Please work with a good attorney to represent this case. you will need to take steps to reinstate your wife's H4 status..She has accrued a week of Out of Status(Mar 9th-16th) until now...The sooner you explain to USCIS what happened, higher the chances for consideration.

Topic: Perm Audit Received

1)Pls chk the PERM tracker for actual audit processing times as of today.
2)Random audits are common. They should pass . Go to sites like myvisajobs.com or dolstats.com to see how many PERM's were rejected for your company till date to asses the risk around this.Unless there was something drastically wrong during filing,no issue is expected.
3)PERM's can be filed in parallel across companies.Not an issue.PERM is for Future employment,so thats a valid scenario
4)You 6th yr end in Sep 2018. ->Meaning you filed your PERM prior to entering 6th yr(Sep 2017)->which automatically entitles you to get a 1 yr extension on pending PERM next year if your audit for some reason is still not cleared.
5)There is no relation between PERM being audited vs 140. They are 2 seperate processes for 2 seperate reasons.
PERM is based on the market job scenario. 140 is "Company specific" document which helps prove that the employer will have the "Ability to Pay" you in the future until you are his employee. So no issue again there.

I did get an audit in my PERM,later on went to get my 140.

So chillax and enjoy the ride! :-)

Topic: Passport renewal when H1 extension is pending?

Is PP renewal @ the Indian consulate an issue when the H1 extension is pending?
The H1 extension was filed with the OLD PP.(with >6 months for expiry).

Can we just go ahead and apply for PP renewal now considering the "regular" processing timelines for Extension currently?
Don't want to leave this PP renewal till the last minute...

Any suggestions???

The PIMS update is a blackhole at best..
In dec 2014 me and my wife(both on H1) went for stamping...
My wife had recently done a h1 transfer(2 weeks before her stamping ) and stamped her H1 with no issue in PIMS.

On the other hand,i had my extension approved from my company 6 months before(in May) -and still faced the PIMS issue.
Good news with PIMS is that it should not take more than 5 business days max(mine took 4).

Again,we cannot do any specific task beforehand to check if we can actually mitigate this issue...
I have read that some folks email the consulate before hand etc...but im not sure about the authenticity of it as a process..
So,not able to comment on that...

You will need to schedule interview in ustraveldocs site.
It will prompt you with some questions (regd ur visa expiry etc) and it would automatically redirect u to consulate interview slot booking or dropbox confirmation..

You might need to fill ds160 prior to trying it out i think..

or just call ustraveldocs customer service explain your case,and know whether u are eligible for dropbox(easier option)

Please check if you are eligible for Dropbox.
Its less stressful than interviews.

You will be eligible for dropbox if you visa expired not more than 12 months ago.(even if you have changed your employer).

Not stamping and coming back into the country is okay as well,just that you need to show your new 797 (for employer change) at port of entry without fail.As the CBP officer needs to properly enter your i94 record based on the latest 797.

If you think that's something you wouldnt want to do,just stamp it again.
Stamping again should not be a hassle through dropbox or interview if you have all documents and payslips.

Double check as i said earlier if you are eligible for dropbox...

For your h1 visa interview booking,please double check if u are eligible for dropbox.

If u are,then u need not worry about original at all.You will have to drop a copy only.
u might need the original 797 only if you are attending the interview in the consulate.Mostly they ask for the xerox copy atleast.

in general for visa interview booking,u need the EAC/WAC receipt number of the petition.
you can calculate the time taken to get your documents once its approved and apply for the interview.

H1 extension in premium(even with RFE and response) should not take more than a month (optimistic case).

Topic: Interview Waiver Program "Dropbox" experience for H1B in India

I just came back from VISA stamping last week in chennai .
My case was like this:

Though i availed the drop box facility,i was given the PP back after 7 days with blue slip(221 G) asking me to come for n interview.
However,after i attended the interview my visa status on the ceac changed to "Admin processing" even though the VISA officer said that my case is "Approved".

This "Admin processing" status nowadays seems to be commonly put up for everything-looks like it could also mean printing the visa and affixing to your PP.(looks like that was the case for me)...It differs on case to case basis.

I too became restless after seeing it but eventually got my PP back in 4 days.

