Notes: Why is it taking so long this year. Denial reason not known yet. What are the options now. Employer told he will file an MTR. What is the timeline for this. I am very disappointed and frustrated now. MTR was denied too.

My 7th H1 Extn was approved in premium. Got one year and now waiting for the dreaded appeal results.

Can another company (company B) apply for my PERM while I am still working for C*S. If the PERM gets approved for company B without any issues, Can they apply for I-140 without me being their employee. If both PERM and I-140 gets approved with in say 6 - 8 months, i can think of joining them via H1 transfer.

I am asking this because I dont want to take risk of moving to company B via H1 transfer and if the PERM has a problem, i can't do any H1 extn because PERM will be applied with less than 365 days remaining.

Please advise.

In my wife's case also, we did not get any response. The employer got confirmation for 10 ppl. Out of the blue, he mentioned that the check was cashed. Not sure if that can be taken as a good indication.

Anyone with no confirmation but check cashed ??

GIT sent an appeal last week for my PERM denial. My 7th year extension was applied just yesterday as my 6th year is getting over this month end. will update when I get some answers.

Got an email from Immig team that they will file an appeal. The result could be anywhere between few months and 2 years and there is no assurance of approval from Immig team.
Also if appeal fails, there will be no more H extensions. So fingers crossed..

The reason for the PERM denial is a departure of prior DOL guidance as to job requirements. It is a legal/ technical issue regarding employer related information not specific to individual associates or applicants, and GM is/ continues to be in compliance with PERM criteria.

Today's draft immigration bill is out. Indian IT companies will have hard time in getting H1 for their employees and companies will suffer big hit in their margins.

Is it worthwhile to invest in a higher degree and qualify for GC under STEM quota. Looking at all the happenings, illegals can get GC easily because they are in low paying jobs, but tax paying and law abiding non immigrant visa holders will be milked of all the taxes and asked to leave the country.

I joined CTS 3.5 yrs ago in the US and now in an unfortunate state of PERM denial.

Priority Date: 25 Jun 2012
Audit Received: 22 Aug 2012
Audit Responded: 20 September 2012
Denial Date: 08 Apr 2013

H1 expiry : May 20 2013
I 94 Expiry: Jun 3 2013
6 year completion and max out date: Aug 1 2013

My H1 Extn was applied before the PERM denial, but that is RFE status. No one from the GIT team has contacted me yet.
I had some questions and raised a ticket, but it was closed mentioning that some one will contact me.

What are my options.
1. Will CTS file an appeal for the PERM denial. I see from previous posts that there is no guarantee that it will be approved.
2. As I was recruited in US, will they offer a job in India. Will they offer a comparable pay or lowball me due to my situation
3. Will I be eligible for new H1 in the Apr 2014 (effective Oct 2014) quota if I leave US in Jun 2013.
4. Coming back to US after one year will again be a problem due to H1 lottery and also if company is willing to do tha. Also not sure if they will apply for new H1 next year (Apr 2014 effective Oct 2014).
5. For some ppl, the company processed EB1. Don't know if the company will do it next year and also if some immigration rules change by that time, I am toasted.
6. If I work from Canada, can Cog apply for L1 or H1 after an year.

Please share your thoughts and experience as it is very frustrating for me and feel helpless at times.

Thanks a lot ctsperm.

I am sending repeated emails to the immigration team, but not getting any response. Someone reached out to me asking to fill RFE questionnaire, but RFE response cannot be filed when PERM is in denied because mine is 7th year extn.

My H1 extn was filed in premium in March and got the RFE in April 2nd. I got the PERM denial email on 7th April.

Options:
1. Go to Canada, work for an year, apply for H1/L1. Can my wife work if we relocate to Canada.
2. Is it worth going to India, wait for an year, hope to get an H1/L1, hope to get EB1 (M level) while I m back in US. I know its a long shot, but dont have other options
3. What would be a good package at M level in India.
