Wow, I had no idea this thread got so many replies. For some reason, I didn't get email notifications.

Thank you everyone for sharing your knowledge and experience. I am still waiting, they said that they should resume submissions sometime next week or so, at which time those with maxouts approaching will get priority. I'll keep you all informed.

I've heard of several CTS employees who got PERM audits, and have also heard of some who didn't get audited. So, it's luck I guess. We'll see.

Hi Tanya,

I think the reason CTS gets so many audits is because back in 2011, there was an incident where some American employees of CTS blew the whistle to the INS regarding CTS bending the rules related to H1 processing (you can find this on google). Since then, I think CTS is being tracked carefully on INS' radar.

To answer your earlier question, I didn't apply for GC all this time since I only joined CTS last summer. Before that, I was with a very small (desi) consulting company and I didn't want to file GC with them.

I also have to say that so far, CTS has been very good with me. My H1 transfer had gotten an RFE, and CTS handled it very professionally. The only thing is that they're slooooow. They waited until just a week before the RFE deadline to submit the required evidence, and now it looks like they want to wait until the last moment before filing my PERM. I'm guessing they're overworked since they're probably working on immigration cases for hundreds of employees simultaneously. Plus there's the bureaucracy that's inevitable in any big company.

I think that whenever they do file my PERM, I'll ask my account manager to put pressure on the immigration team to make sure the paperwork is flawless (I might even hire my own lawyer to double check)...then hope for the best.

I escalated to my account manager and he gave me the reference of some senior people within the immigration team. They also told me the same thing (that CTS is still doing the PERM recruitment cycle), but they said that it's expected to get over by mid to late May.

So far, I don't know of any CTS employee who has had PERM filed in 2012. But I do know of a couple of guys who got PERM audits, and one case where the guy didn't get an audit.

1) What was the reason you got RFE in transfer?
2)Are they processing your GC in EB2 or EB3?
3) How far in future your got extension? Was it though I-140?

Yes their immigration team is very very slow in work. They don't work fast until you put pressure on them.

1) RFE in transfer was to prove client relationship. We resolved this by sending them a copy of the client SOW.
2) I don't know if they will process in EB2 or EB3. I don't have Masters, but I have 6 years of US corporate experience, so I will push them to do it in EB2 (by making a huge fuss)
3) I don't understand this question. They haven't submitted my PERM yet.

CTS will stop applying green cards soon.. CTS will be sued by Immigration as they are filling EB1 even for developers..

I'm in the same boat. Uploaded all the documents on Feb 10th and since then waiting for PERM filing. I'm, also maxing out in Oct-2012 on my H1B. As per the last email from immigration team, they don't have any specific timelines when they should be able to file for PERM. They said that there are some changes in the guidelines from DOL and they are currently reviewing them. It's on Priority expiration alert. On the portal last status it shows is "Pre-Processing for case completed". nothing after that. Please share if anybody hears back anything from the immigration team.

CTS applied my perm in Sep 2011 , no update till now. we can wait for a while but i am worried if perm gets rejected after waiting so long that will be very bad. One of my friends perm got audited and it took 2 years to get the perm approved but finally it was approved for him.

I got an email from immigration department that since Nov '2011 they did not filed any PERM applications.So,since last year,they are not filing at all.Also they are sending template driven responses to all the concerned people like all of us.I think there should be something fishy or to be hidden happening in the immigration.About the Immigration team,they never disclose their policies,their pattern and guidelines for the category,PERM fling process and had very unprofessional approach with the associates towards their proceedings.I request top management,please streamline the immigration process ,else lots of people will be in doldrums in their status which will impact the projects.

Really, all we can do is escalate to our account managers, and make them realize that if we have to leave the US, then it will have a negative effect on their account and their standing (in fact all of CTS' standing) with the client.

There is no transparency wrt the immigration processes at Cognizant. Last 6 months they are repeating same statement. They should atleast have some plan to move forward but no. Probably they themselves don't know what they are doing...just trying out.

Somebody from Senior Management has to initiate and seek a clear explanation from the Immigration Department what exactly happening behind the scene?Why they are not filing fresh PERMS(GC)since last November?What is the situation of those people who got few months of time with H1B validity and awaiting for the GC?Since Immigration department is bit aggressive in H1B transfers for the new joinees,whereas for this issue they are not..,If they shield them not to disclose the proceedings ,lots of people career will be in stake and it will impact projects and their continuation.

I got an update from Immg dir, still they are working on DOL recruitment processes and should get over by few weeks. God knows what's goin on , what process Cognizant following...they are not sharing any info...
