there are many examples . You can easily check the tracker and then see for yourself the success rate.
But remember each case is different and the decision will be based on case by case basis.
If your attorney and employer have followed all the processes and the documentation are submitted then there should not be any problem.
I read recently from Trackitt threads that few audits are going to SR after audit,then getting approved too.

Online status tracking is not available.It is for employers and attorneys only. There are few work arounds.These should be used just for information and the final word is always from employer/attorney.You need to know your ETA form number,which looks like A-XXXXX-XXXXX.Or you should know your Priority date.Knowing both is better.

1.First check this - http://icert.doleta.gov/ Go to PERM and PW Processing tab.Check the PERM processing time. Is this close to your PD? , then you may be able to track if approved.

2.All approved applications are uploaded the next day and can be checked at DOL's LCR. Labor Certification Registry(LCR) can be accessed at
- http://icert.doleta.gov/index.cfm?event=ehLCJRE...

You can give a date range(Posting date range) / employer name etc and check the result. This is processing date and not your PD.This site doesn't show your PD. DOL sends out an email in case the application is certified/approved.This is the right way and 100% reliable way.This site is just for information and convenience.You should always rely on communication given by your attorney/employer.In the past,there had been cases which showed as certified in LCR but was informed by employer as audits.

3.Another way to know what dates DOLs is working on is to check the PERM tracker at Trackitt where individuals update their status. This is voluntary and hence there can be delays.

4.If PERM is denied / audited only the attorney/employer receives mail.Now way to track this.

every quarter DOL releases Disclosure data which is a file that has all the PERMs processed during that quarter.this can be checked if waiting for long with no result.( around the time your PD is picked up).

My friend,even if PERM approval comes through, it is going to be a while before H1B extension has to be applied.
Good idea to discuss with your attorney/employer how much time will exactly be needed between PERM decision and h1B extension filing.
DOL always does back and forth and sometimes no one can predict the exact date.

So may be it will come or may be it wont ! Decide and take a plan of action which will work in both ways.
Sometimes when PERM is applied in 6th year,you definitely need to work on Plan B.

I agree with Imtired.you are wrong.DOL doesnot do any background checks on education.that is the job USCIS does at I 140 stage.

FYI, I have known a case with B.Sc (Computer science) + MCA EB2 getting certified quickly and when the background checks / education equiv done at I 140 stage , he had to do move to eb3 due to 3 years BS degree.

And also the person least affected is also the attorney.
the employee is affected maximum due to maxout/move out/doubtful and restraining etc.
Employer will also be in case of maxout and the employee cannot work.

Just curious,don't you have any hope of approval?

If approved
1. Get the PERM certificate mailed to you(takes 5 days to reach employer,factor in time to reach wherever you are)
2. then apply I 140 in premium,
3.LCA
4.get h1b extension
5. get stamping and then return

Possibly a month process after PERM approval.

PERMs take 240 days for regular cases.so by that August should start somewhere in April.
so it is not only a good idea it is the only way to go.since your PERM has been applied during your 6 th year.

In case of audit,if your employer goes ahead with appeal then you can get a year's extension in August 2014 by which your PERm would have been pending for 365 days.

If rejected and there are no ground for appeal then no other option,you cannot travel back.
