Topic: PERM application for CTS (Cognizant) employees

To Venkygts:

Yeah will soon get the email from GIT. DOL sent the information to GIT on Aug 28. GIT uploaded the required affidavit template on Sept 14th and I got an email from GIT on Sept 17th evening. My PD is 6/30. This just shows the careless attitude by GIT.

And definitely....CTS is in the bad books. I have so many friends who filed through small consulting companies and they are all approved. Joining CTS was the biggest mistake.

On your other question.....Audit is a audit doesnt matter what kind of document do they ask. It will get into the audit queue.

To those who can see the page 8 of ETA 9089. That you'll see anywaz. It has nothing to do when it was loaded. Whatever PD is communicated to you by GIT that remains same.

But, for those who can see two documents, one page 8 of ETA 9089 and GIT_affidavit....those are in audit. If you can see the affidavit template and haven't got an email from GIT....you will soon get it.

To WestportGuy:
I think you also got the audit then. I just got email from GIT. You should get it soon too.

To NeoGC:
Audit response in 4-5 months.....It really gives some hope. God knows....I was anywaz thinking of quitting Cognizant. I'm currently in Canada. I don't think there's any point waiting for Cognizant. Best is to file fresh H1B next year in contracting.

To NeoGC:

When did you fill that affidavit and any timelines when you need to fill and GIT needs to reply back to DOL. So assuming by the way audits go......I think we're caught up for next 2 years?

Seems like I got an Audit.....EB2, PD 6/30.

So far didn't get any email from GIT but I see "GIT-Affidavit-PermAudit.docx" uploaded by GIT team in my case documents on myvisa portal.

This affidavit wording says:
I attest that, to the best of my knowledge, Cognizant has not received payment of any kind from me or a third party for any activity related to obtaining permanent labor certification, including payment of the employer’s attorney’s fees, whether as an incentive or inducement to filing, or as a reimbursement for costs incurred in preparing or filing a permanent labor certification application on my behalf.
I understand that such payments may include, but are not limited to, legal fees, administrative fees, advertising costs and/or any other costs or fees related to the filing of the application, wage concessions, such as deductions from wages, salary, or benefits; kickbacks, bribes or tributes; in-kind payments; free labor, and/or any other form of payment for services essential to the labor certification process.

Please post if you have seen something like this?

I'm sure the decisions must be out for most of the June cases it's just that GIT is taking longer to respond back.....:-(

To Ramasoft: Could you please share your EB Category? From the trail, it looks like EB2's are getting into Audit and EB3's are approved.....

I believe for many associates, PERM was filed in June end. Please post your priroity date, category and start publishing when the PERM is approved. I saw in other forums that PERM's filed in June mid are getting approved but that was non-Cognizant. Cognizant filed in the end of June for most of us:

PD: 6/30/2012
Category: EB2
PERM Approval : Pending

Its crap.....with 4 years bachelor's degree and more than 5 years experience why should Cognizant file in EB3. CTS is just playing with the career's of people. As you're also maxing out in Oct this year....I think there are no other options except getting I-140 approved in EB3 with CTS and switching to another company and then filing in EB2.

Not sure in what category my case would be filed...Manager with 9+ years experience before Joining CTS and 16 years of Education.

CTS is all Crap.

I'm not sure what the experience of other people is from this: But I got an email from GIT that your case will be filed in this month end. Truth no one knows........But i guess they don't tell u the timelines if they dont have any plans to file. They generally say couple of weeks and use words like "may" or "Planning to File". But this time they sent the email that it "will" be filed this month end. So not sure how to interpret that.....

Nopes....I can't work here on TN. To work on TN you should be Canadian Citizen not permanent resident. I'll become citizen only if I stay in Canada for another 2 years. But to work there....I should get a job there. IT market in Canada is not that good......

Anywaz, lets hope for the best and see what happens next. That what we can hope for....

To MountainSeal:

My 6th year is also getting over in Oct-2012. I'm a permanent resident of Canada....not sure if Cognizant has got enough opportunities there. Canada market for IT is not that good.....I worked there for some time with another company. Cognizant too doesn't have enough requirements there.....lets hope for the best. The problem is we're hired here in US by Cognizant and the policies are little different. For moving to India also....we need to find a project there.

My account manager wrote to immigration team and here's the recent reply (Sent today 5/31)

"While GIT still does not have a definitive date when filings will resume, we expect to be able to provide a more detailed update within the next couple of weeks and hopefully able to resume some PERM filings shortly thereafter"
