Immigration team confirmed that the experience letter which was used during PERM filling can be reused for I-140 filing.

In my case, I went to India due to maxout after PERM filed and I got promoted while I was in India. Now I am in US and PERM was approved and Immigration team requested me to use the same PERM experience letter while filing I-40.

Great. Thanks for the info. But I believe that CTS will do only H4 Extn and won't do the initial H4 EAD request. Individual needs to file for H4 EAD. Correct?

Was it filed in Regular/Premium? What was your category? like EB1, EB2 ...

My I-140 was filed in Regular mode on 2nd week of May 2015 in Texas Service Center. I think that it would take 5 - 6 months to expect approval. Might take more time. Lets wait and see.

Thanks Srini. I am about to start processing for 8th year extn. But I am just holding it because I am planning to change employer. If I get 2 or 3 year extn based on I-140 approval then I can change the employer.

Based on past experience, my employer may not submit H1B extn to USCIS until last minute even if I submit right now. And they will do H1B extn in regular mode again. And I guess that it would take another 6 or 8 months. And I will stuck with my current employer and I can't think about changing the job.

1) Is there a possibility that I can expect I-140 approval in November-2015? So that I can file H1-B extn based on I-140 approval and I may get 2 or 3 years extn.

2) I will go ahead and submit my H1B extn by this month end if it is not possible to get I-140 approval by Nov-15?
3) Is there any stats for Texas approval time/delay for I-140?

Filing mode: Regular Processing and Non-concurrent.
H1B Expire Date: Dec-2015

I am on 7th year H1-B. H1B expires in Dec-2015. I am in the process of preparing for 8th year H1B extn.

Question:

1) What is the I-140 approval time in Texas Service Center?
2) Shall I go ahead and file for 8th year H1B extn? (In this case, I will get only one year extn until Dec-2016)
3) Or Is it advisable to wait until I-140 approval and then apply H1B extn based on that approval? (I may get more than 1 year H1B extn approval since my employer has 3 years contract with the current client).

Please share your suggestion.

It seems like you are on the 6th year of H1-B. You have 7+ months left on H1B. How did you file 7th year extn?

And when did immigration file your H1-B Extn? Was it premium H1B extn request?

I thought that Immigration team doesn't file your H1B until last minute of your H1B expiry. And also myvisa doesn't allow you to create a case before 6 or 7 months from the date of maxout.

Returned to India -Mid of June 2014

Still waiting for PERM status indefinitely like others. I have few questions and like to get some experts advice.

Option - A

I returned to India in Mid of June 2014. Can I apply for FRESH H1B in April 2015 based on lottery since it will be effective from Oct 1st? Is it possible?

Will GIT process new H1B for employees whose PERM is pending?
(By June 2015, I would have completed in India for 1+ year)


Option - B

PERM is pending. Based on 365+days rule, my PERM will be pending for 1 year as of 22-Oct-2014. Will GIT apply for H1B extn in Premium based on Perm pending for 1 year? If it is filed with USCIS by end of OCT 2014, how long does it take to get the approval & stamping?

Option - C

1) Once PERM is approved, how long GIT takes to apply for I-140?
2) How long does it take to get approval in premium in India?
3) What kind of approval needed to fill I-140 in Premium in India?
4) Is employee need pay any money out of pocket to fill in premium?
5) How long GIT takes to file H1-B extn in Premium based on I-140 approval?
6) how much time will it take to get the approval for H1b Extn in Premium?
7) Any idea how long does it take get the appointment for stamping & get the passport back?

How much time do you think that it will take Approx. for Options B & C?
