Notes: H1B ext+amdnt petition was approved on 03/10/2017. It took about 10 months to approve in regular mode and 4 weeks to receive the approval copy. Meanwhile, employer had sent PP request on 03/27/2017.

Topic: Port of entry at abu dhabi, Ethihad

I came via Abu Dhabi (Ethihad airline) to USA in March 2016. I didn't face any problems at POE and interview was smooth. They asked basic questions like employer, client, place travelling to, work I would be doing etc. It was quick.

However, Ethihad flight I traveled from had a leg room problem. Hope you get a better aircraft :-)

Scenario:
My H1B extension petition was approved in March 2017 and I got the approved I797 and extended I94 till March 2019. My spouse's extension was also approved for the same duration. Now, due to change of client and location, my company filed an H1B amendment petition in July 2017 which later got denied last Thursday 01/25.

Since at the time of filling up DS-160 for my spouse, amendment petition was still pending with USCIS, so we put petition # of approved I797 which my spouse got in March 2017. However, address in DS-160 says that I am at new location.

Now, due to denial- I may have to move back to my previous client and location for which I have the approved petition. Please note that my previous client has an open position and my previous RM is willing to take me for that position. At the same time, my current project, for which amendment was denied, is also ready to re-file the amendment petition.

Key pointers:
• Extension of H1B and H4 was approved in March 2017
• Current I94 and I797 valid till: 03/30/2019
• DS-160 of spouse has approved petition # mentioned.
• Moved to new client and location in July 2017
• Amendment denied on 01/25/2018
• Previous project and client have open position and ready to have me there.
• Project for which petition was denied is ready to re-file the amendment petition.
• Previous client and location: Client A (North Carolina)
• New client and location: Client B (Oregon)

My spouse has H4 VISA interview scheduled for 05th Feb. Please share you thoughts if you think that aforementioned scenario is going to create complexities during my spouse's H4 interview. VISA officer my ask her questions like client I work for and my current work location? Any inputs would be appreciated.

You don't have to wait for the approval on H1B amendment petition. As soon as the amendment petition is filed with USCIS, you can fly to USA based on the FedEx tracking #. Please make sure that you are taking a printout of FedEx shipment # and LCA to new location while traveling. I am assuming that you have a valid VISA stamped on your passport.

Agreed with Vipin Gupta. Merely making through lottery doesn't mean that H1B will be granted. You have to wait for the petition to get approved, and it will be effective from 01st Oct onward.

Thereafter, it is recommended to work with the current petitioner, which applied for your H1B, for about 6 months before you move to other employer.

I would say, don't rely on online status. My H1B extension petition was approved on 10th March, but case status on USCIS site is still "Case was Received". Check with your employer or its attorney, they would receive the approval notice within 15 days of filing.

It is premium processing for sure. The header says "Case Was Received and A Receipt Notice Was Emailed". In the case of premium processing, USCIS first sends the receipt notice in E-mail, and then a hard copy of receipt notice over ground mail service.

Had it been regular processing, header would have read as "Case was Received".

My H1B extension + amendment petition has been approved in regular mode after 10 months long wait. H1B petition was filed on 12th May 2016 and it got approved on 10th March 2017. But, there was no update on USCIS site and it took about 4 weeks to receive the physical copy of approval notice. Meanwhile, my employer sent the premium processing request to USCIS on 28th March, which USCIS received on 31st March.

H4 extension was filed in July 2016 and it got approved along with H1 petition. Wishing everyone here best of luck !!!

Usually, USCIS accepts extension petition 180 days prior to I-94 expiry. If your I-94 is getting expired in next 180 days, then, yes, you can submit extension petition with amendment petition itself.

However, if your I-94 is getting expired in next 7-8 months (more than 180 days), then also attorney may request for extension along with amendment petition. It is up to attorney how they see your case based on the documents they have in their hand.

You can work from Phoenix remotely provided that you post a LCA. If client doesn't have an office in Phoenix, then post the LCA for your home location. (Better check with an attorney on this)

Before moving to Charlotte, your employer will need to file to an amendment petition. This petition will have LCA for Charlotte location. Extension can be filed along with amendment petition itself.

Once the amendment + extension petition is filed with USCIS, you can travel to Charlotte without having to wait for the receipt notice.

Guys, anyone waiting for approval since May 2016? Per USCIS site, they were processing cases filed till 30th May 2016 as of 31st Jan 2017. I see that folks from July, August and beyond are getting decision in regular mode, but my case is stuck since 12th May 2016.
