Depends on processing center but i'd say 5-6 months. But please note that it can be significantly longer. I' ve seen cases that took up to a year.

Thanks for your timeline. I just want you to be aware that EAD/AP are generally taking about 5 months to come through. Gone are the days when they that 90 day limit applied. I would say you'd probably have to wait a bit more.

Interesting. My company did not share the case number directly but didn't they send you a draft of the PERM to review before filing? At the bottom of that draft, there should be a number beginning with T-XXXXXX. When you change the "T" to an "A" that should be your case number. That's how I checked on mine.

Thanks a lot for your advise. This update is probably long overdue but I sent a final e-mail to the lawyers (cc'd HR) and explained in detail why they should do premium. The annoying thing is the employer was willing to pay but the lawyer kept saying it was unnecessary!! After I sent that e-mail my detailed reasons the lawyers realized they were in the wrong and decided to go ahead and file premium. I got my approval the following week!

Lesson for all: Stay informed and fight. Leaving lawyers to do what they want can seriously delay your process!

You should be fine. What matters is when they receive the application (receipt date) and not when you receive the notice.

Also just so you know, you can opt to pay for I-140 premium fee yourself if you're interested. So just in case you really wanted to do premium processing.

10-12 months sounds very reasonable for current processing times. 3 month approval for I-485 is almost a thing of the past unfortunately. Hang in there.

Hi,

So let me give you my perspective also. I must say i'm quite surprised you sent in a request for I-765 pending for more than 75 days. They are taking about 5-6 months now to process. Hopefully you'll be hearing something shortly but I think it's withing the normal processing time.

With regards to the I-485, it has been taking longer than before but i'd give myself a total of about 10-11 months from received date. Just hand in there. And also remember that things could be much worse (e.g. not being current). I'm sure things will end up well. Hope it helps! :)

I have quietly read the posts on this forum even though I am ROW. After having a very candid conversation with an Indian colleague today who has been waiting for 10 years and has another several years to wait it became more real what you are going through. I don't think anybody will ever be able to understand you. I am very heartbroken as he shared his experiences. And i know there are thousands of stories like that out there. I really think to myself what can be done about this issue? Indeed it is a crisis. What changes can be made? I know you have all thought about these questions already over and over but I still think we should still keep asking until a plausible, balanced and fair solution comes up. Well wishes to you all my brothers and sisters.

Ok that's another case all together. Usually, the lawyer should have your critical dates on hand (e.g. when your H1B is expiring etc). If I were you, I would reach out to your HR and lawyer and make them understand your concerns regarding your immigration status. This is YOUR case so you have to take ownership so nothing is delayed. When things go bad, all they will probably say is "sorry". Wish you all the best. Keep us posted on how things go.

The short answer to your question is that it depends. It depends on the complexity of your case and your lawyer's work load. You must also understand that it can take some time for them to get everything prepared for submission. And trust me, you want everything to be done right the first time. it can take as little as 1 week or as long as 8 weeks. Just be patient and check periodically with them to see where they stand.

Hi,

I can TOTALLY relate with where you're coming from. I was in the same predicament where my lawyer told my employer that premium was not necessary. I thought it was ridiculous because regular can take up to 10 months to process. I kept pushing back in a very respectful way and told them why it was important. I finally asked if I could pay for myself but eventually they agreed to upgrade to premium.

If I were you i'd suggest to the lawyer that you would like to pay for the premium processing (which is totally legal).

That is my understanding also. According to them, they don't want to upgrade to premium because my H-1 is valid until September 2018. They filed premium for other colleagues whose H-1 were expiring sooner. It sucks because I will have to wait much longer since they are not willing to upgrade to premium processing.
