It is really not by RD or PD. The interview cut-off date doesn't make any sense (I believe it is Mar 7, 2017). Why I couldn't be interviewed so that I could get my green cards 3 month earlier??? Now October/November 2017 cases got interview notice and if the visa is still available, even November 2017 are getting approvals. We are not talking about a few days or a few weeks inequity, here we have almost more than one year inequity. I am not kidding, in my case, my I140 approved in Feb 2017 and my 485 RD is Feb 2017. I know someone got GC with a June 2017 RD and I have to wait at least 6 month.



I totally hear you. Am in a similar boat. Feb 2017 filer and it is my second EB1 retrogression.

I also Received RFE notification on the DHS site, USCIS account status no change. Fingers crossed hopefully to get Medicals, did any of you actually received the notice yet any ideas what are the recent RFE's are?



I got the physical RFE notice. It was for medicals only.

I am EB1B with Priority date Nov 28, 2016 and I 1485 RD 02/28/2017. My application is still pending in NSC and field office is Buffalo NY. I see I 485 for India has been processed for RD in May/June 2017. My fear is to run out Visa numbers for India. Several SR and Congress man office but still no satisfactory answer. Is there anyone in same situation as I am?

No update on my case at all! I am wondering whether it is Jan/Feb 2017 filers at only NSC who are having the long delays or whether TSC is any better. For example, the following Feb 2017 case at TSC was approved in October (http://www.trackitt.com/member/LBB2017). It just looks like something major is happening at NSC that is causing all of us this huge delay the reason for which is so hard to fathom.

Finally received RFE. For me just medicals. For wife, medical + bona fide marriage.

That's great to know that there is movement in your case, and the RFE is only for medicals! Its ironic that RFE is huge progress for us Jan/Feb 2017 filers. I expect to have to re-do my medicals again as well.

man you just reminded me that EB1 may go into backlog sooner than later! (it was august in 2016, june in 2017, so pessimistically speaking it could be moving up to april in 2018! which might also mean that if I don't get my GC in hand by march end, I should start planning for another year of bonded labor with my current company!)



According to the Feb 2018 bulletin (https://travel.state.gov/ content/travel/en/legal/visa- law0/visa-bulletin/2018/visa- bulletin-for-february-2018. html), the EB1 category "will remain “Current” for all countries for the next several months".

Does that statement means that there is less likelihood of EB1India retrogression this year?

My medical exam has expired already (>1 yr). I applied for AOS in feb 2017 too and still waiting. Are you guys waiting for RFE to come in and then re-do medical exams or just getting it done now and keeping it ready to send it to USCIS when RFE arrives.



I am also expecting a medicals RFE as my medicals will expire in February. I have been wondering about the same question: waiting for medicals RFE and only then doing medicals, versus doing medicals in advance of RFE. Right now though, I am leaning towards waiting for the RFE and only then doing medicals. The main reason being it is difficult to say when the RFE will come. At the slow snail's pace at which NSC is moving (or not moving!) on the Jan/Feb 2017 cases, RFE may only come after several months, in which case taking the medicals now may be too early. Just my thoughts!

Ask your boss to also write a letter that you are outstanding. Another thing I would suggest is to try to get 1 or 2 more letters from international letter writers outside the US. You mentioned you will get 2 but maybe try for 1 or two more. I heard that it is good to have half the letter writers from outside US, to prove international acclaim. Good luck!

I would say definitely go for premium processing. It helps to get a very fast decision, and I personally dont believe it affects the decision one way or another.

Your profile looks good for EB1B. The citations is slightly on the lower side but the other parts of your profile are strong and can make up for it. I would highlight the four editorial board positions as well as the patents. And of course, hire a good lawyer to position your case well. Good luck!

I assume you mean Feb 2017. Yes it appears Feb 2017 EB1 A/B has been the forgotten lot. I am in Feb 2017 too and my status has been stuck at "fingerprint fee received". No signs of any movement at all in my case! I wish I had put in my application a month or two later so that I could have gotten an interview. Interview cases seem to me moving much faster.

The letter was prepared by my lawyer. The letter basically listed the publications, reviews, and other details like letters from renowned people in the field. I suggest that you hire a good lawyer for the EB1B application. Details of my profile are in my Trackitt account info. In short- current faculty member at R1 research University, and PhD from a top University.
