There are still untouched Dec 16 / Jan 17 cases I would not be worried about a couple of weeks of unanswered rfes...

Topic: EB ROW injustice

I disagree, as long as chain migration is happening there have to be quotas. Part of the diversity issue is, that those 2-3 top countries don't only apply for skilled worker visas / GC but also every GC applicant from this country is starting a chain of immigrants for years to come.
The diversity lottery does not fix this issue and is not a good tool to fix it in the first place imho. Ending chain migration on the other hand imho would be an important part of fixing some of the issues including contributing to reduce H1B and other abuse...

I also see a fair point in the need of diversity because from my own experience those groups of immigrants tend to encapsulate themselves in their own world... integration and diversity looks different...

I know there will be at least one of you guys now blow of on me... this is just my view. I think there is a major issue with this immigration system and it needs to be fixed but it would need to be fixed on so many levels not just the one you personally feel is unfair to you, your community, your nationality...

this makes no sense the correlation says nothing about weather a case that gets an rfe will be denied because hopefully denied cases got an rfe before the final decision to give them a chance to improve their case...

you could turn it around that only weak cases that are intend to deny will get an rfe... but that won't make any sense either...

I wouldn't get too excited seems there is still a fair number of Dec 16 cases open. god knows how they process but maybe someone cam back from vacation got a bunch off his desk and now puts his feet up again for the rest of the year... i have little faith there is much going to happen between now and Jan 8th too many convenient excuses to not to work...

Topic: Abandonment rules are bizarre

You can travel with your AP, I am doing this every month no issues. But you cant travel on a valid AP with a AP renewal pending this will cause denial of your new AP not sure about AOS...

I think its a pure bullying they want to make ones life as hard as possible. Plus Americans not imagining that people have to leave the country for work or event want to for leisure sounds valid since this is outside some peoples intellectual horizon as most never owned a passport in the first place...

Topic: Tourist visa B2 - Stay

I’d say whole picture counts my parents come 2 times per year they own a house in florida and stay at least half of every year in the US my dad came back only 2 weeks after they flew back home last time but they got a house, rental properties, retirement income, funds, health insurance back in Switzerland.
They’ve never had an issue although been asked about reason for staying for such extended times and financial situation and the ability to cover for their own expenses.
If on the other hand one got nothing at home that convinces the officer to believe that they will certainly go back or that the reason might be for your mom to take care of the kids so you save money for childcare they might question reasons for frequent extended stays... so I’d say there is no rule of thumb as they can assume whatever they belief what might be fact and deny them entry.

Patent nonsense... what is good or bad? I have RD 01/09/17 and in our company we had cases that filed after me and they already got they GC and we got cases that have been waiting much longer than I. So is our coming any good or bad?

Topic: Why no approvals from TSC?

Honestly I cant give less of a sh... i go have a medical done so in case needed a valid one will be at hand, if god forbid i'd need another one, there will be a third expense claim for a medical...

I am traveling frequently on my combo card at least once per month, however the lawyer confirmed TSC will deny application if travel internationally while pending. I don't get it but thats what it is...

Topic: Why no approvals from TSC?

It’s expiring March 15th but knowing hr and the law firm and how they work I have to kick their asses well in advance plus I need to travel before and after so docs have to be prepared in advance to minimize effects of travel restrictions. And 3/15 –90 days is in 4 weeks only...

Not sure about the medical it will be 12 months old in 2 weeks so probably have to start thinking about that as well but that’s relatively easy I have a civil surgeon around the corner from me...

Topic: Why no approvals from TSC?

And it’s probably fair to say that from after today on nothing is going to move on for the rest of this year. Thanksgiving next week, week after thanksgiving... week before Christmas, New Years... enough excuses to simply not work...

I’ve given up for this year I have a RD of 1/9/2017 and I told my HR / lawyer to start process for extending the combo card.

Topic: H.R. 170 Quickly Passed by the House Judiciary Co

I disagree fighting outsourcing will never help, there is always going to be cheaper labor somewhere and automation is doing the rest. Thats why the coal jobs are never coming back because they got killed by less demand and more automation not by too many regulation. Or shoes are over forget a tax break for a shoe factory invest the money in teaching people good welding skills maybe thats something with demand shoe manufacturing is not coming back to the US from Asia or Mexico. If they cut out Indian low income IT consultants via wages whats going to happen is they will work for India and make even less...
The whole bringing jobs back to america phrase is populist bullshit.
The only way high salary societies will survive is to get higher paying jobs with well educated workers, education has to be free for a countries citizens. But the US upper class does not want to make education better and more affordable because it would destroy there 2 tier society system with a few rich people that can afford education and a lot poor uneducated people who are getting fucked over by the rich. Republican voters are like pigs that vote for the butcher to be in charge of the pigsty...

The other thing is at some point we have to think about models where due to automation there won't be enough work for everyone in a society and some sort of unconditional wage might be necessary...

Not saying dems are much better but...

Topic: What happens in Texas Remains in Texas??

I understand, the point I was trying to make, there are people from other countries with solid cases with plenty of wait time passed... There seems to be simply no pattern by country of origin, type of case, position, industry...

As for why not another category again, I followed what the lawyer and immigration department was recommending and at the time it all sounded very reasonable and I did not really care at the time I applied the lawyer said they'd usually see the complete process to be completed within 10 months for EB1C which again was very reasonable but that might have changed recently with apparently massively increased volumes... but still I see Indian applicants on here having their I-140 approved within 3 months so there is simply absolutely no pattern...

Which does not entitle you to anything! It still is a non immigrant visa it’s just that your intent to stay is legitimate.

Topic: What happens in Texas Remains in Texas??

Some wild stories here...

I am European, executive management in the us for a large european company, my direct reports are senior management, was in senior management roles before outside of the US. Been with the company for more than 20 years, have a PhD from a swiss university. So overall pretty solid case...

My EB1C i140 & i458 was filed concurrently early Jan with TSC, right after New years. So far no word, lawyer raised a SR and received the standard answer.
There have been cases within our company that had been filed after me that got approved and there are cases that filed long before me that have not been approved.
USCIS remains a black box that nobody knows when and what comes out when you throw something inside.

Before someone starts a the whole why EB1C if you have degrees, its what the lawyer recommended for easier documentation purposes in this case since org chart and plenty of documents to prove my authorities are easy available on hand for HR.
And honestly when I first filed I barely knew anything about the process, categories etc. so I was not expecting my case to take much longer than the published time periods, I am just now learning more as I tried to find out more about the waiting periods and what other people are experiencing.
