Topic: H1-B transfer in 6th Year based on pending PERM

1. Your new h1b renewal can only be filed by 01/08/2015. And you will need a proof for PERM pending since 365 days. This can be done by your existing employer or new employer. this require screenshot of perm site( which your attorney / employer has access) with status IN PROCESS.

2. You should not switch at this time. Since PERM processing time is over 6-7 months for clear case. and if audited over 14 months.

Suck it up, keep present work till you get i-140.

Even if you switch to consulting, there is very high possibility your new employer will not care for your immigration status. They talk nice till u join. Also finding a stable long term project is required even if you have approved i-140. Consulting is also not that great..

Source: I work for consulting for over 7 yrs and I did extension based on 365 days rule.

Be patient, see the light at the end of the tunnel..

Did your Attorney send you screen shot that your case is still in progress.?
If (Yes)

I hope you are aware that during Audit - status still shows In Progress.

Your employer should have recd Audit letter / outcome (like selected for Supervised Recruitment etc.) which needs response, within some time frame.

Like Obamacare site, Labor Certification Registry is down half of the time.

Some of us already reported that its not showing correct data (they saw their case approval one day and missing next day)

I tried to extract data from http://usaspending.gov about - Which company did this patchup work and How much money they made?

Its common sense, Since each case if vetted individually.
Who would want to do a matching game for 500 cases Left side ( PERM Filing) to Right Side ( Requirement) with your permanent Fed Govt salary of < 60K/pa. If they wanna work this hard, they would had joined Private sector.

The only way to resolve such situation is have collective decision. (Since I cannot make Flow chart)

Step 1. Denial / Audit
Step 2. Audit > Denial > Appeal
Step 3. Appeal > BALCA > Denial

I hope nopnop ( dolstats.com) to provide stat regarding this.
Which company got max approved ?
Did they file individually?

Please go thru this thread and other places as well.

1. Most of people are stuck in CTS internal queue, even before DOL's hopeless process.
2. DOL is not happy with CTS's filing. Check icert PERM registry for this years CTS PERM record.

As someone said, Do not join CTS on the promise that they will file in 6 month or even in a year in EB2.

Note: I am not affiliated to CTS. I got similar offer but I let it go based on some well wishers advice.

DOL does not work for immigrants rather it is a welfare agency for residents.

If the original intent is to give you GC, DOL should make this process clearly defined.

For employment based, GC this is one of the crucial check, even for non India-China countries. They don't completely stopped PERM Processing like other countries ( UK, Canada etc). This keep busy all these Immigration attorneys offices. Without openly saying, DOL discourage external employees to take US jobs. Even DOL denials are baseless - advt incorrectly, travel requirement, etc etc. is just to make us to frustrate, keep you in the queue.

Bottomline: DOL - PERM Processing is a big BS. All Immigration Firms / Consulting firms / Placement firms support this. Since their income is directly proportional to time you spend in this queue.

I don't expect this to improve. Moreover, This does not require CIR.

My 2 cents

1. 7th Yr h1b transfer /extn will need proof of PERM Approval or PERM in process for over 365 days.
2. sometimes RFE for Copy of work order (new employer and his client) where you would be placed.
3. Sometimes, h1b validity based on work order / agreement ( item 2)

My suggestion - Join new employer only H1b approval.

I dont know where I am trying to control / close any discussion. One thing is clear you are not able to comprehend anything..

DOL does not care whether you are CTS or non-CTS, why then brag about it or even have a seperate discussions about it, all the doubts are due to company policy. And no one here can help you anyone to to understrand.

I thought at Trackitt, people share / discuss immigration related matters / experiances, not one specific company immigration policy.

Do you have any sense to talk to peers?

I am just trying to understand why CTS people not discussing their internal matters within company?
From where this confusion starts?
Will there be any end to these discussions?
Also, I have noticed so many hard core CTS believers and non-believers keeping these discussion alive.

Will CTS's immigration matters be remain hot topic and be discussed all over internet forums and will create wanted or unwanted advertisement.

I wonder why CTS folks have so much confusion on immigration matters?
Don't have a clear cut policy?
Even on case by case basis, Why don't CTS HR clarifies them? one2one..
Why there is need to discuss internal matter publicly?
Are you affiliated with CTS? - Will it be possible for you to post CTS Immigration policy here of somewhere these people can read.

The point I dont understand, why all CTS fellow make thier own thread here..

Your company does not provide clear guidelines.
Why dont you discuss within your company walls? No outsider wanted to know what you do, why you do or not do?
Why they brag here.

Only attorney to draft reply & Fedex to them ( along with all past documents) before last date.
Yes, Govt Error would be done fast, within 2 weeks you will get some outcome.

Is any possibility of L1A > EB1.. Then nothing like it.

1. Did you signed some affidavit and submitted with your audit answer ? If you are not aware ask attorney get a copy if possible?
2. your HR must have prepared a recruitment report? what does it says - did they failed to submit that as well?

These seems like simple issues, you should get all documents - Original file application & audit reply.
decide yourself - whether your attorney reply on both points. If yes you have good chances to get thru this.

If not, your attorney does not know what he is doing.. Change it for the next PERM.

let me share my experience, My attorney offered to do it free and will only charge $1000 if outcome is positive.
You must appeal. I am surprise why he is reluctant to appeal.

Worst scenario, if your audit was not replied with above documents. that means your attorney & your employer is doing it deliberately. I hope you understands - what does that means.
