I am not sure if this is a USCIS thing or a CTS thing. But the immi folks at cts say that it is a USCIS new rule :( I dont know how to contest it if that is really not the case. And on top of it all - anyways even if they do file H1, I would still have to hope that my application gets picked up in the H1B cap lottery! Last time I heard, the expected application count is going to be 300k this time! So I am not counting on H1B at this point. Made my mind up for a return/canada!

EB3? Why would you stick to cognizant for an EB3 that too with a priority date not very long back? I would say go back, switch and come back after a couple of years or so.. Either that or look for options in Canada. - This is what I am looking at too :(:(:(

Hello my knowledgeable friends.. Here is my situation..

My L1B visa with Mar 2015 max out date was converted to L1A and now my new Max out date is Mar 2017. If I do not get through the H1B lottery next year (2016), is there any chance of me staying in the US beyond Mar 2017? Please let me know.

My GC status - EB2 - Priority Date Dec 15 2013. Pending i140 approval - filed on Aug 27 2015.

Note: I was deemed ineligible to apply for EB1 even though I got my L1A. (Its a CTS thing)

I just received an email from my case manager that she has been assigned as my case manager.


I have been assigned as your I-140 case manager. We cannot provide an exact timeframe for the I-140 submission. It must be filed within 180 days of your PERM approval, and this will be filed in advance of the expiration date - blah blah blah!

How long do they take to file the i140 after sending out this standard email? My PERM expiration date is on 09/19. Any insights please? Thanks in advance.

Reached out to one of the top guys in the immigration team and he said i140 would be filed within 180 days of PERM approval but no specific time frame. So at this point, we can just assume that folks who have a visa extension / expiry / maxout coming up would get priority in getting the i140 filed. All others just work out the 180 day window and wait for the time to come - just like me :(

Cognizant said no to that request (EB1). I got promoted to an SA only after coming onsite and so I was deemed ineligible! :(

Hi friends, I am new to this whole process and so pardon my ignorance.

I am currently on L1A visa (Converted from L1B to L1A 6-7 months before L1B max out). The L1A max out date is March 2017. My perm got approved (EB2) in April this year (Priority Date: Dec 15 2013).

If I get an i140 approval within the next 6-9 months, can I stay beyond the maxout date on L1A itself till I get EAD/GC? Or do I need to get H1 to apply for extension?

I am worried that due to the very high number of H1B applicants, I could easily miss out on the lottery. Appreciate any insights on this.

I could be the umpteenth person asking this. Any updates on PERM filed last year end? My PERM was filed in December last year and I'm sure I am well behind in the queue. Anyone got any sort of updates regarding their PERM? My concern is that the documentation that we had submitted for our PERM would be outdated by now. Thoughts please?

The main reason I am even thinking about L1A to H1B is for staying beyond the max out period. My hope (Which is fading away) is that my PERM would somehow get approved by the end of this year and if I somehow manage to get an i140 approval as well, I can extend my stay here in US only if I am on H1. My current L1A is just delaying the inevitable - which is going back to India.

I converted from L1B to L1A because I did not get through the H1B cap this year and my L1B max out is in Feb 2015. I converted to L1A and now have time till July 2016. My question is, now that i have that time, can i apply for a fresh H1 or conversion from L1A to H1 next year or the year after?

My PERM was filed in EB2 category in December 2013 and no updates till now :( Wondering if cognizant is blacklisted for all PERM processing.

As for my visa, I have my L1B max out in Feb 2015. However I got a conversion from L1B to L1A earlier this month up to July 2016. So now that I have my L1A, would I still be able to apply for H1 next year so that I can stay beyond 2016 if my PERM and i140 gets approved before then?

Appreciate any information on this.

Topic: Query Reg. L1 B Max Out - L1 B to L1 A Conversion

Hi all,

Since I did not find a forum for L1B /L1A visa, I am posting my query here.

I am currently on L1B visa and my visa is valid up to Feb 13th 2015. That is also my max out date.

I did not get a H1 this year. As an alternative, I am looking to convert my existing L1 B visa to L1 A. I have initiated this process on my company's immigration site and have submitted the required documentation. I have the following questions.

1. Will I get an approval notice for the L1A visa if and when it is approved?
2. If there is no approval notice for L1A, do I have to go for a direct stamping in a counsulate (Say Canada or India)?
3. When should I go for the visa stamping considering that my current visa max out date is in Feb 2015 (Within the next 9 months or so)?
4. My wife is on L2 visa and she is currently pregnant. If I have to go for a visa stamping immediately, is it ok that only I go for the visa stamping or does she have to join me for the stamping at any cost?

Any information on this would greatly help.
