This is the latest policy update from August 23, 2017, the news release about the mandatory interviews is from August 28, 2017 (https://www.uscis.gov/news/news-releases/uscis-t...).

The new policy states at the beginning of Volume 7, Chapter 5: "All adjustment of status applicants should be interviewed unless USCIS waives the interview[1]", which is consistent with the press release, posted 5 days after the new policy was enacted.
It then continues with: "Interviews for employment-based adjustment cases are also generally waived if:
•The principal applicant has been approved as a person of extraordinary ability or exceptional ability and is otherwise eligible for adjustment of status"

So this is the NEW post DJT policy.

How did it affect NIW-based I-485s? Did all the recent cases had an interview or only some of them?

According to the following guidelines from the end of August this year, for NIW-based adjustment of status cases, interviews are generally waived.
Is that actually the case for people who were recently approved?

•The principal applicant received a national interest waiver based on performing primary medical care to a medically underserved area who demonstrates that he or she intends to continue according to the terms and conditions of the underlying petition

Hi Guy,

I finally got my NIW approved last week. My PD is 12/06/2016, I have submitted my I-485 concurrently in march and haven't seen any movement other than "Fingerprint Fee has been received" after I submitted it. I got my EAD and AP awhile ago too.
Do you know how long it usually takes from the point the I-140 is approved until they start moving your case around?

I-485 for work based applications in Nebraska now stands at February 2017, which means they are currently processing application from around these receive dates.

I got so excited about my I-140 that I didn't even think about asking about my I-485. I saw that Nebraska is currently processing Feb2017 and mine was received in Apr2017, so I am not worried about it yet.
I called the normal costumer service number and talk to a tier-1 agent who didn't knew anything and asked to be transferred to a tier-2 agent. She created a callback request and I got the call toady.

I got a callback from a tier-2 officer today after I got to anxious about my NIW and called costumer service last week.
The officer told me that my case was approved on 11/14/2017 and they sent me an approval notice. My PD is 12/7/2016 so it was 344 days for me. I DIYied the petition and it worked out fine. I have a concurrent I-485 pending and I was using my EAD card for work so that's a big relief for me.
Thank you all here in the "NIW support group" and to those who are still waiting, you will get the approval soon enough.

About the renewal timeframe the USICS website states:

"If you are still eligible for employment authorization but your EAD will be expiring or has expired, you should file for a renewal EAD by submitting a new Form I-765 and filing fee (if required), unless a fee waiver is requested and approved. Generally, you should not file for a renewal EAD more than 180 days before your original EAD expires."

My interpretation is that you can file when you have 180 or less days left until your current EAD expires.

Topic: Traveling while EAD/AP renewal pending

Hi,

I have my current EAD/AP card, based on a pending I-485, valid until 04/29/2018. I want to submit a renewal for it since it expires less than 180 day from now. I need to travel abroad for work in December for a week.
Will the application be denied if I leave the US? I have already traveled and returned to the US with my AP card. Should I wait to submit it after I return?

Topic: NIW should oppose the RAISE act - soon

You should stop spreading fear in these forums, it doesn't help anyone. The RAISE ACT is far from being signed in to law, and with the legislation track record of the current administration with passing laws. This bill is deeply flawed is unlikely to pass in its current form. Also it's effective date as stated could be FY2019 at the earliest ("The amendments made by this section shall take effect on the first day of the first fiscal year beginning on or after the date of the enactment of this Act.").

I have posted this a couple of days ago but I'm reposing this again in light of the new discussion on the topic about approval times. The new approvals are consistent with the analysis but we will have to wait until some December approvals are posted.



I plotted the average processing times posted here last week together with the recent Chen approvals from November vs the average priority dates. Link: https://ibb.co/jEN2MG

If the current trend of NSC speeding the processing to try to catch up with Texas, a linear fit to the average approval times from the last few months would suggest that by the end of October, NSC should finish processing December 2016 and possibly January 2017.

By this January I would expect them to be processing Jun 2017 and likely settle at a six months waiting time, which is the current average in Texas.

It seems reasonable but then again, all of this is completely speculative.

An EB2-NIW received on 27 Oct 2016 was approved on 13 Sep 2017, totaling 322 days (was updated a couple of hours ago on the tracker).
Nebraska is likely working on Nov 2016 already. Hopefully getting the wait time down towards 300 days.

Your status will only change if either you use your EAD to work or if you use your AP to re-enter to the US.
My J-1 status is ending four month after I plan to use my AP so for me it is not a big deal as I cannot extend my J-1 anyway with a pending I-140/AOS.
