Topic: Urgent Plz! Perm filing wth incorrect(incomplete) employername

Hi, Yupe my perm was approved along with I140 later.

Since Dol could not give assurance that it would be able to update the name in their system to 'xyz Corporation' from its earlier account name as 'xyz' - the attorney went ahead with the application submission .

Attorney was having the opinion that since it's a company legal name, it should not cause any issue. I was a bit worried and hence was requesting attorney to update the name to have everything in order.

Just fyi, 2 other applications submitted along with mine were also approved without any name change in dol account. Hope it helps.

Topic: Returning to US after 1 year through another employer

Thanks PlayCatan.

Since employer through which I intend to come back to US is different than the one who filed my I-140 and I won't have a H1 that is valid when I look for a new job and I have already exhausted my 6 years on H1.

Just to reconfirm , what I wanted to make sure is if in case my current H1 through Employer A (who also filed my I-140) gets revoked after I resign(once I-140 is beyond 180 days from date of its approval)., will I be able to file a new H1 from a new Employer B (that I search from India) probably after 8-9 months ?

Topic: Returning to US after 1 year through another employer

Hello All,
I recently got my I-140 approved and it has been almost 5 months from the date of I-140 approval. I completed my 6 years on H1 this Oct and my currently running H1 petition (is a H1 extension for 3 yrs from same employer that was approved recently) on the basis of approved I-140 - and is valid till Oct 2020.

I am in a FTE with a American company but the situation in my company is a bit dicey and possibility of a mass layoff.

If lets say I go back to India for 6 months after resigning (once I complete 6 months from the date of I-140 approval)
and in the mean time my H1 is revoked by my current employer then:

Will I be able to come back to US after lets say another 6 months (after finding a new Job from India) via another employer who can use my existing I-140 to apply for a new H1 without requiring for me to go through the annual cap ?

(Just on a side note I also have a previously approved I-140 from a consulting company that probably might have been revoked after 1 year of its approval)

Just curious, by approval scan copy do you mean the I-797 approval notice for I-140 ? I thought CTS did not give their employees an access to I-140 approval copy in any form(scan/hard copy).

Another possible option would be to go back to India (requesting on basis of some family emergency) and continue working for your Company and request them to not revoke your current H1B. Tell them that you can use it once you come back. Even if you join another company after going back, then possibly request your current company to not revoke your H1B.

This will stop your current H1B clock and prevent you from losing any more time. You can do your interview prep and job application/interview from India and once you get a new job in US do a H1B transfer (which will give you back your remaining H1B time of lets say 15 months or so) and request new Employer in US to start GC process immediately upon your joining (you can negotiate accordingly once you are selected).

You can come back to US with new company's H1.

From what I read about ability to pay criteria -
- It is not always necessary to have your current wages equal to or greater than the prewailing wages. If the employer submits the Company financial revenue documents and if they are way more than your prewailing wage then ability to pay requirement is considered met.

Do you know if your employer submitted the Company revenue details to USCIS as part of your I-140 filing ?

Also, you may check perm checker sites to see how many labor petitions are filed by your employer which will give you a indication of how many I-140's might be active from the company at present and try to get the revenue details of your employer (ETA - 9089 form for perm filing may have it). If the total revenue of company is significantly large number than estimated cumulative of I-140's filed from company then, it should be fine.

Were you in your 240 day extension period (while your H1 extension application beyond 6 yrs based on I-140 was still in progress) when you got your Driving license renewed for a year (just want to make sure it was renewed on the basis of 240 day valid extension period and not something like spouse H1/I-140 based extension validity) ? I will check details about SAVE application. Thank you.

So getting the driving license renewed during the 240 day period while we wait for H1 extension application to be approved is difficult / not allowed ? Since when I-797 for current H1 expires - validity of I-94 is also considered expired probably (Not sure) ?

I need to file my H1 extension in coming days and if premium processing for H1 extension does not start soon, I will have to rely upon 240 day rule to maintain continuity.
Just wanted to check if it is possible for us to get driving license renewed for 240 day period or so while we wait to receive the I-797 approval copy for H1 extension ?
I reside in California - SF Bay area (not sure if certain DMV locations are liberal to consider the 240 day extension or not, but just wanted to check).

if anyone recently in last 12 months or so ran into the issue of not being able to submit the experience letter from previous employer on their company letter head, and only able to provide notarized letter from a colleague/manager on a plain document to cover any missing skillset/duration of experience specified in Perm ...

If so then please do share some details if possible ...
How was your case handled by Uscis/outcome? Did you also have to follow it up with additional information/documents to support the notarized letter to convince Uscis to accept the secondary evidence ...

Hello Friends,
Have anyone recently(last 6 - 18 months) submitted a notarized letter (that gives required details like dates of employment, designation, skills etc.) inplace of experience letter printed on company letter head as part of I-140 documentation ? If so can you please share your experience - if it was acceptable as secondary evidence or received any kind of RFE's on it to submit actual letter on company letter head (If so how did you get past it - W2/paystub/offer letter etc along with the format of the letter submitted) ?

I read on a lot of older posts(posted 2012 and earlier) that earlier applicants who could not get experience letter for their previous employment on Company letter head were able to successfully use notarized letter from their previous colleagues or supervisors as experience letter alternatives. However lately, notarized letter are not being accepted by USCIS and things like that.

I wanted to collect some of very recent experiences in case if any one was able to use notarized letters from former manager/colleague and able to successfully get their I-140 approved especially if the letter was used to cover the missing skills/years of experience required as per the Perm job description.

I have a situation where I worked in a US based product company for 10 months, 3-4 yrs back however
presently none of my original team members, HR or Manager work there. So the new HR is not able to give me a experience letter as none of the current folks in that company can verify my experience. My manager is able to give me the experience letter on a plain sheet that I plan to get it as notarized document, however current HR is not willing to print it on the Company letter head.

I need to show 2 years of experience. I have one experience letter from one of my earlier different employer on their Company letter head that covers me for 1.3 yrs. This 10 month experience letter is required for covering the remaining duration and 1 specific skillset requirement which is not present in the other letter.

I am not sure if notarized letter will be acceptable or will I need to submit any additional details along with it. Hence attempting to collect some recent experiences from
anyone who was in similar situation.

Friends, please share your thoughts or experiences regarding using the notarized letter from former manager on plain document in the absence of experience letter on company letter head.

What was the duration for which you submitted the affidavit ? Was it a notarized document printed on a plain sheet with the Manager's/Supervisor's/Colleagues contact details and signature ?

If possible can you please specify the format for the letter (You may exclude the skillset and additional details) however just the format of the introduction part where relation of the colleague with the workplace and your designation was specified to indicate your experience with the Company.

Congrats Evensource, If possible, can you please specify the initial 5 digits of your A number (A-00000 -*).
It usually gives us an indication of what series is being approved for 1st week of filing, especially if the A-number is not in regular sequence of Feb filings.

Congrats arunsankhyan. Did you receive a audit or just a delayed response (since avg processing time is 80 days and from Jan 3, today its approx 120 days) ? I usually notice that folks having their perm draft date way behind the month in which the case was filed, usually face delays. Just wondering if that was the case in your scenario if not audited.
Can you please past the first 5 digits of your A - number if you dont mind .
Eg: A-00000-XXXXX.
