Topic: I140 Question

I am on starting of 6th year on H1B visa and got a I140 from a employer A. I have resigned from emp A and joined emp B 3 months ago.My current employer B is yet to start the greencard process(earlier they told they will start immediately and afraid they may not process)now I am getting another opportunity from employer C.

Is it possible to transfer the H1B B to C and use the same I140 received from employer A? Or I have to get the I140 from employer B(current employer) and then only I can move a diff employer?

Guys..Looks I screwed myself now..pls help me.

Now my employer E says he is going to cancel the my H1b petition and I140 revoke tomorrow.Also, I cannot join to Client C, because of the contract.I don't know what should I do now?

1) If my employer cancels my H1B tomorrow, how long I can stay in US.IS there any grace period?
2) Will this be a problem in filing for GC in future?
3) I am talking one other employer to do a H1 transfer ASAP, is it possible to do a H1 transfer even after my employer cancels the H1B?


Please help.

Vendor is ok with this .Because Vendor is doing lot of projects with client.

1) As you have mentioned that you have experienced this in the past, did you face legal charges?Any tip on this will help.
2) I am not worried about the back pay or any penalty charges which I can afford(max i can afford 5k).Will there be any other issue?

I am really scared and don't know what should I do now.

I work on EVC model.For the last one year i am working for an end client C, through a middle vendor V, from my company E.My end client C now offered a full time position.My middle vendor is ok with this, but my employer syas I cannot join because of non-competent agreement I have signed during my offer.The offer letter says that I cannot to join to client ,client's customers for 2 years after I resign from my employer.If I violate this, I need pay the finder's fee for the employer.

Here my employer not found this client, I got the call thro the middle vendor based on my resume in Dice.My employer came into picture only for signing the paper between Vendor and my employer.(they haven't signed anything with my employer.)

1) Have anyone of you came across this kind of issue and any experience on this?
2) Will there be any problem ,if I proceed and join with my client.
3) In case ,if I need to pay the penality/finder's pay,anyone have any idea on how much normally companies will ask for approx?

Thanks a lot myusjob!

I really spent worst days with my desi consulting companies to file the GC and get this I140 approval.Keeping in that in mind and all your advises, I will reject the CTS offer.

Even if I get 25% more in CTS, I don't want the hassle on H1b or GC.

Even I didn't tried for CTS much, but they offered me 25% more than other US based employer, so my mind turned to CTS. :-(..

As I have the I140, if I can keep the PD, i thought it doesn't matter how soon CTS will file GC.But if while H1 transfer, if I get 1 year extn, i think i am screwed.

With your answer above,can you please answer this question?..

I have my H1b still Dec-2014(6 year max out time) with my employer A and have I140 approved with my current employer A.I have got this I140 approval after the H1B extension . I HAVE NOT GOT ANY H1B EXTENSION after I140 approval.

Suppose if I move the employer B, where they will start the GC after 6 months.Will I be able to port the I140.My old employer A will revoke once I leave the employer.

I am planning to switch the employer and your answer will help a lot.

I also got a offer from CTS, with Manager desiganaion and salary of 100K+.
I have I140 approved in EB2 with the PD of Nov2012 and left with one year in 6 year max out H1.

Recruitment team says they will start the GC process in 6 months after joining.I have total of 11 years experience.

Is it good to join in CTS?,will they do the GC after 6 months?I also have a offer with another end client with the little less package(85k) and they do GC as well.

Need your suggestions,pls.

I am in same exact situation, my new employer says he cannot port the PD if the old I140 is revoked/cancelled.

I haven't filed for any H1 extension after getting the I140 approval, just moved to a diff employer.
