Looks like your employer is out of mind. How can he say that "its not an issue as you have a valid I94 and 797". Does he mean that instead of 2013 if it is printed 2018 as a printing error, you can stay that long...

6yr rule is standard for everyone. If USCIS realize the error it made with you, they will simply say sorry and will ask you to pack your bags.... at that time neither your employer will come to your help nor you can argue for their mistake. You can simply call in to any Q&A sessions conducted by lawyers on any Radio and you will get a bundle of info (and ask your employer to do that as well - instead of giving wrong advises).

About next steps, since you are already getting into 6th year, get your GC filed asap. Once you have Labor & 140 approved, you can seek extensions. And whether your current employer will agree on GC filed from someone else is completely between you and him. I don't see a reason why he would not. Either he should file GC for you or he should anyway be ready to let you go. In this case, you are atleast staying for some more time and earning him more then he can think about. If he really is worried about that, he could very well file your GC and atleast request/force you to stay longer. Looks like he want to save GC money and effort while earning as much as he can from you. The route you are taking will only benefit him more then he thinks and I don't see a reason he will not accept it.

If I was you, I would go and see a lawyer and take the most safe route.

2. When did you land in US? Your work eligibility starts on 10/01 and if you got here later, all that could have been recaptured during renewals... If you were here on day one and never left US, you should have already informed this to USCIS? You cannot claim the advantage over someone's mistake - especially on such immigration matters. Check your entry date and act accordingly... do not take risks plz...

Yes - this is definitely wrong forum. People here are so messed up waiting for GCs and you are asking about Citizenship... Just imagine the temper of everyone...

To answer your question, as far as I know, from the time you got GC (actual card date) you need to have a gap of 4 yrs 9 mths to start your citizenship process. Gurus can correct me if I am wrong. You can check with attorneys as well.

On other note, I strongly feel and pray for some progress to the EB3 guys who have been waiting for a while now - even if it is at the cost of EB2. They are waiting so long, we can afford to wait for some time. Hope HR3012 gets through and EB3 guys start progressing.

Topic: Sample Affidavit Birth Certificate format for filing I-485

Hi All

Need clarification and opinion on getting a BC from CGI. I have seen this in our Consulate General of India - SFO site ( ) wherein we can get a birth certificate issued by them based on the details of our passport. Ofcourse Passport would have been issued based on the educational certificates. My wife did not had a BC at the time of getting passport while in India and I got a simple affidavit from the magistrate in a Rs. 20 stamp paper. It was like self declaration and the magistrate issued based on the certificates. I got the passport using that affidavit. So - If CGI gives the BC here again based on the information from Passport, will it not serve the purpose. The reason I am looking for another BC from CGI is that the earlier affidavit is self declaration and USCIS might not consider that. So to be safeside I am trying to have one more from CGI. Can gurus throw some light on this plz...

Going by 4-way lane example, according to ROWers logic, even if other lane is empty, one still has to wait till a vehicle approaches in that lane and at that point since you are waiting, you can go. Also, you want to allow x% of vehicles to pass the stop sign and next x% to wait for another hour/year. Doesn't it sound stupid? Think before you speak.

The 4-way Stop sign is a good example but sorry to say you guys completely understood upside down.... "well tried to prove that 3012 is unfair". How long you guys are here in America? Forget America, how about your countries? Not sure what you guys observed in real life.

If there is huge traffic in one of the lane of 4-way stop sign,

If its once in a while, people pay less attention (eg: even during accidents, such situations arise).
If it is happening regularly, you will soon see a signal to streamline the traffic.
If it is still not resolving the problem, the signal timers will be set to low for less traffic lanes and high for higher traffic
Even after above measures, if it doesn't solve, the administration will try to put a flyover for the higher traffic lanes to
avoid inconvenience.

Haven't you ever seen/observed such things. Any point in time if administration sees that the people are facing inconvenience, it comes to rescue them irrespective of race, community, age, etc. India/China is not asking for a flyover. Somehow this logic was not applied for PR/GCs and that makes US look different and HR 3012 is only tring to fix this issue.

Whoever came up with the argument of using 4-way stop sign example against HR3012 is so stupid that he didn't even think for a min before getting into argument. This is why you need I/C... ha ha ha.. Stay calm guys. Senators very well know what they are doing. If the bill has merit, it will pass. If not it will die. Why to fight on these Forums? just stay cool.

