Topic: H1b extension processing time - Nebraska

I'm assuming the delay is because of the workload transfer from other service centers to Nebraska service center.
https://www.uscis.gov/news/alerts/workload-trans...

I'm watching every day to see the progress and it looks like none of the September filed cases have been processed yet. And USCIS hasn't updated their processing time yet since September 30. This scares me a lot.

I just read on USCIS website that Premium Processing Service is currently suspended for all Form I-129 filings that request a change or an initial grant of status for beneficiaries within the Commonwealth of Northern Mariana Islands (CNMI).

Are they talking about premium upgrade?

Topic: FOIA to get I-140 information

For me, it took around 2 weeks. If you don't hear from them by then, you can send a follow-up email.

I have sent a request to get a copy of approved I-140 on November 3rd, but so far no response from USCIS.

Usually how long does it take to get a tracking number?

You can subscribe for email alert / text alert using your receipt number and USCIS will update you whenever there is a status change in your petition.

Topic: I140 Premium

Usually an email of receipt notice is sent from USCIS to the lawyer within 2 to 5 days of receipt if they filed in premium. Then they send out a receipt notice through mail. Which service center? Is it Texas? Why don't you contact USCIS? The email for Texas service center (only for premium processing) is TSC-premium.140 at dhs.gov

Topic: Urgent: I-140 filing by two employers

Would there be any conflict since two different employer are filing I-140 and trying to port the priority date? Is there any chance that USCIS rejects one of them?

Topic: Urgent: I-140 filing by two employers

I'm currently employed with EmployerA and I already have an approved I-140 in EB-3 category. EmployerA has now filed a new I-140 in EB-2 category asking for porting the priority date and this I-140 has been filed last week in normal mode. Now I have a job offer from EmployerB who will also be filing I-140 in EB-2 category asking for porting the priority date from EmployerA's I-140 petition and this I-140 will be filed in premium mode. I already have PERM approved from EmployerB on account of future employment and the employer is ready to file my I-140. Now, will this cause any issues when both the companies are filing I-140 on my name? I need your valuable inputs before I move on. Thanks in advance.

Do we know how long GIT is taking now to upload the receipt notice from the date of filing I-140?

PD is the date on which PERM was filed. This is the date you should see in the approved I-140 under priority date.

Topic: URGENT HELP :: H1B and I140 transfer after 6 yeasr of H1B

Your new employer can use the approved I-140 from old employer at the time of H1 transfer and ask for a max of 3 yrs extension. But it depends on USCIS on how much time to give you on H1. If your old employer withdraws the I-140 after you quit, then you won't be able to use the old I-140 for further H1 extensions. You need to make sure you get your new I-140 approved before your H1 expires so that you can use the new I-140 for H1 extensions. If you are going to use pending PERM for H1 extensions, then I think your PERM filing date has to be more than 365 days old. I'm too not a lawyer.

Thank you fusionora, madhuusa13 and Rajiv2015,

GIT finally filed my I-140. They had filed yesterday and did not notify me. I checked with the contractor this morning and then she updated the status. I was very much worried since my PERM was expiring in 2 days and my docs were last accessed in MyVisa by 1st week of Aug. So much wait time to file. Now more wait time for approval.

3 more days for my PERM expiry and they haven't filed my I-140 yet. Tried to contact them but no response. This is frustrating me a lot. Not sure what else to do. Any suggestions?

I think you can submit a FOIA request to USCIS to get the information.
