Topic: PERM application for CTS (Cognizant) employees

Hi Raj,
I think you can extend your stay for another year by changing your H1B status to L1A if you are already a manager.
In the mean time (before end of 7 years), if you get your PERM approved, You can apply for I-140 with the premium processing which would take another 1 month. If you get your I-140 approved before your L1-A expires, then you can switch it back to H1-B after seven years.

Please check with CTS immigration team once.
If my understanding is correct, please reply back. So that some one else can also opt that path.

Thanks,
Alex

Topic: CTS - Cognizant Technology PERM filing cycle -2014

Hi,
Thanks for your reply. but still I am bit confused.

My question is, I am applying the for PERM with my current H1 visa and the H1 is expiring in October 2015. Then say I am getting converting my visa status to L1A. After my visa status change to L1A and if I get my PERM and I-140 get approved, really we can convert back to H1 which is already expired?

I understand that if we are in valid H1 when we get I-140, we can keep extending. But I will be in L1A when I get my I-140 just in case. Still Can I really convert back to H1 though I max out the 6 years criteria.

They said end of this year or may be next year in first quarter. I just said Feb 2015, to talk about my worst case scenario.

Here is my case.
I have my H1B max out in October 2015 and till now PERM is not applied by CTS. They say they can apply when the PERM cycle opens next time. Say they are applying by Feb 2015. Can I still convert my H1B to L1A at the end of six years and extend my stay for another year? before end of 7 years, if my PERM and I -140 got approved (Between Feb 2015 to Sep 2016), Can I really convert my status back to H1B at the end of 7 years?

Cognizant Immigration team said, yes. It is possible. Can any one please suggest your thoughts on it?

What about converting to L1A and complete the 7 year max out? Then start extending the L1A as the PERM would have got applied 365 days before? Is that a workable solution?

Right now I am in L1B visa and it is getting expired by this October 2014. I got my H1 approved from this October 2014 to October 2015 and my H1 will be max out in October 2015.

L1B Max out - October 2014
H1B Max out - October 2015

I just started the PERM process and cognizant GIT team is informed that they don't start the PERM cycle until end of this year or start of next year. So my PERM will get applied may be some time in next year. Say they are applying it in Feb 2015. But my H1 is max out in October 2015.

What if my PERM is not approved before October 2015
1) Can I be able to extend my H1B still?
2) If not, Can I be able to apply for L1-A and be in US for another year and then come back to H1? How it works?
3) or I have no other option other than leaving back to India??
