365 days rule is for effective date (to start working) and not for filing. Like all h1b extensions can be filed in advance with a later effective date, the same could be done here as well. So in your case if you have to step out of the country (i hope you don't have to), when you are out of country, your extension can be filed and approved.

For everyone's benefit, confirming this info again. I checked with my immigration team and they said that there is no need to wait for 365 days to file H1B extension for 7th year. It can be filed and approved in advance. They also confirmed that if you leave the country early (with some left over time to recapture), you can come back early - they can file extension along with recapture time.

Yes we are aware that it is not allowed to stay in US after I94 expiry. But about applying extension, my guess is that it should be allowed to file extension and get it approved with effective date in future. But need to confirm this.

My PD is same as filing date.

So do i have to wait until 10/22 before actually filing an extension, or it can be filed in advance with effective date post 10/22. Because if it can be filed only after 10/22, even if it is premium i need to wait for another 15 days, and i need to go for stamping before returning to USA, which will add up an extra month.

I'm not aware that you can file an extension based on the audited PERM 6 months prior to my PD. Have never heard about this. Where do I get more info on this?

You need to calculate the day of the year. This is how the A number is composed:

Each number consists of the letter "A" and two groups of digits. For example #A-12001-XXXXXX. "A" means that it's a perm application case. Five digital part consists of a two-digit number for the year of the application coming first (12 stands for 2012), followed by a three-digit number meaning the exact day of the year. For example 001 stands for the January 1st, 058 - February 27th and so on, finishing with 366 for December 31st for a leap year. This is the date when the draft was created in the system (but not the date when the application was sent).
