This drive was targeted towards American based companies only and it has nothing to do with H1b....so don't expect to see any Indian IT companies in the list.



Thanks for the clarification.

I know that the drive had nothing to do with H1B. But what I am trying to suggest is that the Amendment would impact these companies the most since they are the major H1B sponsors. And for a fact CTS claims to be a US company.

One thing I noticed - major desi IT companies (Infosys, TCS, CTS, WIPRO, IBM INDIA, etc) who are the top H1B sponsors are missing from the list. That makes me even more to support this bill with amendment!:

IMO, If fraud needs to be eliminated, Auditing small companies with less than 100 workers and having high % of h1b will be more effective.

you are right. You keep PD (even if employer Revokes it) as long it is not revoked due to Fraud.

Just FYI, When you get I140 approved, since most employers dont share it with employees, do keep a Screen print from USCIS status website which states that the case has been approved. My friends employer asked that information and ( i guess) used that info to communicate with USCIS.

Thanks for your wishes!

I have 4 yrs degree( BE) .Total 8 yrs exp, was in India(mostly) for initial of 4 yrs. If GIT doesn't wish to file in EB2 - they will invent a new reason. I am surprised at email they are sending to people why they dont qualify for EB2 ( Need to be M & above or SA with 3 yr CTS global exp). Because I and couple of other colleagues who meet those requirements have never seen that email :) we all got 'other' reasons.

Yup, lets see where MS takes me - I hope it wont be worse than CTS. I wish there will be no hiccup with COS to F1.

All the best with your GC thing and CTS!

Anyone in general (not just CTS) - if you who are getting filed in EB3 and have a masters or 5+ exp, don't waste time! wake up and explore more options before its too late. Because once you reach 6 yr limit - you are stuck!

Thanks for the advice MontainSeal :) I am SA/PM, was a BA when they applied. Believe me , I have tried a lot to convince them! I think it comes down to how 'valuable' they consider to me for the org and by thr action I see that they don't value me that much! I wasted too much time and mental energy worrying about this and all I got was frustration. If they dont value me, its up to me now how i want to take it. I can sit and hope for the best or take action and move on. Thats what I am doing - I have already applied for COS to F1. Will be starting my MS in Sep and its a STEM course. So i will get ~3 yr OPT after MS. I m really looking forward to break from work :) In a way i m thankful that they filed in EB3 which 'forced' me to act - i think i had gotten too comfortable and lazy :)

I was able to get hold of the exact email, if it helps:

"Yes, you do definitely qualify under education and experience but because of your salary you did not meet the EB-2 requirement. The DOL prevailing wage requirement for EB-2 with a Bachelor and 5 years experience is $107,453 and and your wage falls short"

How can they do that ? If they committed for EB2 hold them to fire to continue in EB2. I hope you did not get confused with the initial email they send where they mention about both EB2 and EB3 - "Your Green Card will be filed through the PERM process (EB-2 or EB-3 category). "

I had same confusion about I140. As per my research on internet I thought DOL (LC) was more about skills and it was USCIS(I140) who cared more about category (EB2 or EB3). However I asked the same to GIT and got the below response

"Your PERM was filed in EB-3 therefore, your I-140 will also be filed in EB-3. You were notified that your GC would be filed through EB-3 prior to it being submitted with DOL. "

By Nov 2012 ? Since they just said to you it will be EB3 that means they just started your PERM - right ? If that's the case -sorry, I cant see how you will get labor and 140 by November even if everything goes smoothly (no audit and everything gets filed on time).

Something else you might need to consider: CTS has a 'policy' that they will not apply for GC twice. So if they file in EB3 now, if you go back to India and come back after couple of years, they will not file in EB2. This may or may not be of concern to you but just wanted to bring it up.

Sorry to hear that.

Trust me, its not worth wasting time and hoping for best. I was totally disappointed how they discriminate people based on if you are on L1 or H1 or hired from here or from India etc. The biggest disappointment was my colleagues getting filed in EB1 even when they did not have any one reporting to them. Its like they will go out of the way to help some people but will not even care to do basics for others. I dont get it and I dont want to get it :) I will be out of here soon. I spent so much time thinking and researching about it that then realized its not worth worrying about. Got to take my own actions to make it better. Either switch to file in EB2 or get a masters (full-time or part-time) and then switch. Either way, its up to me now.

I am with CTS for 8 yrs (SA). 4 yrs India + 2 yr other countries + 2 yrs in US. Reason given by GIT for not filling in EB2 are not consistent. Its as if they invent a reason. What incentive does Cog has for filling in EB2? They want to retain you forever and best way to do it is by filling in EB3. They really do not care about associates.

GIT said it was ~ 109k so i guess it was Level 4. I vaguely remember seeing a Experience drop down but I could not find it anymore. Here is a document that explains the different wage levels :

For EB2 it got to be Level 3 or 4.

Since EB2 mandates 5 yrs exp, in a way I guess its good to have 6yrs rather than 9yrs. Because I am guessing if you have more exp it might hurt in a wrong way (increasing your level and requiring more pay and CTS dosnt pay that :)

Query for CTS within that and you will get an idea what 'Level' they are generally using to file PERMs - however it doesn't give details about if a case is EB2 or EB3.

I too have 8 yrs expr with BE. It will mostly depend on your Pay. If you pay scale meets the prevailing wages or up to 20% less and not more, you have higher chance of EB2. Check the prevailing wages of Teneack,NJ. I had checked it is 2009 - BE with 8 yrs IT exp was around 109k. Mine wasn't 109k or 109k-20% - so they did not file mine in EB2.Since the pay scale for SA's transferred from India is same - I asked does that mean none of SAs get filed in EB2. They said some of SAs hired here get applied in EB2.

Its not true that all PERM went to Audit before but it seems to be norm now (100% for CTS). My friend got PERM approved without Audit (PD Mar 2010). He had close to 10 years experience but still they filed in EB3 saying that his salary is not good enough to file in EB2. For EB1 they said he has 'less' people reporting to him but filed in EB1 for 2 other colleagues working in same project/same client and same role ( they had MBA from IIM). If you were a manager in India or have an MBA from IIM ( dont have to be a manger!) - you will get filed in EB1. If you are hired in US - higher chance of EB2. If you are transferred from India and on L1/H1 - 99% you will be in EB3 no matter how much exp you have or have a masters. GC in EB3 for India is nothing but slavery of 21st century.

The timeline for application varies a lot. My team member raised request/submitted documents in May 2009. He has a PD of March 2010. It took them almost a year to start PERM - go figure!

GIT kept saying they are in contact with DOL to get some clarification about a document. Now a days it seems to be way faster but again they can change 'policy' anytime :(

Yes, its not updated after 04/02. But look at the trackitt data. People who have PD in Nov 11 and got Audit (EB2/3) - they are getting response to the audit starting 05/29.

Since November 2011 CTS has high rate of Audit. As per immigration attorney i spoke regarding some other immigration matter, he told me that lot of Indian IT companies are getting close to 100% audit rate. Mine was applied in Nov and got Audit.

It used to be slow before, but in general its quiet fast now a days. Of course, some cases might have different time lines.
Going by timelines in trackitt, if you have PD of Nov 11 and got audited and responded in March, you should be hearing soon from DOL.