Stay relaxed and all will be fine in your case as well :-)

Employer can revoke H1/140.but USCIS does NOT do it in premium processing.
So,im surprised when u say he revoked already?

Did u mean to say employer applied for revoke??(it shld take 1.5 months atleast to be processed at USCIS)

Topic: Second time H4 visa stamping using husband's H1 approval

If you need to join your husband in USA very soon,pls ask him to process the extension in premium processing.
If that is done,he should have the extension 797 in 4-6 weeks(even if he gets RFE).If you are lucky and no RFE,then it only should take 2 weeks.

You could then apply for your H4 visa via consular processing (for you/your kid) and join your spouse here.
The catch here is the timeline for H1 extension(in vermont center) for regular processing.

If you apply in regular its currently taking 4-5 months.(they are processing May end extension applications right now).
So if you want to come here soon,through H4,premium processing is the best/fast option.

ABout your other option of B2/tourist visa,its possible,but they will ask you to mention about your prior visa in the DS160.
They might ask you about it in the consulate stamping.And later on assuming that you step into the country on B2,you will have to apply COS from B2 to H4,which again takes 4-5 months within USA.Please bear in mind that COS to H4 from B2 does not have premium processing.
So,it's a longer process compared to the first approach (H4 stamping in India) which you mentioned.

i dont think complete file request is "a fee based" feature.
They usually charge 25$ or so based on some specific criterion.

In your case ,i think you should get the CD,as the request already has been processed.
If any,they might ask you to pay by specific instructions through the mail which you receive with ur CD.

Again,i think it does not apply for your case,lets c.

I think "Walgreens" answered this question below.
GC is for future employment.

As long you have an approve 140 and initiate an extension with your employer in US,you should be able to stamp it with no issues,sitting in India.

No recent payslip comes into picture when you have been in "H1" status INSIDE USA and have no pay slip to prove your H1 status.

In this case you are in India,and when you join back ur company in USA,you will have to show proof of employment offer in USA etc when you for stamping in India(with your H1 extension 797 based on approved 140)

1.Yes you can get H1 approval and subsequent visa.But the exact duration(3 or less than 3) depends on your project duration etc.
2.It does not fall under quota.
3.You can apply anytime from India for extension of your H1 based on approved i140-provided your 140 remains active.(meaning your employer does not revoke the approved 140,for any reason)

hey,i feel you are panicking unnecessarily,pls relax.
there is nothing called as "listing" when it comes to DOL.
you lawyer cannot do anything to list your company in DOL.

Let me be more clear:

All the sites you checked, i.e; the DOL site,permchecker site,DOLSTATS site etc ,will only show APPROVED PERMS.
Currently there is no provision to see any PERM which is "audited"( like yours) until it's actually "APPROVED".

if there was some other employee from ur company who already had perm approved ,it would have been displayed in these sites.

since u are the only perm initiated in the company and again since u are audited,nothing shows up on these sites.

just sit back,relax and wait for ur audit to clear.u will automatically see ur company in all sites after that.

Also another remote possibility is if the employer initiated perm with some other parent company name( he might have a lot of explanation to do with dol if thats case when he filed)

Your priority date is YOURS to keep UNLESS uscis pulls down company A for any fraud related activities.

Revoking 140 by an employer is a common practice if an employee quits.That does not strip u off your PD.

Personally i would say filing H4 is better option than B2.H4 is dependent status-meaning you can stay as long as your spouse is here.H class is dual intent status,so u staying back in US is not an issue.

B class is more temporary,and NON immigration intent.
So assuming you change to B2 now,your COS from B2 to H1 will be scrutinizied more as you are necessarily changing your IMMIGRATION INTENT from non-immigrant to immigrant.

Filing H4 COS is very easy.As long as you have proof of your paystub,for the last payperiod(to prove you are in status),and proof of last paystub of your wife(to prove she is in valid H1 status),you can go ahead and apply online.

Problem might arise if your wife is supposedly in H1 and NOT running payrolls(could be for any reason).
If that is the case,then applying H4 puts her H in jeopardy as well(as she will be considered out of status by USCIS)

Hoping she is running her payrolls-Just apply for H4 immediatly,if you have no employer to transfer your H1 by your end date.
