, i may be wrong. But, my 10 cents.

Retrogression happened coz there are a limited no. of Eb1 GCs for an year (Oct to Sep) and there was no quota left for processing any more GCs in EB1. From this week, count started from 0 for the new quota.
