I'm not here to prove anything right or wrong. I'm posting my experience at clients place with our interactions. If clients are not asking for GC / citizen, most of us will switch to the full-time opportunity which is the case now.

Where to report EB2 & EB3 fraud in processing by cts. Few guys got liberty and jumped the normal CTS Q (not coming under 18 months bracket) and filed the Perm before this is EB2 & EB3 filing is closed .

First of all i'm not a EB1 guy. But i know many people very deserving and in EB1. Please do not generalize that all EB1 are fraudulent cases in Cognizant.

And not just anyone who is a favorite for his manager can get EB1 just like that. I know lot of managers and Senior manager still staying in EB2. Everyone expect EB1, but not all of them gets it. That's okay, stay calm. Since you don't get it don't show your hatred that all EB1Cs are not deserving. Some might be an expert in some technical fields so do others. So it doesn't mean that all deserves EB1. EB1 has some criteria (Cognizant and DOL) to be met to be eligible apart from being technically strong in your field.. If you don't like the policies here find a company which suits you. Or if you're personally affected please take some actions legally and prove that you're right.

There are many baseline criterias Cognizant has set based on the DOL eligibility and history of petitions rejected so far.

Some of them are
Designation should be M and above.
Should have worked at least 1 Year at offshore.
Current role should be like managing associates across Onsite and Offshore.
Current role should have project and people management.
And after meeting all the above listed there is a quota on how many number of EB1C Cognizant can file every year. Based on associate's visa maxout and FCFS, they start filing it.
After this, based on the justification cognizant has provided in the documents, DOL makes the decision.

How many of you here met the above criteria and still didn't get EB1C?
Yes, Cognizant has lot of policies, criteria and guidelines for delivery, immigration, security and many such. How ever hectic it's for the associates, these stuff are essential for running a company which has more than 2.5 lakh associates and thousands of clients.

Your ratings depends on how much you perform in projects, Value Adds, Team management, people management skills, and some times even how favorite you are to your supervisor and management.

But this is not the case of EB1C. EB1C in cognizant can never be influenced, because It's under higher control not just one or two levels of our supervisor hierarchy. (You can see many M, SM and even AD still sitting in EB2).

If anyone has any clarifications in this i can respond back.

I'm not here offending or defending anyone. I'm also an EB2 filed last April 2016. I know a lot of senior associates who filed in EB1 a couple of years ago. This "M" level was added just last year. And if you know any "SA" who has been filed recently please go ahead and escalate it. Even the EB1 criteria document has been updated to "M" level. This was a recent update in the EB1C after receiving lot of EB1 applications they wanted to increase the filters. And Yes i can give you the details of the AD and few SMs too, who was filed in EB2 since they didn't have one year offshore experience.

As per USCIS updated eligibility criteria, the associate should be a multinational manager (Managing at least one resource at onsite and one resource at offshore) - Many SAs were denied i140 when filed in EB1C earlier. This is where M level came in. Not my recommendation or not Cognizant's.

From USCIS :

Multinational manager

You must have been employed outside the United States in the 3 years preceding the petition for at least 1 year by a firm or corporation and you must be seeking to enter the United States to continue service to that firm or organization. Your employment must have been outside the United States in a managerial or executive capacity and with the same employer, an affiliate, or a subsidiary of the employer.

I also feel if by some means if i get EB1, it'll be great. But i'm not going to vent on others for that.

You are right friend.. unfortunately many are naive to understand the situation.. Many on this thread are US joinees and know similar people who are on EB2/3.. if they look around for people coming from offshore, they will have better idea.. My offshore developer recently got into EB1.. He played regional card in an account which favored people from TN.. So there is gross misuse..

Similar case is happening at my client also. I thing its because of clients not wanting to get bad names like Disney, Univ of Cal etc., by eventually getting their work done by H1B people..

To be very specific, GIT didn't filed for all max out associates. There are few whom I know have less than 18 months and having their max out in 2018, not picked up in this cycle.

Thanks. I guess that answers CTS may not resume processing any time soon, My guess 1-1.5 year, if they ever start filling EB2/EB3 cases again.

Request to all who will reach max out period in coming months to keep us posted. Can't help but can share concerns.

Yes True. It based on management decision to file for those guys irrespective of Max out date. Max out 2019 and doc submitted in Feb 2016 was filed in June 2016.

To all friends who are in shock after hearing that CTS stopped green card processing, there are more bad news. It is not just the green card, they are also stopping/cutting H1Bs to a large extent. In the past they stopped GC processing for short time but this time it seems to be a totally different case. The promise that they will start GC later does not seem to be true as we hear from top management. That is only a promise to keep people still waiting on hopes as long as they can. They may process it but only for a very few. Many account managers are given targets to cut H1B in their accounts. Also if you see the latest job posts, it is clear that they are specifically looking for people who don't need visa sponsorship. There are some other rumors that the H1B / L visas will not be renewed in the coming months. So don't be surprised that after we wait in anticipation for green card or visa renewal, we may be asked to leave. Offshore is not a promising place anymore to go back and find a job if they send us back. It is certainly a very bad time. Think and act before it is too late. I am on the same boat like many of you. No hopes about future in Cognizant now. If anyone can advise on a better thing for everyone, that will be great. Hope everything works out fine for all.

EB1C suspension will probably be annunced officially next. hopelfully within the next 6 months to 1 year. This is too toxic a climate for them to be trying to create loopholes by making announcements that belie their actual negative impact to the whole immigration debate- that CTS has been singled out not just by community but named by the President. one report from a premier us news print saying something like "EB2/3 suspension was a sham since EB1C has been gobbled up by CTS as a loophole and EB2/3 suspension was just a clever misdirection" would destroy CTS reputation permanently.

My maxout date is June 2021. Had opened request for GC in 16 Nov 2016 and pre-processing for case
on 30 Nov 2016. Also, got couple of email from GM in Feb 2017 for more clarification on document and they confirmed by case file is ready and will be filed as per the queue.
Suddenly, EB2 and Eb3 filing is stopped. I had spoke with my manager, he is also not sure when it will be resume. But he said, its not going to be long and will be resumed soon. I need not to worry as I have more time in hand. Can someone confirm if they heard anything when it will be resumed?
