Yeah, it's not very common. Mine is an Employment-Based AOS but after the interview the officer felt he needed more evidence that my marriage was "bone fide" as he put it so he issued an RFE for marriage evidence

Topic: EB2 ROW

I'm EB2 ROW and submitted to NSC on July 10, 2017, my GC was approved April 14, 2018.

So there's hope for EB2 ROW from NSC, hang in there. It's all up to the NBC and local field offices now

this is my timeline:

My PD is Jan 21, 2017, case was filed at NSC on July 10, 2017 and the case was transferred from NSC to NBC on Dec 20, 2017. I received my Interview Notice on Feb 9, 2018 to appear at the San Francisco Field Office on March 13, 2018. My online case status updated to "transferred to local office and they have jurisdiction" after the Interview on March 17, 2018. I was issued an RFE right after the interview which I responded to on March 30, 2018 and 2 weeks later my online status changed to "Card is being produced".

Congratulations!
Didn't they call you for an interview? Why?

Thanks!

They did call me and my wife for an interview on March 13, 2018 at the San Francisco Field Office. At this point interviews are required for all Employment-Based Green Cards. But even though the interview was employment-based the Officer was really focused on our marriage and that resulted in the RFE requesting marriage evidence (even though we provided plenty on the AOS application).

Fortunately it all got resolved quickly and our GC has been approved!

Seems the interview didn't go as well as I expected and in hindsight re-reading my post I should've expected it.

Yesterday I received an RFE in the mail requesting more evidence that my marriage is real. This is honestly ridiculous, we've been married for 10 year, my wife has been on my F1 visa petition (F2 for her) as well as several H1-B petitions (H-4 for her) over the last 10 years and they still want more proof? it's also ridiculous because this is an Employment Based Green Card and instead of being RFEd for my pay stubs or EVL they ask me for pictures of my wedding?

The RFE is dated March14th so the very next day after the interview. I'm guessing the story the officer made up about some files not having arrived from NBC was just a lie to get us out of his office.

Anyway I'll be replying to the RFE this week and report back. Status online didn't change still says "Interview Scheduled"

Hi,

Finally had my interview today and it seems our green card will be approved. I attended the interview with my wife and we were interviewed together.

We showed up at the USCIS field office in San Francisco a full 45 minutes before our appointment. Our attorney went with us and having her made the process so much smoother. She asked the person at the registration desk if we could be interviewed together and he replied that was usually how it worked and he showed us to small waiting room were we sat and our names were called in less than 10 minutes, so we went to our interview 30 minutes ahead of schedule.

Interview was smooth, we were asked to take the oath and then the officer proceeded to ask questions to me first and then to my wife. Mostly yes/no questions relating travel, address and bio information. He didn't really ask anything about my job, just the name of my company and if I was still working there. Then he proceeded to ask my wife the same yes/no questions.

Our attorney had said previously that since this was an employment based GC interview, we had been married for over 10 years and my wife was part of my F1 visa application as well as multiple H1Bs we probably didn't need to bring any proof of our marriage but unfortunately she was wrong and the officer was really focused on our marriage. These officers are not used to these employment based cases yet and they simply stick to what they know so he didn't ask me anything about my job (except for the name of the company and if I still worked there, didn't even ask for pay stubs or employment letter) but instead was focused on how my wife and I met, how big was our wedding party, who attended, etc, he then asked for joint bank statements or documents with both of our names so our attorney politely said this was not a marriage based green card and we didn't have any of those documents to which the officer replied he still needed to verify the marriage was bona fide.

My wife quickly picked up on the tension and started telling an endearing story of our first month together to which the officer seemed satisfied and stopped pressing the issue, but the big take away is: BRING *HARDCOPIES* OF YOUR MARRIAGE RELATED DOCUMENTS (bank accounts, insurance papers, wedding pictures, etc) because it will probably come in handy.

Fortunately in the end the officer said that shouldn't be an issue and he would approve us for the green card anyway. He then filled out some documents and asked our attorney to review them (she found a mistake but he quickly corrected it.), then he looked at his computer screen and said there were some documents that still hadn't arrived from NBC so he couldn't approve us today but that we would do so in the next few days once the documents arrived. Our attorney asked how long the documents would take to arrive and the officer replied that he had already requested them but had no idea how long they would take to arrive. He then told us we needed to got to the Social security office once we receive our green card to get the restriction removed from our SSN cards and proceeded to return our passports, EADs, SSNs, etc. and told us that was all he needed and handed us the sheet that said our case was in review.

The interview took about 35 to 40 minutes but it honestly felt like it went quicker. The officer was really pleasant and other than him being so focused on our marriage instead of my job the interview went really well. :)

I'll keep you posted as soon as I hear more, but it seems it will be a few days until these documents arrive and we get approved. (he said something about a T File, maybe someone here knows what that is?)

Yes, I needed to travel in October and at that point the AP had been pending for over 3 months. I used my H1-B to get back into the US which wasn't a problem before but the current administration changed the policy and they are now denying your AP even if you used your H1-B to travel.

Congrats pedroalbernaz!

My case was also transferred on December 20th but have not received an Interview notice yet. I'm in San Francisco as well.

My package was submitted on 7/10/2017 and received by USCIS the day after (7/11/2017). Filed concurrently with I-140 on PP and that one was approved on 7/24/2017. AP was denied for International Travel and EAD arrived a week and a half ago (1/22/2018)
