Topic: Instate tuition for H4 dependent

Hi,

I am also in the same boat, staying in NJ, and my daughter started 1st grade here and will start college in 2019.

Talked with counselors at school and they are also saying the student will be considered out-of-state as she is on H4.

Please update if you find any new info.

Topic: Need info on travel to Berlin(Germany) Via London

Please call the airline and confirm their policy.

Last time we had to wait 45 mins, while traveling from U.S to India via London with an expired H1 visa though we had valid I-94 we got through H1 extension in U.S. (We were traveling for stamping H1 visa in India)

Airport personnel told us that we can't transit through London since we don't have valid visa stamped on our passports.

We did ask her how we get back to India and her reply was direct flight to India. But after 45 mins and many phone calls and eternity of tense moments, she allowed us to continue the travel.

So just to avoid the headache, call in advance and confirm their policy and book the ticket.

Topic: H1-H4 VISA Stamping using drop box @hyderabad

After getting DS-160 confirmation number and paying fee, you should get a visa interview appointment.

During that it will ask your eligibility for WIP/drop box and once you click "Yes" to those questions, it will give you a drop-box confirmation number.

You will take the print-out of Drop-box confirmation letter, DS-160 confirmation page and other documents to VFS for drop-box.

Book the ticket once you receive the e-mail that your visa has been issued.

In my case I had to postpone return journey twice, since my estimates about I-140 and H1-B extension (everything in PP) came short.

If I am right you have only one visa stamped on your passport which expired on 2010?

After your extension, you didn't get visa stamped?

In that case I think you don't qualify since your last visa stamped from India expired before one year.

It is when you try to get an appointment date for visa interview. They give a list of questions and if all YES, you can go for drop-off.

I am in the same situation like you; came back to India before H1 max-out and working remotely, paid in INR, waiting for I140 approval and H1 renewal.

1. Our attorney informed that once I140 is approved, he would apply for H1 extension premium. Once that is done, go for stamping and go back to U.S

2. No idea what it is...

3. Somewhere I read I140 email is enough for H1 extension as I140 and H1 is handled by the same agency. Experts please comment.

Topic: Working in India as Independent contractor (W8 or W9)

I am in the same situation, May-8-2013 PD and H1 maxing-out first week of Jan 2014.

I am going back to home country this week and will work as a consultant till I get my Labor approved and H1 get extended after I140.

I will be paid in home currency in home country. I would be paying my home country income tax for whatever the money I receives there for whatever period.

My best estimate is less than 2.5 months to come back to U.S provided I have a successful H1 stamping.

My company HR/attorney didn't mention anything about W9 or W8

I will be working from my home country and payment would be in home country currency.

So you will be working through a third-party consultancy company whom with your company have tie-ups to supply man power.

Once your H1 is stamped and you are back to U.S you will resume with your company.

In my case, they promised to continue with this setup as long as it takes to get H1 renewed as they need ongoing support on projects.

So far that is my understanding :-)

Same here, PD first week of May'2013 and max-out date on 05-Jan-2014

As per attorney's advise, planning to go back to home country before max-out date; company will terminate the employment in U.S and will retain as a consultant till H1 get renewed and back to U.S

a. As per my attorney I would be eligible for 3 yr H1 extension once Labor and I140 cleared.
b. He advised me to leave before the current H1 expiry.
