thats true. But,attorney should be aware of this clause & be seasoned to handle such case. As i have seen its sometimes goes unnoticed by USCIS.

Thanks Spidey,but one last question.

There is conflicting info laying around(Murthy/ImmiPortal) etc.,saying if one had exhausted all 6 years & later had 140 approved,it "WILL" be subject to cap,as new H1? And we need to wait till April(of the year) to apply new H1?

I was just concerned that i had used 6 years(7 years to be precise) with H1/L1 & outside US for less than 7 months in India.

Was concerned if i will be able to do H1 with cap exempt,now or to wait for 1 year.

Its just the matter of GSD responding,however if you have receipt# you can track yourself?

140 was approved on Monday,i didnt check my CTS emails until today. And i see it was done.

Its been quite a ride,Thank God.

Done half way now.

just get the D+ approval,citing the fee$.,Though they have a format,dont think they care of any specifics if you have D+
