You need to do new Labor and i-140 for the new company, then you can keep extend you h1b for 3 yrs. I went thru this cycle and you can have old priority date.

My spouse AP has been denied due to out of country visit mistakenly. Last Friday , I have received another receipt saying that they are reconsidering the AP again. It seems that they are re visiting the wrongly denied application now. great news. I did not take any action on this one. thought of apply new AP application.

Check your I-94 online if there is any mistake. they do verify you I-94 and make decision for approval. My case they denied due to left us with valid AP.

they may cancel your AP or you will be lucky to get approval , they did approved mine and my spouse one got rejected. It is depend on the officer. there is no rule that they should reject pending AP with travel. I did not have any issue entering with valid AP. you should be good to go and come back. the worst scenario they may cancel your AP application. You can re apply.

We already entered US using the valid old AP. I received the decision that applicant out during the AP processing. when i consulted with attorney , they said MTR is long process. best is apply new one.

According to the USCIS rules, if you depart from the United States before your Advance Parole Document is issued, your application for an Advance Parole Document is considered abandoned.
I suggest that you re-apply for your AP; it will be cheaper and faster!

Correct, valid AP till sep 2017

05/04 - Applied AP renewal
07/20 - Exit USA
07/24 - Enter USA with valid AP
08/02 Denied AP due to exit usad uring AP processing. which is wrong.

Lawyer suggested to reapply AP. hope helps others, It seems that when AP is processing, we should not go out of USA


NOTE: Luckily mine got approved both EAD/AP.Hence the rule is very confusing.

I think MTR is better as we have denial on application and may have trouble apply next time AP. But sometime the MTR will take more than 1 year. it is very painful. I sent mail to 2 different lawyers. lets wait what they suggest. I will update.
