Under this new rule effective from Jan 2017, if I have an approved 140 with an employer and stay with that employer for more than 180 Days I know I can retain my PD even if i change my jobs, and can I still use my previous I-140 to extend my H1-B beyond 6 years...

But my case and question is -
Initial I-140 was in EB3 category and have already covered the 180 day limit on that approved I-140 (and my 6 years on H1 also already completed).
Meantime, my company has upgraded to EB2 category and filed for a new I-140; waiting for approval now.
So Once I get that new I-140 in EB2 category approved, do I need to again stay more than 180 days with this new approved I-140 to be eligible for the new executive action to retain my PD before I can switch jobs??

Kindly help and advice.

Ok, so I am new to this forum, and would sincerely appreciate if some stalwart here :) can please let me know the latest news on EAD after i-140 is approved? With the knowledge on this rule, could someone pls tell me whether USCIS has made any progress in bringing this rule to fruition? Will it see the light of day in some months or years?

Thanks for the reply...I have told that my case Denial is due to some minor issue, so they do NOT need to go for BALCA...they would only like to file for Reconsideration (which goes to the same DOL officer and mostly the response is faster, though no guarantee of that).
But do you have any idea, regarding the outcomes for cases who file for the new PERM within sometime after a Denial of old PERM?

Thanks...but i guess i may want to file for the new Perm rather than keep waiting endlessly in reconsideration (thats what i am hearing from friends)....Couple ofquick ques, and of you may know the answer
1) Can we in parallel file for recpnsideration and also for a new Perm??
2) But if this is either/ or case and if we file for a new Perm, can we get any extensions later while my new Perm is Pending for approval??

I would sincerely appreciate some prompt responses...

I am from March 2013 PD date, EB-3 category and I just got an email from GIT that after being 2 years in Audit, my PERM has been denied.....Is anyone else in the same boat?? What could be the next best steps..My 6 years on H1 have been expired...and i am on the extension based on perm till August 2016...

ohk...Good to know. So did your case also went to Audit? And if yes, when did the GIT submit the response back to DOL? Hope ours Mar PD date Approvals start soon. Good luc.

I guess though we are still seeing approvals for c*s...for the last few days we haven't seen anyone from Feb or Mar 2013 PD dates...I am Mar PD audit case...Has any case from Mar 2013 audit cases got approval yet?? Hope after our bros from jan 2013 audit cases got their approvals we will see our feb and march pd audit cases also approved : )
