If you planning to change ensure your H1b transfer is complete before notifying your employer. Once you switch company they will need to do your GC processing from scratch. The only exception being they dont withdraw your I140 and when you date becomes current you switch back to them for employment and do you I485 etc through them.

The best option is get your h1 transfer in premium and get the approval before you join them. You don't want to risk your current employer withdrawing the I140 before you receive approval from new employer.

Topic: Change of employer with approved i140

Hi,
You need to ensure that you have atleast spent 6 months with your current employer post the approval of your I140. Once you cross the 180 day period, the I140 gets tagged in your name which means that irrespective of whether your employer wants to withdraw your I140 or not you wont get impacted as far as PD is concerned. What you should also do is get a copy of your I140 Approval using the FOIA request so you have necassary documentation in case your employer is not willing to provide the details. If you have crossed the 180 days of your I140 approval, your new employer can file for an extension and you will get it for 3 years which should be sufficient time to file GC and be able to keep your status.

Its a Happy Friday for me. Finally i got an email with the assignment of a case manager for my I140.
My timelines -
PERM Approved - 3/25
Received email from GIT on I140 initiation - 4/2
Received ETA Form - 4/15
Received ETA confirmation - 4/23
Contacted by Case Manager - 5/15

It took a little less than 2 months for my entire process to come along. It is a pretty painful wait but I guess we dont have another choice but to wait until GIT reaches out to us. GSD tickets etc. dont really help much so the best thing to do is wait patiently for some more time.

I had a GSD raised and the response i got is, we have 6 months to process I140 from PERM approval so it could be weeks or months before case manager is assigned to process your I140. So even if its been a couple of weeks or more since docs were sent the wait could be a lot longer.

did u get an email from GIT when your 7/8 th page was shipped to you. I was contacted by GIT last week about my I140 processing. Submitted the questionnaire, updated the docs and responded to GIT. I am waiting for an update from them. If you can provide this info on whether a confirmation email is sent or not it will be helpful. thanks in advance.

I finally got the most anticipated email from GIT today. They asked me to submit a questionnaire and to upload the documents. I completed it and sent it to GIT. Waiting for them to confirm and send me the hard copy of my PERM so I can sign and return it and have my I140 filed. I need to file for my 8th year extension so my guess is that they might file it in premium. My H1b extension expires in October so need to have things moving soon.

What a relief. I finally see my case number in the list on icert. The PD is A-13267-*****. Now am waiting for the beloved GIT Team to reach out to me so I can get my I-140 going and get the extension for 3 years. My visa expires soon so I need to file for the extension as well !!!

i had a friend whose i140 was done in premium.. if your visa is to expire within the next 7 months they will do i140 in premium w/o even u asking for it... otherwise its the big tiresome process of director level approval etc. as in h1b premium cases. i am a september 2013 case and waiting anxiously for an approval. my 8th year extension process needs to be started in the next couple of weeks with expiry of 10/31..

maybe it was case that finally CTS was told by DOL that ur cases r gonna be approved in bulk similar to what happened wid microsoft a while back and hence the email to the associates. Jan cases are moving n mine was in september cycle anxiously waiting hopefully some good news soon !!
