Appreciate your replies, suggestions, experiences about below queries.

Question-
1. If I go back to my home country with a new employer (C), can I get my GC done when my PD becomes current staying in a home country?
2. Or do I need to join the same company(A) who sponsored my PERM & I-140 in USA/home country?
5. Or Can I join a new employer in the US to file my GC?

Basically, I would like to know if one can continue the GC based on I140 approval from home country with these different situations?

Hello friends!
Need some advice regarding this.

My I-140 got approved with Employer A. Now my I-140 is NOT revoked by Previous Employer and I switched my job to Current Employer (B) and got 3 yrs H1-B extension for First time based on my Previous Employer's (A) approved I-140.

A) Now, with current employer, my 3 yrs will end in 2018, if my current employer doesn't do my new PERM/I-140 then is it possible for my current employer to still renew my H1-B for Second time(or subsequent times) based on my Previous Employers Approved I-140 and will I still get 3 more years of H1-B extension?

B) Can I change current employer and get an extension based on my I-140 from employer A?

I want to discuss below case. Appreciate your replies, suggestions, experiences about the same.

I have I140 with PD of 2015. Max-out - End of 2018.
I am joining another company B using my current employer's(A) I-140.
Question-

I was in ZenSar and need experience certificate for GreenCard. Tried reaching HR and other colleagues, but did not help.

Does anyone know the point of contact for getting the certificate from ZenSar?

The approved I140 and EAD for spouse is not at all reason to speed up your process. Everyone would have got it done in PP.

No one will help to expedite the process, so sit back and relax for around 4 months.

I think someone mentioned in the previous post that Sep-18 got I140 approval. Oct-15 will need to wait for around 1 month or so.

First Congratulations on I140 approval!!

To retain PD, it is not mentioned anywhere in USCIS that you have to wait for "xyz" months with current employer.

CTS is definitely going to withdraw your I140, but that should not affect you if you are already in a good situation(already got the extension or have a good remaining time on H1B).

Retaining PD is case by case and hence, everyone will give you a different opinion.

Congrats for 140 approval!!

I have seen many guys with 140 approval and I am sure that this approval is more interested in only below cases..
1. H4 EAD
2. Extension beyond 6 yrs
3. Change employer? (on risk/luck of no PD retention due to USICS past results on porting PD)

So not sure what else is the reason to celebrate?

We are talking about 140 EAD but as we all know, it is not going to be easy and uncertain.

1. After PERM approval ,can I pay for I140 premium and get it with a month. For me director approval is little difficult. Ready to pay I140 and all other fees
--> Your PERM would be approved in around Dec, after that your I-140 will be filled in Mar or April (if lucky may be earlier)...
Now to file in PP, you have to have d/d+ approval and you can't pay on your own.
As you said D approval is difficult, it will go in normal processing(unless max out priority) and around 4 months time to approve it. = around Aug-Sep-Oct-2016.


2. Can I leave USA and file I140 from India
--> Yes, and I think that's the best option as of now for you.

3. For Premium ,how to get it on premium without waiting for 6 months in queue . Can HR help me as staying alone with 3 year baby is not a easy task for me

Well, the discussion was started as "It is safe to wait for 6 months before joining another company".

Now we are discussing, ppl are not able to carry PD after 8 or 12 Months.

Both are contradictory.

I don't want to give examples but summing-up--if someone really wish to join a new company after I140 is approved, he can do so and carry PD.

Most of the companies have policies to start GC process after 1 year or so.
When your PERM is approved with a new employer(doesn't matter after 1 year), while filing I140 they will ask you for previous approval details to carry PD.

So yes, irrespective of timeframe after joining a new company you should be able to carry PD.

This doesn't mean that you can not carry your PD. If USCIS revokes your I140 due to fraud/misrepresentation only then there is a problem.

You should try to get receipt/approval notice copy(that's it) which is needed when you join a new employer to carry PD.

There is no rule that we have to be there for 6 months. We can switch once it is approved.
It is our thinking to be on the safe side and wait for 6 months. But frankly there is no such rule.

It is MAX out which is considered and definitely not VISA expiry or similar. So why would GIT file in PP and why would Director give you approval?
