Quick question here - so 180 days for I140 approval. Does that mean that you should start your H1 transfer with new employer only after 180 days of I140 approval? Or you can start your H1 transfer before that also and make sure current employer doesn't know / revoke I140 before 180 days? For example, if someone's 180 days are completing on March 5th, then can he/she start H1 transfer in Februaryitself and get all paperwork ready and can quit after March 5th? or should he need to wait till Feb 5th to ensure 180 days done with approved I140 before initiating H1 transfer

Even without this rule, we can switch jobs with approved I140 and can retain old PD. The impact is only if old I140 is revoked for any fraud reasons which is very unlikely a case. So what is the worry in switching jobs if PD can still be retained. Am I missing something?

Thanks USGCTracker for your response. Can I ask why you recommend waiting for upcoming I140 irrevocability rule (anyways it's not sure when they will publish final rule and make it into effect). Will that rule mean that current employer can't revoke I140? As with existing scenario, if we can retain PD until unless I140 revoked for fraud (which will definitely not be the case), why is there a need to wait for the I140 irrevocability rule?

1. I-140 approved couple of months back and got H1 extended for 3 years. Is it safe to switch to new employer? Hoping H1 xfer can be approved for 3 years!!
2. Will new employer be able to retain the old priority date?
3. Does Cognizant revoke I-140 upon resigning?
4. Will this effect H4 EAD for wife?
5. Any reasons for playing safe and not switching?

Guys - need help / guidance on my case please. Below are my details:

I140 filed - Sept 2015 (Regular Mode, TSC)
RFE received - 1st Dec 2015
RFE response filed - 1st Mar 2016

It has been 3.5 months now waiting for decision on RFE response. I called USCIS Cust Care twice and they say we have info on your case, but can only reveal to petitioner/attorney. My CM is adamant and not calling them even on multiple requests and keeps on saying that if they check with USCIS, the only response they get is case is pending. He is saying in order to expedite get D approval for Premium, but D should write that even though GM doesnt recommend, he still approves. Now it is not easy to convince for Premium approval

Can someone recommend what can be done here? I read people saying 60 days or 120 days figures as standard for response. I've seen people getting response back in max 1 month after RFE response barring a couple of unfortunate cases. Not sure what to do here. Please guide

ok thanks ... USCIS status change for my RFE response happened on 3/7 (even though was filed on 3/1) .. so its been 70 days now. let me also try to get it moved to Premium then

congrats dude... so finally you made it ... i am also waiting since 3/1 since my RFE response was filed
quick question - I was told by my CM earlier (when my RFE response was being filed) that it is not recommended to upgrade to Premium as case can then go to a different USCIS officer. I see you upgraded to Premium after 2.5 months of RFE response filing. Did your CM agree for it? Also whose approval did you get : D or D+?

Anyone waiting for more than 10 weeks for I-140 approval after RFE response was filed? My RFE response (regular mode) was filed on March 1, status updated on USCIS site on March 7, and its been 2.5 months now and no change yet. It is filed to Texas Service Center. Anyone in same boat?

Yes, I read in previous posts that people were successful in getting the experience letter from Infy now. You can search through previous posts if you would like. You need to send email to US_empverification@infosys.com to request it. I remember a person with email (vsunilkumar.vsk@gmail.com) who got it. You might want to send a note to him as well

Topic: Upgrading RFE Response regular processing to premium risky?

Hi - as I told on the other thread, I was told by GIT CM that it is risky to upgrade RFE response to Premium mode as when we file back in Regular back, it goes to the same USCIS Officer; but if you upgrade, it can go to any USCIS officer and the new officer might ask something else resulting in another RFE. It's been 6 weeks for me also since RFE response was filed and waiting to get a decision. I am with you that this wait is really frustrating
