That is kind of a grey area, I think. I am not an expert on this but from what I have heard, it's usually MS+2 years of progressive work experience. Also, whether or not an application will be filed in EB2 depends on the job description for that application. Ex. If the job description says the minimum criteria to perform the role is a Bachelor degree with 2-3 years of experience, the application will be filed in EB3 irrespective of whether s/he has a Masters degree or not. This is because the job itself doesn't need a person to have a Masters degree or considerable years of experience.

As far as I know, there is no rule that says that the experience has to be gained at offshore only. The rule is to submit evidence of 5 years of progressive work experience, i.e. the applicant has gained increasing work experience over the period of 5 years (at least) that is related to the work role mentioned in the PERM. For people with Masters degree, number of years of required work experience is less because the educational background makes up for it.

My situation is the same as yours, visa expiring in oct'14 and maxing out in may'15 including recapture time. I submitted all documents back in Jan'13 and got an email yesterday saying my application has been drafted in eb2 and will be submitted shortly.

wondering because immigration user review hasn't started for me yet. I had submitted the docs back in Jan this year and upon pestering the concerned people, the last update I got was filing will happen in the beginning of november

@ meta - The reason why people feel irritated is because the subject line is very 'implicit'. People here have opted to stick to c** and are trying to share factual information about the current cycle that might help other c** folks to gauge the situation. People are well aware of the facts that you are pointing out but those things are aside the topic of conversation here. If you look at the recent posts, no one is asking other options outside c** or discussing if the policies are skewed or not. So, while you are free to post whatever you like or wherever you like, it doesn't help most people on this discussion thread, rather they keep detracting. So, may be your intentions are friendly but why advise people if you know no one's interested to take your advice? :)

With a small company comes a lot of other issues, depending on whether its EC or EVC and what not, more so, when there isn't a defined list of documents that you are expected to bring along. C** folks do get stuck too but the percentage or probability is way higher for a small company. In the end of the day, its all a matter of luck/speculation. And trust me, c** is way better or transparent when it comes to gc than a lot of other bigwig companies, seen the other side of it and have had first hand experience. Its the sheer size of their work force that's dependent on gc which puts them in a tight spot. Lastly, I didn't start my career with c**, been with few others before jumping ship here, so may be I have been lucky so far not to face the issues that you pointed out

Its a two-pronged issue. One hand, you could join a small/lesser known consulting company that will probably get your gc started right away, but then, when its stamping time in India, you'd probably run into issues as the VOs are skeptical of companies that aren't much heard of/have fewer employees. Joining one of the larger consulting firms with a good track record of GCs is definitely a good option, but most of them have their internal rules like 1 year wait period before starting with GC. So, for someone with less than 2 years left on visa, it gets dicey. Small consulting is definitely a go if you can let go of going out of country till you have your EAD, but for most, that's not the solution.

Chances are there but considering different options, it is prudent to stick to the current situation. It isn't any better in other big consulting firms and almost all of them have their own internal policies for PERM processing.

As for the smaller ones, yes, they might file pretty quickly and might not be subjected to close scrutiny. However, they pose a different problem when one goes for stamping.

How long has she been with Cognizant? NA lateral hire? Filing category should ideally correspond to the job description for which the PERM is being/going to be filed (among other things), so its kind of hard to suggest without knowing the specifics
