I have a question regarding EB1C criteria.

I am working in Company A here . I worked with the same Company A as a
Manager in India from 1-7-2011 to 12-16-2011 and came to US on 12-19-2011.

I am missing 21 days for EB1 eligibility. My present company is telling I
need to have 365 days outside US experience within 3 years period (2011 to
2013). And they are saying the clock is reset now.

Are there any exception clauses to this one year period?

Can I go to India now and work for 21 days to cover up this?

Note : Before Company A, I worked in Company B & C for 9 years(6 years in India, 3
years in US) . And right now I have approved I-140 under EB3.

I have a question for applying H4EAD.

I have approved I140 and I am in 8th year in h1. I am planning to apply H4EAD based on approved 140. If I transfer my h1 to new company will it affect h4ead approval.

the new company will not apply Perm immediately.
Anybody received H4EAD based on AC21 rule.

As "ctspermstuck" mentioned, If you transfer your h1 based on I140 from CTS and if CTS withdraws your perm it doesn't affect your transferred h1 validity(it will not be void). you can file new perm in new company and after i140 approval you can port your PD. I know couple of friends did like this. So don't worry.

Have you reached out to anyone to prioritize your case? for me Perm is approved on 4/8, till now case manager is not yet assigned.

In 7th year extension - it is valid till end of this year.

No idea. Have you contacted GIT? Anybody from Dec 12/27 got email from GIT regarding their perm status? I sent an email to them. Will keep you posted.

I am in 7th year extension (based on AC21 rule) and it expires in Dec 2015. I am planning to apply H4EAD after May-26, so H4EAD will be approved till Dec-2015.

If for some reasons H1 8th year extension is approved only in Jan 2016, will my H4EAD dependent allowed to work in this gap period until her H4 , EAD is extended?

yes, I also found out H4 can work.

I applied for some US companies, but nothing is materialized yet. I believe it would take 3 to 4 months for new company to file a PERM. And we would have only 8 months left for next extension. With this I am not sure what should I do.

have you tried outside to start a new perm. I am also in the same situation. Searching for an employer to file a PERM.

and I hope our H4 dependents are eligible for H4 EAD-even if we move to a new company - based on AC 21 rule?

how long it will take for the new company to file. I am searching for a new employer to file my GC. I got 7th year extension till end of this dec -based on perm pending rule. I heard from other forums even if I transfer now, they will give 1 year extension. Considering this how long it will take to file GC for a company. I understand it varies, I am asking normal timeframe.

Extended beyond 6 years (Based on perm pending more than 365 days - AC21 rule), planning to move to employer B and Employer A will withdraw the PERM after resignation.

Thanks for the information. I have looked at the document, I am not sure if I transfer my H1 to new company and old company withdraws the perm, I can show the old company's perm as a proof for H4 EAD.
