with the current trend it should take around 8-10 months
as Premium processing is getting closed on 3rd April , most of the cases would move pretty fast.
there is every chance of getting extension before Aug-17, if not anyways u have ur 240 days after 194 expiry.

would suggest to go with normal processing only.

Even though u withdraw ur petition , NIOR is issued against ur H1B( Control Number / Identification number for cap exempt).
when ever ur applying for new petition they will definitely come to know about series of the events u did .

Ur employer or Advocate wont be having any problem . ultimate suffrer is u.
ask ur employer for client letter. its always better to stick to what ever u said.

indirectly ur accepting that u faked ur employment for a year, Thats what USCIS wants, ur status will become invalid . they will throw out of this country in what ever status ur. it also effects ur spouse.

sincere advise , Dont complicate your case further

Iam not sure , why you are worried about NOIR , its just a notice saying USCIS was unable to find ur Client A, just provide them with Client A details . if there was any merger or acquisition kind of stuff for client business, provide compleet details.
hope they should consider true facts.

why you want to withdraw all petitions , indirectly you are accepting that ur client A was fake.

Usually RFE Cases are dealt immediately, most of the cases shall get cleared in less than a 60 days.
how ever ur case could be different, as u wont have Premium option later 03 APR, better to get it converted to Premium while replying to RFE.

Topic: Query about Travel with approved extension

You shall have a extended 194 before even you start your travel to India , Ideally u should have a stamped visa with ur latest I797.

Iam not sure wether u shall be able to apply for Premium extension before April 3 , heard we need a justification for premium.

better to travel with existing Visa and apply for extension after ur arrival.

Hi,

- find a good employer who can offer you a job in USA
- Get your H1B transfered to that employer
- Get VISA stamped
- Travel

as current situation is not so good, it is not advisable to come as a contractor through a consultancy/ In house projects for a small employer.

if your friends petition is getting expired in December, they can apply in June 2017 for extension.

i have seen people returning back to USA with a visa validity as less as 15 days. it all depends on officer at POE.

In Us tax return main applicants (You) resident status is important, you can file as Married filing jointly(MFJ) , spouse resident status is immaterial. you can file MFJ status even though your spouse is in India.

Hi Amit,

You can Claim your wife as spouse in tax return for TY2016, u need to apply for ITIN for your wife along with your federal tax return . Its not necessary that ur wife needs to be in USA for claiming as dependent.

It is also not necessary that u should be married for whole tax year 2016.

Can reach to some good tax consultant , they will guide you. Reach AOTAX they will guide you with actual process . its not necessary u should file ur return with them.

Iam not an expert in Ustaxation gave opinion based on my previous experience.

why cant you got for stamping on earlier dates like 8-1O th March , as per my understanding if you get a 221(g) also its getting cleared in couple of weeks , thats how u can spend good time in India.

You can get a stamping dates very easily in Kolkatta.

Topic: Dilemma to wait for GC (Eb2 2012) or chose stability

Hi Madhu,

1. To continue living in US and for GC for 10-20 years from today.
You have a half ripen fruit in ur hand , I understand its a in-stable environment all around , but always better to wait till last minutes, in this land of opportunity do you really think u wont be able to find a job for you and ur spouse .
who knows if country cap for GC gets removed probably ur fruit will get ripen in next 3-4 years. i would suggest to maintain status quo.

2. To move to Aus on a PR and we both can work there.
This option is always open for you, u can move to Aus at a later time as well .. if its really bad time staying in US

3. To go to India , come back with Eb1c Manager role and get GC in 2-3 yrs.
Not at all suggested, People are waiting in Indian companies for this opportunity

its my personal opinion , but would suggest to maintain Status quo.

Iam not sure how it works , but one thing is for sure , your previous Denials shall not be impacting ur future H1 transfers and extensions .

You can try filing on more petition even before leaving USA in premium ( if it is allowed ) and can be in status , Please take advise from ur attorney on this.

don t worry about it . let ur denial notice come to you

U need to leave US with in two weeks from the date of Denial notice receipt.

1) I will go to India once I have the letter
with in two weeks from the date of Receipt of notice

2) I will stop working
should immediately stop working from the date of Receipt of notice
3) Can I apply for a new H1b extension with the same employer?
You can apply , there is no harm in it , u will be given extension

4) Should I file an MTR? and how long does it take to receive a response?
MTR wont have time limit for decision it may take months, if your employer is supporting you for new extension , its always better if you file new extension in premium .
5) should I instead file a fresh H1b transfer via another employer?
Not required , can file with same employer
6) will my stay from jan till date consider illegal?
its still considered as valid
7) Can I qualify for the new 60 days grace period?
Not sure

Reason for Denial could be client letter, LCA or any other document which you might have provided wrongly..
quick question , was there any change in client during RFE. means ur extension was filed for a clienmt , while RFE another client like that..

Hi yogesh,

Iam not sure about MTR time dewtails, but you need not to look out for lottery.
you can file your extension as Capexempt even though your H1B was denied earlier.

It happened to me earlier, my employer went through capexempt route instead of MTR because there is no time limit for MTR.

I got 3 years extension through cap exempt route. Need not to wait for lottery.
