Hi, how many days it has been since you got h4 approval notice in mail. Also, online status is not updating at all. I received my wife's h4 approval notice 3 weeks back, but online status still shows case received. For my h1, it just updated yesterday, saying the was sent

Received H4 approval notice one week back. Online status has not been updated. Pathetic USCIS.

It is really weird that H4 got approved before H1. I was on the assumption that my H1 would have got approved as H4 was approved nearly 3 weeks back.

I have been under the same impression but, I guess, not anymore! This is crazy.

Hi, I applied for H1 extn and my wife's H4 extn at a time. The receipt notice date for both is May 25th. I got my wife's H4 approval notice in mail nearly 3 weeks back. The H4 approval notice date is July 10th. But, till now I haven't got my H1 approval notice. I checked with employer also once today. Today, when I checked my H1 case sttaus online, it says an rfe was sent on Aug 3rd. How come that is possible. When my spouse H4 got approved already and received the approval notice in mail almost 3 weeks back, and now today H1 extn went to rfe status. This is so confusing and frustrating, has anyone faced a situation like this.

In my case also, I have already received H4 extension approval but no decision on H1 extension yet. They were both sent together as part of one package. I am worried seeing your update now.

To give you all update :-

Case received - 24 Feb 2017 with Nebraska center.
On May 25, I received an email stating that my case is transferred to another USCIS office.
On May 26, I received an email stating that my case is transferred to another USCIS office.
On May 31, I saw my status. it says Case Was Received At My Local Office.

i received notice from my attorney saying on 25 May. USCIS Transferred to California.

11 July - Case approved. Received Soft copy of petition from attorney.

Still USCIS Case status is not updated. It still shows Case Was Received At My Local Office. Checked it.

Had you signed up for texts? Did you receive any of them any time?

Received a text saying that my case is now updated. Checked case status on USCIS website and there is no update. Last update was last month that the case was transferred to CSC. Did they just send a text in error, is there a way to know? The case was filed in April. Very frustrating!

Topic: US Consulate Visa Appointment Availability - INDIA


I got an email from ustraveldocs that due to technical glitch, the appointments from June 22nd to June 26 has to be rescheduled from July 6th onwards.
I have finger printing tomorrow.
Can I reschedule just the visa appointment only or do I need to cancel both?

Same issue, rescheduled appointments to after 6th July. How long does it take to get the passport back? Flight back's already booked. What a mess!

Topic: H1-B re-stamping with stamp still valid?

Can I get H1-B stamping done when the existing stamp is valid for ~9 more months? The current H1, H4 stamps for me, dependent is valid thru Mar 2016 while my H1 extension has been recently approved till Sep 2017.

If we visit India, can we get re-stamping done to get longer validity or is there an earliest date (say, six months before expiry similar to H1-B extension filing) before which it cannot be done?

Also, If we travel back to the US with current stamps, can we get I-94s with validity matching my H1-B petition's validity of Sep 2017 or will it be matching our current H1, H4 stamps of Mar2016?

The acceleration of EB2 ROW approvals is indeed a reason for concern. The upward trend in EB2 ROW approvals were expected, but the approvals in that category is moving up really fast...

What are your latest predictions of PD this year?

=> Depends on the timeline. But last action rule will apply. If you return USA, and you get COS extended, your status will be defined by this COS I797 expiry.

Thanks again. Are you saying that there is a possibility that they may not cancel the EOS after he leaves the US while the extension is pending and may still grant EOS which will be valid if we are back by then? And if that so happens, the last action rule will apply?

If we travel outside the country while his extension is pending,

- how does it get nullified, do we inform USCIS?
- It appears that H4-extension is taking >6 months. Therefore, we might be back before they even get to it. Is it possible that the extension still gets approved later? If so, can that cause any issues?

H4 extension for my son is being applied. His I-94 expires Mid-June but stamped visa is valid through Mar-2016. We have plans ro travel to India in Jul. After H4 extension has been applied --

- Can he stay in the US even after his I-94 expires and extension is still pending until our intended travel?
- Can he then travel overseas even if the extension is still pending and return with the stamped visa which is valid through Mar-2016? Will it create any illegal gap in his stay?
- What happens to the pending H4 extension petition? Does traveling when it pending create any problems?

Can anyone tell me if another employer can file a cap exempt visa (transfer or new or whatever?) for me when I have returned to India and the current H1 has expired? Or, does it have to be the same employer for it to be cap-exempt?

I have a 140 approved for a long time but never got a chance to file 485.

I have a post-sixth-year H1 extension approved till sometime in 2017 based on I-140 approved (stamp expiring in 2016). My question is, if I return to India at this stage and want to come back to the US at some point, how can I do that?

- Can I somehow re-capture this ~2 years that I have currently left?
- If the same company petitions an H1 after 2017, will it be cap exempt?

it was approved on November 6th, but the status on the website got updated on November 12th

what I meant to ask was when did you get the text message -- the day it was approved or the day the it was updated on the website?

Did you create a SR?

how is an SR created and what is eligibility to create one? I see that on the uscis site, processing time is mentioned as 2 months for extension cases. Since my case has been pending for over 2 months, can I crate an SR to follow up?

I applied on Sept 2nd, regular processing, VSC, India origin. Got approved on Oct 31st. 7th year extension with I140, got 3 yrs extension.
As per my experience, if there is RFE, it comes in first 3-4 weeks...Since you passed that, you should be good and get approval soon.
