I am currently in India and have filed for 7th year extension (actually new H1 not subjected to CAP) which was filed on Aug 6th. I got an email from USCIS (since I had registered for automatic updates) that my case was been transferred to local USCIS office and now they would have jurisdiction over my case. Has any one else also received any such email? Does any one knows what it means or how long from here it would take for them to take a decision?

May 29th date for extension of stay is as of "Sep 30" for Vermont Processing Center. That was like 2.5 months back. My case was filed in first week of Aug and I also have the same status - "Initial Review". God knows what these people are up to.

I am in the exact same boat as you and having the same questions. You mentioned your 7th year extension got approved based on PERM pending with BALCA, may I know, when was your application filed? Mine was filed on Aug 6th and I am still waiting for decision.

Can any of guys who returned to offshore due to PERM AUDIT can tell...how the project allocation happens? do you get allocated to PDP pool initially then ops will find you project..if you are not allocated to project, any time limit they set for Onsite returnees to get allocated? i want to get allocated before i fly to India next month and not very sure how many opportunities are available from offshore.

Hi Krishna, I just returned to offshore due to PERM AUDIT. You will have to work yourself for project allocations. Look up in ASPIRE or work with friends or senior managers to identify a project. Talent Management team is a group of good for nothing leeches. The offshore location for my project when I was in US was different from my location preference and I got really rude reply from Talent Management team since I am a US hire. Their response was: "We don't have a policy to send Onsite Hires back to Offshore if they don't have a project in hand. If you don't get a project before you move to offshore, we will have to release you from cognizant." Imagine the audacity of these guys who are not even showing any traction to get a project for you. So I ended up talking to my offshore team and getting an opportunity there rather than having a lay off. Hope this helps. all the best for project hunting.

To all dear folks out here, who had to relocate temporarily out of US , a courtesy of beloved GIT team.

Let us hope june audit cases starts clearing up in next few weeks and the our beloved GIT will start next steps on filing extension and etc.and we have all the paper work ready to reenter back in US

However there is a caveat- our managers/supervisors back offshore or wherever- wont be letting us go back to US or will be releasing from current project. :)

My question is there any rule/law/policy we have which can ascertain that we can return back to US. Can a lateral hire(US hire) can challenge them legally or through any HR policy.

My biggest concern is labour laws/HR laws in India are much different than US. In US they are taken much seriously unlike in India..

I know there are multiple things which must be completed even before we can think about this policy...but I thought of bringing this to the forum and take your inputs..since we all have associations back in US and are interested to spend some time back there.



To Raj28, I just got transferred to India from US (I am a lateral US hire) because of no update on my PERM and maxout scenario. Even if, we don't see any update from DOL in next couple of days, I will be eligible for an extension in June when we complete 365 days pending PERM as i have 2 days left on my original visa.

As to your other points, once you have a valid stamped H1, the supervisors can't hold you back for more than 1-2 months due to pressure from operations the reason is very simple. By holding a travel ready resource at offshore, cognizant looses a onsite billing for that person. Hope this helps.

Where did you hear that? Trakcitt PERM trackers don't show any approval for June Audit filings.

The way things are going on, not sure, if we can actually get an approval and get back within 3-4 months or even a year. So have to plan for worse case scenario and hope for best case :).

When DOL site says they are processing cases from 05/31, that doesn't mean everything prior has been completed, it means they have started processing cases from 05/31. Look it as a tunnel, a looong tunnel. Once the case gets out of the tunnel it's processed. DOL only gives the date when the cases start entering a tunnel not when the last case of a particular date exits. There might still be cases under processing as far back as March/April.

icert website just got updated. As per that, on 01/03 DOL is processing audits for PERM cases filed on 05/31. I am hoping we should start seeing some updates for PERM filed in Mid June in 2-3 weeks. Keeping fingers crossed.

hi .. I have recently raised a request for gc and GIT asked me to upload all the supporting docs ..
I joined cognizant from another company, and they have refused to provide a experience letter, stating its not in their HR policy. my only option is to get a affidavit from supervisor.

i have relocated and now i cannot get a hard copy of the affidavit in the format cts mentioned. is it fine if i get an affidavit in an email and notorize the email, and upload it ? or else, i have to travel and get it from my ex-manager.

please advise .. thank you..



You can't notarize it yourself. Your Ex-Manager, has to notarize it. Your Ex-Manager will have to sign the affidavit in notary's presence and he can then mail it to you.

Did any one raise any GSD ticket to get an estimate on the PERM's that were file in JUNE 2012. I wanted to do it but thought of checking here before raising one.
Also my visa is expiring in 2 months and would like to know what plans others have in mind incase PERM is delayed, I mean, not to be a pessimist here.
I have family with me so I personally would like to pack up[to India] 4 weeks before the last day..
Please open up.



I just opened up a ticket with GIT. Will update as soon as i get a response.

For people whose H1 is maxing out soon in Feb/March, are you considering transferring to L1A, there by giving you an addtional 1 year stay, by which time, you will get PERM and 140 approved. I heard cognizant is not filing any fresh H1 (in case it expires), for any SA or above.

The way i am reading the question and its response, i am inferring the following:
1. H1 Extention for a 7th year can only be filed if and only if either PERM or 140 have been pending for more than 365 days (Thus, an alien is eligible for an extension of H-1B status beyond the 6th year as long as either the
qualifying labor certification application or I-140 petition has or will have been pending for at least
365 days prior to the alien's requested start date). Alien's start date i am assuming is the date of 6th year completion and hence a new start date for 7th year needs to be established.
2. The 7th year extension can be filed any time before 6 year H1 expiry and does not have to wait for actual expiry.
3. In case there is a gap between date when H1 (6-year) has expired and 365 pending day from PERM or 140, then the extension of stay request cannot be granted. -- > This particular point i am fearing most, because, if Max Out Date is in early march and 365 days will be in june, and if we don't get PERM and 140 approved by max out date, and have to leave the country, in that case, we won't be eligible for further extension.

Isn't that correct?
