My Case is like this:

Got RFE : 10/13/2017
Case Status updated as "Request for Additional Evidence was mailed'

RFE Respnse (regular): 12/28/2017
Fed-Ex was received and signed by USCIS on 12/28

But till now Case Status still showing as 'Request For Additional Evidence was mailed".

Any thoughts

I too got this RFE and working with attorney for the same.

Type- H1 Transfer
I-94 expired now
I-140 Approved
5 yrs 6 months on H1B now.
Total experience - 12 yrs

RFE reason: L1 Wage

My attorney working on following 2 responses:
1) Getting a certified affidavit which is referred as expert opinion letter justifying proffered position is speciality occupation
2) Putting attorney arguments stating wage level comes under DOL jurisdiction and not USCIS

Not sure how this going to work.

No need to leave the country as far you get H1 extension Receipt number before your max out date.

You have 240 days period before which decision need to be taken by USCIS. If no decision , then you need to leave the country which is more unlikely.

Lets consider below scenario:

If my old employer withdraw my approved I-140 (it was approved more than 1.5 yrs), can it will be get revoked? Then can we still use that I-140 for H1 extensions?

Do the employer now having the rights to withdraws the approved I-140, even though it was approved since more than 1.5 yrs?

I have my H1-B Max out on June 2018. My Current H1B validity ends on Aug 2017. I have my I-140 approved on Feb 2016.

But last week unfortunately I got terminated from employment and H1-B revocation may happen. What are my options?

1) I got one employer who can transfer my H1. What is the period within this transfer needs to be initiated?
2) Can my new employer use my approved I-140 for H1 Transfer + Extension? is there any chance that I get or eligible for 3 yrs extension?
3) If I don't get 3 years extension, how I can stay here beyond 6 yrs..

Topic: H4 Extension (I 539 petition)processing time

I have my I-94 expiry date as 11th Aug 2017. Immigration team in the process of filing H1-B extension in another 7-8 days. But now I need to work for another client and another location probably by another couple of weeks.

During this scenario how immigration team will file my H1B extension? Are they first file my amendment so that I can go to new location at the earliest or are they jointly file extension+amendment together?

Any delay in filing will impact my joining date to client location. Any suggestions/inputs

I have my I-140 filed by GIT today in regular process. Looks like they filed yesterday (9/28) and today got the email saying 1-140 filed and provided the Fed-ex tracking number.

My perm expiry date : 3rd Oct.

So I believe my next step is to receive the receipt number from USCIS which may take 2-4 weeks, After that there will be 3-4 months wait to get the I-140 approval (ofcourse it depends upon luck !). The FedEx destination is showing as Texas, so I believe Texas is my processing center. Please let me know if my understanding is correct.

Also all the best for the people who is going through frustrated nights hearing for their I140 submission status

I have got below email from my Case Manager:

"I have prepared your I-140 for filing and it should be filed shortly. You should receive an email with the tracking information within a few business days from when the case is filed. Please continue to monitor MyVisa and your emails for further information."

My perm expiry date: 3rd Oct.

My Perm expiry date will be on 3rd Oct.

Yesterday (9/22) I got an email from GIT to asking me to fill up some I-140 questionnaire etc and upload some supporting documents, which I did completed today.

Just wanted to know is my I-140 process is on right track? How much time/days they will take to file the I-140 after the associates send them the filled questionnaire etc.

Hello,

Mine perm will expire on 3rd Oct. Till now I-140 is not submitted by GIT. I have raised many GSD tickects and sent an emails to Case Manager. Only reply I got that it will be filed before perm expiry date.

Some of my friends whose Perm expiry date in 1st week of Oct, got their I-140 submiited in 1st wee of Sept. Not sure why is the delay in my case.

What else I can do to get my I140 submiited on time apart from just waiting.

My PERM got approved yesterday:4/6. PD: 30-JUN-2014.

I have found my case in Icert portal. I didnt got any email from GIT though.

Do I need to followup with GIT or can wait for couple of days? Also do they start I-140 process immedietly or it require any wait time. e.g based on Max out period etc.

All the best for other folks who are awaiting their Perm approval.

Looks like DOL is not processing the application on particular series basis. May be they are doing random picks..Hopefully will hear some good news in coming week

Mine is PD 30June2014 with series A-14178-xxxxx. Not got any update from GIT as well as not seeing my case in Icert. I will update you guys if i heard anything on my case.

My PD is 30June-2014 with series: A-14178-XXXXX. Did anybody with PD for the year 2014 got PERM certified? Given the current rate of Perm processing by DOL, when we can expect the updates for June-2014 cases?

I have been seeking some info ..please apologize if this is silly as i am totally new to this Perm world..

Lets say that avg Perm processing time is 6 - 7 months. During this period is it possible if we get some kind of update from DOL, like Perm is either 'Approved' or 'Rejected' or 'Need Audit'?

One of my colleague still awaiting for the status since last 10 months.

If we get some kind of update then it will be easier for us to plan our career options.

My PD is 30-JUNE-2014.

I have my colleague whose PD is somewhere in Jan 2014 and she has not got any update till now.

I am in assumption that average processing period for Perm 2014 application is around 6 - 7 months. Even if it goes for an Audit, can't we get notified in these 6-7 months? Perm application with more than 9 months waiting without any update (Approved/Rejected/Audited) is kind of frustrating.

Is this normal, in precise normal for CTS folks?
