Topic: I140 application for CTS (Cognizant) employees

If you are really looking for GC, my simple and straight forward advice, please don't join. There is no way you even cross the perm stage. My exp is, i joined when i got 22 months, CTS filed my perm only when i got 5 months, moved out of USA 2 years back, still waiting for my 140 approval. As we become USA employee and we can't stay any more after 6 years of H1B, i almost kissed my termination letter as its was year end and i couldn't able to find any off-shore proj, somehow managed to get a project in off-shore and waiting for the miracle.

Hi,
Someone told 90 days, but from the below information it seems 84 days only.

Requests for evidence (RFE) and notices of intent to dismiss (NOID) specify the type of evidence required and/or the bases for the proposed dismissal.[92]

The RFE or NOID will state the deadline for responding, up to a maximum of twelve weeks from the issuance of an RFE or thirty days for a NOID. See Chapter 3.7(c) for information on how to calculate the time periods.

Hi Ravimslife,

I am sorry to bother you, did they reply to your RFE. As per the initial mail communication from CM, they told us that we need to reply before end of Feb. Today, we reached end of Feb and i still didn't hear from them that they replied to my RFE.

I don't want to disappoint/scare you, the status changed to "Name Was Updated" doesn't necessary be an approval, it can be RFE or anything, it simply tells us that they picked your case. Most probably you will hear something in coming 2 to 3 days.

In my case, it turned out to be RFE after the status was changed like above.

Thank You.

Hi,
I too got RFE on Cognizant's ability to pay around Dec 10th, GIT asked me to upload the W-2 and payslips around Jan 15th , they are yet to reply to my RFE.

Few months ago, 2 people in my account got the same RFE, after GIT reply they got the approval around a month time.

As per USICS guidelines, they would give some decision with-in 60 days time.

Yes, GIT CM replied to me asking to upload the W-2 forms for the years i was in USA, He asked me to ignore the paystubs for 2015 if i am not in USA.
I don't see any update in visa portal for my case, i didn't check regarding the portal update with my colleagues who got RFE and later approved.

Few of my colleagues also got RFE(they were in USA only as their perm was submitted few days before their 6th year, in my case they filed when I enter into 6th year only),GIT reached out to them close to a month after RFE issued, they submitted their Paystubs and W-2 in few days, GIT replied to RFE in couple of weeks after they provided the documents, then they got their 140 approved to close to a month after the RFE reply. In their cases, its general RFE challenging the ability to pay only.

I do asked the CM & submitted the GSD as well, but as of now, no response, I thought someone might have gone through this scenario, so they can share what they submitted, so its useful to me and people like me for speedy response.

Hi Friends,

Today GIT reached out to me regarding my RFE and asked me to upload the paystubs from Jan 1 2015 to till date, how ever I moved out of USA due to maxout in Oct 2013. Can anyone guide me are they expecting me to upload my India paystubs from Oct 2013 to till date and I worked close to 2 years from USA location before I returned to India, so the W-2/paytubs are from those 2 years, does anyone know what is expected to upload?

Thank You.

This is what i read from USCIS Standard Timeframes for Applicants or Petitioners to Respond to Requests for
Evidence;

A standard timeframe of 30 days for Form I-539; and
A standard timeframe of 84 days for all other form types, regardless of whether the request is
for initial or additional evidence, or whether the evidence is available in the United States or is
obtained from overseas sources.

I too got RFE on Dec 11th, Till now, neither I heard anything from GIT nor I bothered to reach out GIT. Eventhough i am outside USA, based on previous experience with GSD ticket response, I felt the GSD response does hold good for nothing. Even though each one of us might got RFE for different reason and the response and result might be different, but I got few colleagues who got RFE for their 140, for most of them its about organization financial capabilities, most of their cases approved with-in one month after the RFE reply.

Hi,

Today morning, I too got the same message, even my case was filed on Aug 27th.
Below is the message
"
There has been a recent processing action taken on your case.

Receipt Number: SRC1590XXXXXX

Application Type: I140, IMMIGRANT PETITION FOR ALIEN WORKER

Your Case Status: Initial Review

On December 9, 2015, we updated your name for your Form I140, IMMIGRANT PETITION FOR ALIEN WORKER, Receipt Number SRC1590XXXXXX. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators. If you have filed an I-485, I-589, I-751, N-400, I-90, I-821, I-131 or I-765, you can expect to receive an appointment notice to appear at an Application Support Center to have your fingerprints and/or photographs taken. The timing of your appointment is determined by the number of applicants ahead of you that also need a biometric appointment. We try to schedule biometric appointments as quickly as possible and in most cases you will receive your appointment notice within 30 days of submitting your application. We will send your appointment notice approximately 14 days ahead of your scheduled appointment. It is important that you keep this appointment. If absolutely necessary, you can request that your appointment be rescheduled however, please be aware that rescheduling may delay the processing of your application. Please follow the instructions on your appointment notice if you need to reschedule. Occasionally, you may receive an appointment notice to appear at an Application Support Center to have your fingerprints taken when you have filed a form other than those listed above. In these situations, you may receive your appointment notice more than 30 days after submitting your application or petition.
Log-in to your myUSCIS account to view your case history and understand what you can expect to happen next on your case.
Current processing times can be found on the USCIS website at under Check Processing Times.

Sincerely,

The U.S. Citizenship and Immigration Services (USCIS)

"

Kindly let me know if anyone know/gone through this kind of scenario.

Thank You.

It doesn't make any difference to GIT whats our PD is, they even doesn't bother to open our file and see the details. Based on the details we provide in our mail, they simply pick either template A which is for the people above 3 months than the current processing time else template B which falles for the people below 3 months. After repeated mail to Case Manager/Immigration GC Dept head, here is the standard response where many people might have seen earlier.

Hi XXXXXXXXXXXXXX,

If your PERM was filed more than 3 months prior to the date posted on the DOL site, then it is considered to be out of processing time. For these cases, we have already reached out to DOL via email requesting an update for those pending Cognizant PERM applications. As the site now shows they are reviewing cases with February 2014 priority dates, that means we have reached out to DOL for all cases still pending that were filed October 31st 2013 and prior. Unfortunately, there is nothing more an employer can do to push DOL to adjudicate a case any faster, and the only option is to wait for them to issue an update.

These delays are affecting all companies across industries, and are not specific to Cognizant.

Again, once we receive any significant update on a case, (an approval, an audit, or a denial) we will update myvisa and contact you via email within approx. 24 hours.

Below is the generic response from DOL after a status inquiry is received. Therefore, we respectfully request your patience and ask that you wait to hear from us regarding any decision on your case.

Thank you for your inquiry to the Atlanta National Processing Center concerning your application filed under the Permanent Labor Certification Program.

Please be advised, case # A-XXXXX-XXXXX is in process; notification of your case status will be forthcoming.

Applications are processed in the order they are received. Once the Analyst reaches your case in their queue, based on the principles of FIFO (first in first out) it will be reviewed and official correspondence will be issued.

However, because each application is unique, processing times may vary depending on the specific circumstances of the case.

The policy of the U.S. DOL/ETA National Office prohibits the expediting of applications.

We apologize for the delay.

Sincerely,

ANPC Permanent Program Help Desk # X
