You can file for H4 EAD renewal upto 120 days before the expiry date. So in your wife's case, you can apply for renewal from Jan 2016.

She can travel without a copy, an extension filed receipt is enough to carry. But i think she would need the Original H4 approval documents for her stamping. I suggest once you receive the original H4 doc, you can send it to her in India to avoid any problem.

I am not sure if spouses on H4 can go for stamping with scanned copy or print out copy. Others who have experienced that should be able to share their experience. Even DMV in USA do not accept print copy of extension documents so I have a strong feeling that Visa consulate will not accept either.

It purely depends. I received my H1 approved document (USCIS sent it to my employer and employer couriered it to my address) in 1 week's time after it was approved. H4 document took the same time although USCIS mails it directly to your address. But in my previous extension, i received my documents after about two of approval.

You may consider an average time frame of 2 weeks from approval date.

I don't think they will send you receipt notice when you upgrade it to Premium. I had premium upgrades 4 times in the past and in each case my employer shared the new receipt copy online but that is not original. i assume that they do not explicitly provide a new receipt for premium because they already provided one during regular processing and your receipt number is not changing.

I was in a similar case last year; had to move to India and was eligible for H1B cap exempt category. Yes, they treat it similar to H1B extension so expect the same time frame. Fortunately, my employer filed for Premium and i was able to come back after 2 months of stay.

You can request for Premium upgrade if not done already. Best of luck in your case.

Honestly, I have know idea on the exact time frame. I am too waiting for it as my Spouse's EAD got approved on Nov 20.


The status in USCIS website will change to something like "Card is mailed to your address". My guess is 2 weeks time for the Card to reach us.

1. Yes, EAD is a card which is of the size of regular Credit card. You can apply for Job after getting the approval notice but you will have to produce the EAD card when you join the employer.

2. Yes, SSN is important before joining Employer. First thing after getting EAD is to apply for SSN. You will get the SSN after one week of applying. You will have to go the SSN office for that, it doesn't happen online. SSN is a must before starting job.

My thoughts:
1. You can apply for your wife's EAD renewal right now but it will get approved only after USCIS approves the h1B/H4 petitions. Extension approval will not happen on the basis of pending I129. I had a similar case - Applied for my H1/Wife's H4 extensions and EAD renewal before our expiry date of 13rd Nov. We have received the H1/H4 extension approvals but EAD is still pending.

2. Your wife cannot work from Dec 27th if the EAD renewal is not approved by then. Not possible to work with a pending I765 receipt. She can start working again once its approved.

Not an expert in this matter but I believe she should now be paying SS/Medicare taxes. You should consult a Tax specialist, CPA or Attorney who have good knowledge on this.

1. What documents she needs to travel.
Wife: Valid Indian Passport
Kid : Valid US Passport and India PIO/OCI Card with return tickets.
2. What documents she needs for H4 stamping.
Assuming that you have already submitted DS160 and have got a stamping date for your wife. She would need the following documents: H4 approval document, H1 Approval Document, Your Passport copies (Preferably color with photostats of all stamped pages), Marriage Certificate, Bonafide Letter from your Employer for your wife's stamping, Your last months pay slips

Upgraded to Premium : 30-Oct-2015
H1 extension approved : 12-Nov-2015
H4 extension approved : 12-Nov-2015

So it just proves again that Premium approval is taking less than 15 days.

You CANNOT work with a expired EAD card. For payroll to run, your employment status should be active. Otherwise, the employer will be in trouble during any audit. I have applied for EAD renewal for my spouse in October. It got expired on 3rd Nov and now we are waiting for the approval.

Waiting till your case gets approved is the ideal scenario. However, there is no restriction on joining the new employer with just the receipt notice, but not many recommend that.

Problem arises when the case goes to RFE, and in most cases, the decision will take time. So if you go for vacation, you cannot come back until yo0ur case is approved. Thats the reason why Employers/Attorneys do not encourage employees to travel when their visa is expired and their case is pending.
