H1B 3rd Extension

Hi All ,

I am about to file for 3 rd extension for H1B , I have been hearing a lot about the rejections . Just want to ask around for precautions that we need to take before we could file . Any info is helpful.

2010 -- visa Stamping done ( 1st time)
2013 -- Oct 1st Extension
2016 -- Feb 2nd extension -- have until 2018 Jun
2016 Mar USCIS Officer came to my work Location and i have answered all Questions , Took Some pics at my work Location ,Pay Stabs , W2 and all basic questions about my work
2016 APR i travelled and returned June 1st back to US ( I was under the pay role during this time)

Same employer since 2010
Same Client since dec 2015
I am having Computer Science degree ( Bachelors)
Prior Work Exp before 2010

I want to visit India for marriage proposals and am not sure how to proceed . As the premium processing is not advisable at the moment ( at least thats what i hear, please correct me if i am wrong ) .Am very worried to go to India Not sure when to go .

How long is the current extension for H1B ( Am planning to without premium )?Is there any precautions that i need to take before i could file ? I have LCA as " Programmer Analyst " .

If the normal processing taking less time i would wait until its done then travel . please advise

Regular processing time may take 4 to 5 months without RFE but with RFE it can be delayed a lot.

Are there any precautions that I need to take before I could file?

Yes, you have to file proper job code based on your job role and responsibilities in LCA, file with higher wage level. Look at OOH handbook for the SOC code with wage level, it should be highly specialized work means OOH handbook shouldn't mention any associate or below bachelor level degree can do that job.

Prepare document specification that kind of product your company will develop, mention that your company has highly specialized work for you.

If the normal processing taking less time I would wait until it's done then travel: yes.

My 2nd extension had 84,500 USD , Now we are trying to file for 95,00 USD i believe that will be higher wage ( please correct if i am wrong ) .

To my knowledge my employer does good documentation and pays his bills /taxes properly ( as i have been with for 7 yrs )
