Topic: CNN's EAD news. Backup options?

A couple of my friends are trying Canada PR as a backup option.
They just got the ielts done and getting other paper work in order.

I myself had tried Can PR 7 or 8 years back, it was at the last step (fee payment ), but
My credit card company screwed me by denying the foreign transaction.

And Canada guys were were “generous” to just send back my whole application without contacting me(mistake is mine , I should have used a cheque instead of card). by the time I tried to re apply, the Rules had changed quite a bit and didn’t pursue further.

But in hind sight , it all worked out well.

Topic: H4 EAD Revocation rule

I think the new opt folks just have to consider that competing with H4 is part of the practical training :)
There may be a small dip in salary for a period of time , but the market forces will even it out,

Once the h4 folks who have been away from Job for some time gains enough experience they will demand more or find other Opportunities. Alternately, the employer might find that a particular H4 candidate is not a good fit for that job and look for other options.

They could have left H4 ead as is. It is definitely a great support for families on H1, not just financially, but to keep h4 person sane. It gets to you after a while. I am not telling that there are no other options.

H1 tightening is inevitable, but again the merit based system is not an exact science either , hopefully the smart guys who don’t make it in the merit system have a better future in store in their home countries.

Hopefully your OPT was rejected due to the H1 already being approved.
I think you need to stop working as soon as you came to know about it. (That is what my lawyer told me few years back)
My guess is that since your H1 is a net new application and not an amendment / transfer / extension - you can work only once you receive the approval. So it would be wise to apply for H4 right away after making sure the H1 is not already approved.

Topic: How to report EB1-C abuse?

In my experience , best efforts are made to ensure that all the applications received for the ad are screened and interviewed.
The screening team or the interviewing team is only provided with a JD and won't know if the application came out of a PERM ad. If the candidate is qualified and willing to take up the offer , they are hired - I can attest to this fact because , I have been involved in such a process and came to know from the 2 resources after hiring that they were contacted because they had responded to a PERM ad (They didn't know it was PERM ad , but, by the ad they showed me I knew it was a PERM ad template)

Based on what a friend of mine did a few months back, this is possible. he was able to retain the priority date from an EB2 based 140 when he moved to a new company , the new company filed in EB3 - not sure what the specific reason was

Topic: H1B Out Of Cap RFE from USCIS

I was in the same situation few years back, but an attorney I consulted (not the company immigration team ) suggested that I move out of the US with at least 10 days before max out. I moved to India 2 weeks before max out .

A year later my perm was approved , 140 was applied, approved. Subsequently h1 was applied in cap excempt and approved.

Please double check your maxout calculation to see if there was any math error, it could be a mistake from uscis end as well

a friend of mine got an RFE as well ..looks like it was around detailed managerial duties. the documents submitted in support by him were details of duties and percentage time spent on them, org structure (off/on), qualifications and grade of all reportees, W2, Payslips. The immigration team had asked him specific items they needed - didn't provide the rfe notice or details of rfe to him.

do it only if you have written agreement from HR that they will do within a specific timeframe .. I have worked there and it is just too much politics. (i am not blaming the company .. it is just crappy middle management that creates all this mess)