We want US to be like what it is - free and fair competition, without indifferent laws or behavior towards certain set of people/countries. Even in case of Fraud, it has to be dealt similarly without any bias. Wherever there is Fraud, punish them irrespective of which country they belong to.

After coming so close, don't do any thing stupid that might make you repel for coming years. Just stay calm, do your job, say yes to whatever your employer says and most importantly, you please do not do anything that might provoke him to take any kind of action. Every dog has a day. Today may be his but not always. Some people are like that - even though they don't benefit anything, they still want to harm. See if talking to him in person can minimize the friction. If possible, take a few days break, go out of town and spend some time with close friends and just try to have fun (without talking about this). Immerse yourself in work and nothing can distract you. Start creating positive atmosphere man. Start talking only positive about your employer all around you. It doesn't cost you anything but will benefit you in every manner. Do not listen to anyone who give you false confidence and provoke you against employer. Its your career in stake and no one else'. Don't keep those 90, 180, 240 or 365 days in mind. Just be positive and days will runaway in no time. Good luck buddy!!!

Come one buddy... you seems to be unsure about taking the sarcastic comments... and you thought that I have written a full page article and did not realize that I don't know whats the expansion of "ROW" ... by the way... what is HR3012, EB, FB, I/C etc... can you also educate us on this plz... what kind of teacher you are... you picked only "ROW" which is your fav. and left other abbreviations.... thats not fair buddy...

instead of thinking so many things which are not in your control... why don't you think positively. there are 3 yrs of transition period and within that if everyone work together on recapture, entire EB can become current.... after that lets simply follow FIFO... no one is stopping ROWers to grab the GCs through FIFO.

And you are saying "Because of that, US employers will not be able to sponsor the workers they need." I thought they use H1s for sponsoring the workers from outside US. They changed this also to GCs... Comeon - you should tell such things to all the people sitting in the Forums... how can you be so selfish and keep all the info with you and throw bullets on us at your wish..... And yes... no body but Indians support 3012... you are absolutely right - all those 389 Reps who voted in favor of 3012 are Indians. They were adopted by US and elected as Reps so they can support the Bill in the House. Nice observation. Keep up the good work.

And about 72% - why didn't ROWers used entire 7% or 72%. How come so many numbers went unused? What kind of sadism is it that neither you eat nor you want others to eat.

And btw - if you really had this much concern, I am surprised how come you allowed Spillover rules to get through. Probably you tried even at that point to stop and couldn't do much. Now trying to stop 3012. Atleast now you should understand that US has realized that whatever was going is not right and they are trying to do justice to everyone. Most of them who are earning here are forced to go because of these delays and all the money along with the skills are going along with them either back to their home country or to some other competitor. Whatever is happening now is in right direction. And don't think that those 389 voters in favor of the 3012 are not as wise as you.

Once again, lets stop fighting. Whatever has to happen will happen. We all are immigrants here so better understand that. US will do what is best for them. Help in fixing the issues such as illegal immigrants.

Sorry for the long write up...

EB3 guys have huge backlogs and with the amount of experience they already have, they may be more or less equivalent to EB2 or even EB1. Its always like people earlier to us have better quality of education with less technology then current generation which ideally means they have putup more hardwork then the current. They are still on par and completing with every one around them. Otherwise they would have gone by now. Don't we respect our elders... then why is it not the case here? If any of those guys are behaving improperly or taking advantage or curbing the growth by some means, that should never be tolerated.

I am an EB2 but want to support EB3 guys irrespective of where they are from. Lets have our fight at our home country. As far as US is concerned, we all are immigrants and if tomorrow US decides that immigrants have to go back, it applies to everyone. Better to look at something that benefits everyone.

I don't understand how it will impact ROWers if HR3012 becomes law. As of today, with 7% cap, ROWers are current under EB2 and lagging behind in EB3 but not as much as EB3 I/C. Instead with HR3012, ROW will have 15% during transition and then after 3 years, everything will fall in line. If not, ROWers will still have 7% and will still go at same pace. Spillover will still go to I/C with the huge backlogs. Lets assume HR3012 is passed, everyone can work on recapture and then everything is set within the transition period. Who is forcing ROWers to stand in queue next to Indians or chinese. Let the FIFO gets enabled. Within the transition period, the EB3 gap between I/C and ROWers will vanish. After that, everyone is FIFO. If not, it will take more time for EB2 I/C to become current and with ongoing Porting from EB3 to EB2, no one knows how long it will take. Passing HR3012 and then getting through recapture - everyone will be current and will get rid of illegal immigrants. How does this sound? I recently read elsewhere that illegal immigrants are costing over $180 Billions to US by way of insurance or unpaid taxes. Is it not important to fix that first?

