good point. another line of thought that can be presented..

all our comments are generally how we benefit.. this brings how US benefits as well..

atleast adds sense ... just some rought numerbs..

considering 500k people backlogged. assume atleast 100k houses would be purchased because of stability. avg home to be around 300k.. it translates $30billion(on the very low side) . 0.2% of GDP... :-( we are shit in ocean... just adding few points

direct jobs.. indirect jobs.. no forex outflows.. addl stability to real estate market... many ppl turn enterrenuers... increased pool keeps indusery local.. and so on

rule is now classified as "Major" and "Economically significant".

probably changes were done but we dont know which way. either case .. as per their procedures (refer the link below)... this has to have Congressional approval. if both house and senate dont approve... president cant do anything.. this becomes void...

and .. the review process is little faster for these type of rules

hey guys...so was looking at the thread and the tracker itself...my application was delivered on May 26th-
I used the new form, may 26th is too early for USCIS to start receiving the applications?
The website clearly mentions that it should be file on or after May 26th.
I haven't received any email/test message yet. Check not cashed either. I sent it to Lewisville.
On the tracker, don't see any movement on the Lewisville service center.
Anyone in same boat?

folks... whatever.. im not against IV or for IV.... or any other advocacy group... just give them their small due as well as another 1 among 1000 hands...

Can we extend Q1. to accommodate

a) I-140 approved through previous employer but GC process NOT started yet with current employer?
b) In this case, what will happen to H4EAD when previous employer withdraws I-140 before priority date can be ported with current employer? and H1B employment < 6 years.



yes i agree. Q1 needs modification on how we ask the query.. it is not just asking but how we ask also matters..
can we reframe it as below and keep it simple

q1) Taking in to account the job portability and the number of ppl who have changed jobs; Can the approved I140 thru previous employer be used to obtain H4 EAD?

****strictly do not use pending or in process in this questions... pending is clearily defined in the final rule... so do not confuse them again****

I am very confident about positive response but nice to have it clarified.... if it not possible, it would be a big detterent to job portability after I140 which the agency is striving for

I am really confused about the point you made here.

In the scenario you mentioned, if person already has approved I-140 from previous employer A & pending I-140 with current employer B then why would spouse NOT ELIGIBLE for H4EAD since he should be able to get H4EAD on previous approved EAD? Because at some point person will apply for I-140 with current employer, isn't it?

Am I interpreting you scenario wrong?




scenario is right.. this is the only confusion which is affecting the majority of folks... that is why im requesting to sneak in this question today itself...

first 2 are fine.. for the third... atleast they will check today and answer tomorrow call... if you ask this imp question tomorrow.. they might delay it more .. never know...

Hi,

I am currently on H1B with approved I-140. My wife is also on H1B. Can i apply for change of status for my wife from H1B to EAD.. I mean directly from H1B to EAD without going through H1B to H4 & H4 to EAD.
As she is already working on H1B, changing the status to H4 will make her stop working until EAD gets approved.
How long does it take to change status from H1B to H4 and again from H4 to EAD if H1B to EAD is not allowed?

vavrevah..... this is heights of greeeed....... it is simple right... this rule is H4EAD and H1EAD... without H4 how can they decide on EAD?

all that is mentioned is he will speak on initiatives.. cant we ask question on the items he will speak? if he lists H4EAD as part of initiatives.. what is wrong in asking? i still dont get it.

All who are planning to attend today's teleconference with USCIS, please refrain from asking any H4 EAD questions. The teleconference tomorrow is specially scheduled for that. We should focus more on the other fixes that are coming our way. Some of the questions being discussed in the other thread:

1. What are the measures they are planning as a part of visa modernization to reduce the backlogs(let us not suggest EAD for I140 right away as EO mentions "job portability" which was interpreted in this manner)

2.DHS Director Jeh Jonhson Issued a directive on 20th Nov 2014 regarding "Policies supporting U.S. High Skilled Businesses and Workers" and One of the Items (Item E) was to make changes to Increase Worker Portability. Can you please let us know what policies USCIS is exploring for implementing this?(suggestion of our member gangua)

3.If they ask us to wait until 20th of march and ask for our suggestions we should stress more on recapture of past unused visa numbers and removal of dependents and just counting the principal applicant(Let us put EAD for I140 as the last item in our suggestions. If we hit a jackpot we get straight GC instead of EAD(I know I am being a little greedy here:) although we are aware that they can only consider those suggestions which are legally feasible)

4.What could be the time frame this rule will be published?

5. what will be proposed rule and when will it be entered in the federal register?

Lets focus on asking these questions today and we can concentrate on H4 EAD tomorrow.

is this meeting specific for visa modernization or future initiatives...? agenda doesnt specify that... he is going to highlight their initiatives.. i beleive he will definitely put h4EAD as part of accomplishments... then we can ask one question related to that which affects almost 50% of our population that is

eligibility for applying H4EAD on prev employer I140 approval. dont think this harms even a bit.. we can mention there is no clarity around that.

I don't know exactly, but what i heard from my friend is that You are not eligible.

What he mentioned is I-140 is always associated with the current employer. Once you change employer its not relevant any more or you cannot say I have valid I-140.

If you go back to that employer and if he doesn't revoke, you will be eligible.

One of my friend is also in similar boat and he is gathering all the information needed.

This is what i heard from my friends and I myself doesn't know exactly.

Please check with attorney also

guys.. this was addressed in one of the first posts after this rule is passed... all of you are panicking about page 30... refer page 42... that is where the scenario where approved I140 from previous employer is addressed.

as per the content in page 42... you will be eligible... pls stop the false rumours

page 30 only talks about pending I140 from new employer but does not address approved I140 from previous employer.

text from page 42

"Extending employment authorization to H-4 dependent
spouses of H-1B nonimmigrants with either approved Form I-140 petitions or H-1B
status granted pursuant to sections 106(a) and (b) of AC21 encourages a greater number
of professionals with high-demand skills to remain in the United States. Moreover, by
tying eligibility for employment authorization to approved Form I-140 petitions, DHS is
reaching the H-4 dependent spouses of H-1B nonimmigrants granted status under section
104(c) of AC21. DHS thus declines to exclude from this rule the spouses of H-1B
nonimmigrants who have approved Form I-140 petitions."

getting H1 extension under approved I140 beyond 6 yrs falls under section 104(c) of AC21... as you know this can be with any employer..... so instead of adding sec 104(c) they have added entire approved I140 under eligibility.

it is very clear... but any attorneys out there.. could you please interpret this page for us and clarify...?

""Pending Form I-140 immigrant petitions with new employer: Fewer than a dozen commenters requested that DHS extend employment authorization to H-4 dependent spouses in cases where the H-1B nonimmigrants have transferred their employment to a new employer and are in the process of obtaining approval of a new Form I-140 petition. As noted above, however, authorizing employment based solely on the filing (rather than the approval) of a PERM application or Form I-140 petition is likely to encourage frivolous filings to allow the H-4 dependent spouse to obtain employment authorization while the filings remain pending. DHS thus is not extending this rule on the basis of pending PERM applications or Form I-140 petitions. By requiring that a Form I-140 petition first be approved, DHS will further disincentivize frivolous filings and better serve the goal of extending the immigration benefit of this rule to only those spouses of H-1B nonimmigrants who are genuinely on the path to lawful permanent residence". "

We are certainly not "frivolous". How many times do we need to be screened? I-140 already approved through previous employer (not withdrawn or revoked). Are we still eligible to file for EAD???????????
