Anyidea if folks whose case is with BALCA, After moving to US (based on PERM pending for 365 days which is extn for 1 year), can we transfer H1 to L1 , if spent 1 year out of US?

Since we are not sure on the outcome from BALCA. Thx

when we raise H1 Extn under Non subject to cap(June'12 audit cases) based on perm pedning for 365 days, do they file extn under premium or regular? How do we know if they(G *t) started fiing? I see the status as Auto approved when I submitted my case.Also when can we expect approval? anybody recently raised this request? Thank You!!!!

Hi folks,

I returned back to India due to max out.(6 years completed on H1B and now my case in BALCA) and will complete 1 year outside US within few months.


can anybody please advice

If I move back to US based on PERM pending for 365 days(Case with BALCA) and get one year extension.

1. Can I apply fresh H1b from US (EITHER THROUGH same company/ OR FROM OTHER EMPLOYER) based on staying out of US for 1 year, since I am not sure of the outcome from BALCA

2. Can we convert to L1 from H1 (with one year extension visa)..since I stayed in India for over an year after completing 6 years of 1hb.

Pl. advice since just getting one year of extension based on perm pending for 365 days rule and ambiguity on BALCA's decision- not sure if its worth
of travelling just for one year and returning back.

Yes, many junior folks are not well knowledgeable about the process and driving us nuts..
When I raised a ticket asking if I can go ahead and raise h1 extn from offshore, I was told to wait until PERM pending for 365 days and it is mandatory. I meant to ask- since preparatory time takes time I wanted to raise extn req few weeks in advance and once it passes 365 days, they can file for extension.

My new Maxout date is Dec 2013, since I left US early this year , (recaptured time due to staying outside US)
PD: June 2012

My I94 already expired.

In this case, I think i can raise request for h1 extension from india based on PERM pending for 365 days? correct?

My PD: 27th june 2012.
Appeal was sent for "denied perm "last week. Received confirmation email from G*T.

I already left US early this year.

Can i apply for extension by raising h1 extn through my visa portal right away (since my case is "in process" state) or do i have to wait until 365 days are past since my PD?

Pl. advice.

I disagree with the statement dream boy.
We do have requirements for staff augmented based projects and if you have good rating feom last year and technically sound, there is good demand for onsite folks who are returning back.( my honest opinion based on my experience since I returned)

Btw..a million dollar question..how long does it take to see response after appealing denied perm?

That is excellent, Atleast client is fine to work from India.
Just curious, on full relocation context: per HR policy can we claim household moving expenses from US to India.
I was told only taxi, lease breakage and 2 additional check in bags can be claimed and it was mentioned in NA move out policy aswell

Apologies folks if I am deviating from main subject which is PERm.. Thought this will be helpful to C..S folks who had to relocate out ofUS due to delay in filing perm by git

abcindia, many of the folks you see here were exactly in the same boat when they joined c*s. apporx 2 years ago(having 2 or more h1b visa period left before maxout) but had no idea what was coming on their way.
If gc is your priority, better process your gc with some other company.consider samlookout's advise and move out ASAP.

I received similar standard reply from GIT today when raised gsd ticket stating they will contact us once audit results are out.
I can't stop speculating that GIT for some reasons are delaying to release the results.
It is painful , psychologically, financially, physically to relocate unplanned, at short notice, leaving behind life of 6 years, due to actions of few teams on whom we have no control. Atleast this forum helps to keep connected with like minded folks.

Date shown in icert audit processing time is for PD. PERM Audit depends on case by case.
Majority cases for June 2012 audits seems to be related to request for affidavit- stating fees are taken care by company. hope this helps.

All guys out there, take a moment , think before you accept offer from any company . esp cts if you want your GC to be processed. Joining small consulting companies are better bet than these so called global company.

To all dear folks out here, who had to relocate temporarily out of US , a courtesy of beloved GIT team.

Let us hope june audit cases starts clearing up in next few weeks and the our beloved GIT will start next steps on filing extension and etc.and we have all the paper work ready to reenter back in US

However there is a caveat- our managers/supervisors back offshore or wherever- wont be letting us go back to US or will be releasing from current project. :)

My question is there any rule/law/policy we have which can ascertain that we can return back to US. Can a lateral hire(US hire) can challenge them legally or through any HR policy.

My biggest concern is labour laws/HR laws in India are much different than US. In US they are taken much seriously unlike in India..

I know there are multiple things which must be completed even before we can think about this policy...but I thought of bringing this to the forum and take your inputs..since we all have associations back in US and are interested to spend some time back there.

if any assoicates out there in similar situation please respond what are next steps- anybody out there relocating to India?

anybody in India who had to relocate temporarily from NA because of situation like this..did GIT file your 140 in premium and initiated h1 post PERM Approval? any governance /approval issues you are facing for h1 extension.

any folks out here who had to leave US temporarily either to buy some time to get past 365 days since PD or received audit on PERM ..travelling to Canada/India etc..how do you negotiate salary ..meaning HR has some standardguidelines for lateral hires(US emloyees)? appreciate your feed back.

flora123, did you find a new project in India or going to some other country? Who allocates new project? any choice you get to choose location in India for temporary relocation?

If your PD is June 2012..irrespective of approval on audit, you can re-enter US after june 2012. Can't you..? based on
1.PERM pending more than 365 days ..
2.Perm + I140 approved and H1 filed

Do you know when they file H1, based on case 1 or case 2 above, would that be under subject to cap meaning under usual H1B quota?