Once immigration issue is fixed (with all getting close to GC), no one should ask to be given preference to them. If you stand first in queue, you will get what you deserve. No one should have the liberty of coming whenever they want and still get GC in short time. Its better to consume the available visas rather then letting them go unused with 7% cap, which is happening from past many years.

If you go by past, its better to clear all the waiting list. If you go by current, you should simply follow the EB categories b'cas they are in place with some reason and purpose.

As far as fraud and cheating is concerned, its everywhere and that has to come out and every effort has to be made to curb all such things. We have seen USCIS and DOL taking lot of steps in past couple of years. They will take more steps if needed and its better to let them do their job instead of we all fight. A fraud/cheating is not right by anyone - may it be Indians or Chinese or ROWers... and no one should blame entire community based on few samples. Majority people are good and they need to be respected. Otherwise there is no meaning of majority and their honesty - may it be Indians or Chinese or ROWers. USA is not only land of dreams but also land of security. After 9/11 we have seen how security has changed this country. Similarly, after these immigration frauds, fixes are in place. Major gates are closed. Minor leakages here and there will apparently get closed.

Guys - lets stop this fight and do something that benefits everyone. Instead of 2 support and 1 oppose, let all 3 support and then let it continue for rest of the programs. Let this 3012 get through and then start working on recapture. Its better to compete with each other on skill sets and capabilities rather then trying to eliminate each other. Do not forget, if we eliminate someone, you will have someone to eliminate you. United we win - whether in homeland or foreign land.

It looks so bad to fight and abuse each other. We all are in Foreign Land and we shouldn't forget that. Especially this land is giving bread and butter and teaching to respect and be friendly with every other.

I believe I140 should be filed within 6 months of approved labor. So approved labor = certified. If I140 is not filed within 6 months, its expired labor... don't know if someone can capture PDs from expired labors... If that is possible, some of them might have captured, otherwise, we can simply discount those numbers and count only certified and any RFEs... denied and withdrawn are already out of queue. I may not be 100% correct... if someone knows better, they can respond.

Also, ~with 60K in 09 and ~45K in 10, looks like all this should be cleared in an year... with a total of 140K visas. Again, this has less certified cases and also covers everyone (Rowers, I, C for all EBs). Shouldn't be a surprise to see the EB2 current at the max by mid of 2013 with spillover rules... if HR3012 comes into effect, it may be early as we don't have to wait till end of FY.... either way, EB3 should also start moving faster (atleast not one week jumps). And by end of 2012, faster EB3 movements can be observed based on spillover rules... I am just all too optimistic... :)

They look everything in genuine manner and if anyone can justify that something is not correct, they would definitely verity it. If you have a point to justify, do that. They must have already got so fedup by people crying on each other... and please don't even keep calling senators... they know what is right and what is not... don't frustrate them to take any decision that may impact everyone. Not sure why ROWers are against this bill... how can they justify themselves or gain confidence by saying that Indians/Chinese are either by fraud means or can cause any trouble to Americans... indirectly American Immigration or Security policy is being questioned... does it make sense... in the past two years, so many frauds have come to light and also due to recession, immigration laws have been tightened.... after all this, if anyone say that there is still fraud or injustice to Americans, it is not right.... you are only doubting the sincerity and integrity of American Laws and immigration...

On the otherhand, how does it impact negative to US... there is a law for 140,000 potential visas and by not filling that quota, US is already loosing so much of revenue by way of I-485 filings, tax and spending..

Above all, it is only going to create more competition among those 140,000 filers which will bring best talent to America... further its going to be FIFO... so who ever is eligible and file the GC first will be eligible... if ROWers are eligible, they will get the GC first... its better that either ROWers get or others (Indians/Chinese) instead of letting them go waste.... It is understandable that for initial few years, most of them would go to India/China since there is a huge backlog... but in order to have legal immigrants, its better to clear this backlog and make everyone current... it should help everyone.. . I am only trying to be fair to everyone including ROWers...

Instead of going against this bill, why can't all the ROWers support the Bill to recapture the lost Visas.... This might almost help to put all of them to current.... Guys - we all are immigrants here.... lets be friends and help each other on foreign land... :)
