Hi Joseph,

Thanks for getting back. After I posted the question, user Zzzzzz provided the reference to an AILA document. Did some additional research also.

Situation 1: Will not show up in pending inventory or demand as there is no I-485.

Situation 2: it will be counted in EB3, the case will not moved to EB2 until priority date is current. So when PD gets current and is not approved by the time the next demand data comes out, it will be shown in both EB2 and EB3. Once the I-485 is approved the case will be taken out from both EB2 and EB3. All that I did not get clarity is the time lag for deletion from EB3. In the begin of this fiscal EB3 demand after 2004 should stay relatively steady. There were no visa approvals in EB2I in the preceeding four months.So logically any porting approvals that happened until May 2012 in EB2I could have been taken out of EB3I Demand by September 2012. The cumulative EB3 demand from 2005 to 2007 as per October 2012 demand was 21625, and as per June bulletin the demand for the same period is 20375. So a net reduction of 1250 where neither EB2 or EB3 was current. Any thoughts?

Sorry I couldn’t get back to you earlier.

I would like to say that the chances your case have been pre-adjudicated is very high.
You can always confirm by contacting USCIS. Also an L2 officer should be able to confirm with you.

Just out of curiosity, which service center did you apply I-485?

Your priority date is Sep 2007. Since USCIS is conservative this year, I am also going to be conservative with my calculations. You might just make it over the fence for your PD to be current this year.

I respectfully dispute your argument.
“Interfiling” is a term used only when you have I-485 filed in either one category, then filing another I-485 in another category.
Theoretically either one of the I-485 could be approved based on the PD. Hence the need for having it listed under both categories.

In the past 2 years, I have read it on multiple platforms and have also confirmed with prominent lawyers (Lawyers that handled my case). Also doing a quick Google search below is the first link that came up.

These rules were implemented quite a few years ago. Porting has been going on for quite long but the flooding is a trend that’s been happening within the last 3 to 4 years.

Situation 1:
EB3 I-140 approved. I-485 not filed yet
Ported to EB2 with I-140 approved
This applicant is also eligible to file I-485 under EB3 provided his EB3 is current. But for India, in the current environment it is highly unlikely that EB3 would be current before EB2 becomes current.
This applicant would show up under both EB3 and EB2.

Situation 2:
EB3 I-140 approved. I-485 filed.
Ported to EB2 with I-140 approved
This applicant is eligible to file I-485 under EB2 provided his EB2 is current. But this would be interfiled since EB3 I-485 was filed. This applicant would also show up under both EB3 and EB2 until either is approved based on priority dates. (It’s mostly going to be approved in EB2 category since EB2 is much ahead of EB3 but many many years ago that wouldn’t have been the case since there wasn’t much difference between EB3 and EB2 PD. But back then there wasn’t a need to port too)

Things to remember when answering your question:

1) Demand data ONLY includes I-485 applications which has been pre-adjudicated and is just awaiting visa numbers.

2) According to CO, when an applicant ports from EB3 to EB2, they are counted twice. Only when the green card is approved does the duplicate file number go away. At that time, CO’s office is told by USCIS to cancel a pending EB-3 case

Ans to your first part: If the applicant has his I-485 application in under either/both EB3 or/and EB2, only then would it show up under the Demand Data number for either/both EB3 or/and EB2.

Ans to your second part: Based on my thoughts and calculations most of the cases prior to 2005/2006 could be porting from EB3

Yett,
I agree to your posting with a correction in 2nd statement.

1) Yes, H4 is eligible for in-state but would not be eligible for on campus job or OPT after graduation
2) F1 is still eligible for in-state provided it aligns with the requirement from my previous posting. (We had to submit marriage certificate)
My wife converted to F1 after the first semester, since she wanted to be eligible for OPT. She was still eligible for in-state in F1 status for the rest of her school.

I understand your plight in having to pay out-of-state tuition for your daughter.
Have you have confirmed it with the university? I dont know which state you live in. I am in KS, the rule in KS state that an employee's spouse/children are eligible to get in-state provided the employee is living in the state, his/her GC is in process and has the intent of living in the state after GC has been approved (This can be substantiated with a letter of employment from your employer). Your state might have a similar eligibility for in-state.
My wife was eligible to get in-state for her Masters. I was also eligible for in-state for my 2nd Masters.
Hope this information helps. Check with the financial controller at the university.

Thank you for your postings on this forum.
I was reading your priority date predictions and rate of SO for 2013 fiscal year. If I may pick your brain......

My priority date is Feb 2007. I am hoping it gets to my PD during the last quarter of this year say August and I apply in August 1st week. I believe my dates would stay current till September 2013.
Being optimistic I believe I might get my EAD.

Based on your prediction, dates might retrogress during the next fiscal year which would reflect in October 2014. What date is it expected to go back to?

Do I stand a chance in getting my GC this year?

Let�s handle this thread professionally please....

My take is that the bulletin should definitely move forward during the last USCIS fiscal quarter of 2013 (July, August, September) considering the spillover and any unused in EB2I category. Due to the ongoing EB3 to EB2 porting part of the EB2I allocated 3163 GCs would have already been depleted.

How much or if there would be any forward movement reflected in the June 2013 visa bulletin is up in the air. I am hoping the dates move forward atleast a bit for some hope for all of us.
