What is the point making dates to 07/01/2009, when dates already moved to 05/01/2010 in year 2012.
This will not help anybody , this is lot of disappointment thousands of people.
We are at mercy of Beurocracy and not why USCIS can't handle 1 yrs cases, when they handled same in 2012.

This is so painful,very bad part on USCIS. Hope they will revert back in next 2 days to original bulletin.



I think it is for the porters which will help USCIS/DOS gauge demand for this Fiscal Year.



Porters?? USCIS made the blunder and you still try to be blame it on porters,EB1C,etc. It's because people like you Indians get what they deserve.



where did i blame porters... you are assuming too much... the world does not revolve around you...

guys.. lets calm down - we need to figure out our options. Is there an attorney in these forums who can help us understand our options ? Are there serious grounds for a class action lawsuit ? What about all the $$$ that so many people spent + plus all the pain and suffering ? Is the action by USCIS illegal ? Which law have they broken ?

even if it correct, thats only for EAD not for grene card. SO medicals will be waste. I dont think dates (2011) for green card will be current in 1.5 years

Hopefully that will be great if they start any of October denial cases. But I still didn't see any updates from August or sept cases in this link so not sure whats going on . Also for cts we have to wait atleast one month extra to get the updates only on last day they will update..so I'm sure I will not hear anything at-least for one more month.

All Please share if you hear anything from July/AUg/Sept denial cases.



My PERM was denied as well (PD is in Nov) and I am not sure I will have to wait till November for updates. However, Cognizant PERM application window will open up again towards end of October, so you might want to consider refiling as soon as possible.

ah i see. so in case of retrogression CP is always better seems. I didn't know that, otherwise would have been chosen CP in stead of AOS.



In case of retrogression if your interview is not scheduled then you will neither get GC nor EAD/AP. Thus, if retrogression is imminent then AOS is better unless you don't mind paying CP and AOS fees i.e. pay CP fees and if dates do retrogress the you will have at least 3 weeks to file AOS. However you will forfeit your CP fees.

NVC notices are good news. If June 2011 PDs are getting these notices, chance of a major retrogression seem unlikely. Even if movement stalls till October, June 2011 CP would be expecting GC by March 2013 (by the 1 year rule). If I consider a 6 month processing time, we arrive at October 2012 for June 2011 PD to be current!
Friends, I am no expert at this and got hooked to trackitt during last month's frenzy. Hence my calculation may seem ridiculous. But that's ok -- nobody really knows what is going to happen!!

I am the person who got NVC fee notice (PD June 2011) and I can assure you its not a spam. The fee notice directs you to www.ImmigrantVisas.state.gov to pay the fee. Moreover, my case number is printed on the Letter and it has the correct names for all the person. Finally, it was uploaded by my lawyer on their website (they are the ones who got it).

Topic: CP vs AOS based on recent movement

Gurus,

My PD is 06/2011 so this may not apply for me anytime soon but the recent movement has been unprecedented and I had a question related to CP.

I know it is easy to go from CP to AOS without any additional documentation. Therefore, I had applied as CP when I filed I-140. Moreover, it was general consensus that you generally get Fee Notice and FP notice even before your dates are current (i.e. 6 months before your dates are current). So presumably as soon as the dates got current you would be called for an interview and would get GC faster than AOS.

I do not think any Fee Notices were sent for people in 2nd half of 2009 since the recent movement caught everyone by surprise (including State Dept). What is option for people on CP? Should they continue with CP knowing fully well the dates might retrogress and they may never get an interview? Or should they go for AoS? If the PD is current when is a visa number allocated? Is it when the Fee Notice is sent or at some later stage?
