Thanks wiweq, for your inputs.

So do I need to apply rule AC21 before I switch to the new employer and then produce the offer letter with it or after switching. What happens to the I-485 case which was pending from the previous employer?

Secondly, moving onto EAD/AP a good option at that point in time, when we have transferred our H1 to the new employer?

So many things and reading, I am getting confused. Appreciate all your help.

Hi Karan,

Thanks for your inputs and guidance. So does that mean, after I-140 is approved, we can switch jobs and the new employer doesn't need to file a PERM again?

Will our older PD be applicable, since say the I-485 is in waiting state, to become current. Can the employer revoke I-140 after we stay with them for more than 180 days?
If they revoke, what happens in that case? Does my H1-B extension become invalid? Am i allowed for further H1-B extensions and on what basis (pending I-485)??

Hi All,

I am new to this forum and have a question on the current PERM.

I am currently in the 7th year of my extension based on PERM pending for more than a year. More than a month ago, completed the cool-off period of 1 year and would be travelling to US soon (hopefully).

Based on this H1 extension, that I have for 1 year for Employer A, can I transfer this to Employer B?

Does Employer B need to file a New PERM and if that is pending for a year, can this transfer happen?

Or should I wait for Perm Approval and then move to the new employer?

Any guidance in this regards is highly appreciated. Please point me to any earlier post, if this question is repeated.
