Topic: I485 Process for CTS (Cognizant) employees

Hi Bhajarangi-
My case was interesting- My eb3 PD was Oct 12,2004. During Sept 2015 -Eb3 dates moved to Dec 22,2004, so Eb3 was current. Also Eb2 perm and I-140 was approved as well. I did not file a new I-485 application as it was already filed during 2007 when all categories became current for a month.

Along with Eb2- I140 immigration team send a cover letter to port my old PD .That's all.

In reality I don't know which category was used Eb3- dates were current in Sept 2015 or Eb2 using the old PD. Doesn't really matter as end result was same

Topic: I140 application for CTS (Cognizant) employees

Hi cts2012-

Eb2 was with same employer C -:). After waiting for so many years my Eb3 priority date (Oct 12,2004) became current in September 2015, and Eb2 I-140 was also approved in Aug 2015. So I am not sure whether USCIS had to port my application or it was just straight forward Eb3 approval.

Either way result is same " Green card approved"

On you your question abt priority date retention- I believe that you need to have I-140 approved and stay with same employer for more that 180 days after I-140 approval in order retain priority date (in case employer revokes your application after you quit the GC filing employer).

* This is based on what I read here in forums , so may not be accurate . So please consult a lawyer.

Topic: I485 Process for CTS (Cognizant) employees

Here is my Journey
Aug 2003- Got an internal approval from my manager to file GC
Next 14 months did nothing for unknown reason
Oct -2004 filed GC - no idea about Eb1/Eb2/Eb3- Did not even know what category it was filed, funny thing is that I did not even know that there are 3 categories for employment based green card.
At this time I already has 5 years for progressive experience but my application was filed under Eb3 , which I came to know when RIR(as it was known before PERM) was approved.
Next 2.5 years - waiting for RIR to be approved. Read that all the RIR application sent to backlog elimination center
Jan 2007- RIR approved- This is the first time that I came to know that the application was filed under Eb3
Apr 2007- I-140 filed
June-2007- All dates supposed to be current
July 2007 first week – All the categories unavailable
Lot of discussion on forums, flower campaign etc. struggling to get medical apt.
July 2007 end Suddenly USCIS decides to accept applications. Got the medical done somehow. Shipped the application for self and spouse.
Sep 2007 – Got EAD- did renewal 6 times since then .
Dec 27, 2007- New PERM filed under EB2
March 23, 2015- PERM approved after 14+ months
Next 2 months – I-140 filing struggle, filed under regular processing on June 15 , 2015, as could not get PP approval
July 15, 2015– All of sudden my VP approved PP request. Upgraded I-140 application to PP
July 22, 2015- RFE on I-140 send to immigration team , took 5 days to receive (RFE is about Ability to Pay)
Submitted W2, Salary slips etc no Big deal.
Eb2 I-140 approved within 3 days after submitting RFE response.
Meanwhile
July 15th – RFE issued for self and spouse on I-1485 with receipt date of Aug 13, 2007
After waiting for 2 weeks and not receiving RFE documents tried to book a apt at local USCIS site. Got the apt only after 3 weeks.
Went to USCIS office, apt at 9 AM. Most helpful lady officer, checked my records and informed that RFE has been issued. I told her I am aware of that but did not get the documents.
She called NSC and asked them to fax the documents. Waited for 6 hrs for the fax to arrive. Finally got RFE faxed, lady officer handed over fax print outs including forms for medical and biographic.
I-485 RFE details- Latest Biographic form, Medical forms, Job evaluation, location of the job.
Surprisingly even after updating address on time, and receiving EAD cards on new address RFE was sent to old address.
Good lady officer also asked NSC to send the RFE to my current address (received it on Aug 20, 2015)
Performed Medical – had to search frantically to find a doctor.
Filled Biographic form, got required documents from the company (took 6 weeks and had to use all my connections and contacts, frustrating ….).
Created a set for RFE response.
Checked lawyers to prepare response, fees were exorbitant ($1500 to $2500 per person).
Decided to file RFE response myself.
Created a cover letter and used UPS to ship RFE response documents.
USCIS update received next day that they have received RFE response.
2 days later created online SR to enquire.
SR response email received next day at 10 AM mentioned that an officer working on it and should receive an update in 60 days.
3 PM of same day – new cards ordered txt received.
Next day CPO email received for self and spouse
4 days later welcome notice and cards received (Oct 1, 2015)
Did not get tracking number from USCIS, so registered on USPS site with my name and address and started receiving updates the moment USCIS created pre-shipping labels.
11 years journey coming to happy conclusion.
Apologies for long post.
