Thank you rocker8 for the reply.

Yes, I was taken to detention center and finger printed. Now does that mean i would get visa revocation mail/email? If so, would that go my employer or come to me directly? What about my recently approved H1B extension, can that be revoked too (which means I will be out of status?)?

Folks, I got pulled over for DUI yesterday :( (no accident, just was not driving within the lane and speeding) this is 1st DUI and I have no idea what next, though I am getting DUI attorney to represent my case.

I read on the forum threads that my visa will be revoked soon...Is that definitely going to happen? In my case my visa stamp date is already expired and I am on approved I-129 valid until 2018. In that case how visa revocation would work since it is already expired. Also would I be allowed to work in US until I go to India for stamping OR do I have to leave immediately for india?

I will post more updates as progress through the case, however is someone can address to my clarifications above, would be highly appreciated.

Hi, my employer filed H1/H4 in regular processing first and then upgraded to PP. Meantime, I sent H4 EAD applicable separately to VSC.

Now I see that my H1B is approved on 18th Jan, however H4 still shows "Case was received" status. Is this normal that only H1B gets approved and not H4, even if both are filed together in PP. I understand that PP is for I-129 only, however have never expected that H4 will not approved along with H1B. Anyone has experience with this situation and what is to be done to get H4 approved too? I have H4 EAD application pending too with VSC and I am afraid that would also be delayed until H4 is approved.

If you were to refile the application, would you be sending directly to Nebraska processing center OR to lock box facility since H1B is approved already? That's the confusion I have, where to send the EAD application.

In my case USCIS vermont customer service says I should have sent EAD application to lockbox facility than VSC..that is the reason no receipt generated for my EAD application...while I read on forums (and on USCIS website too) that if your H1/H4 extention is pending with any given service center, EAD application to be sent to that service center only.

Hi, my employer filed my H1 and spouse H4 visa extension under regular processing during month of Nov. We received receipt notice for both and petition is pending with VSC. Since my employer does not file H4 EAD application, I submitted H4 EAD renewal application separately to VSC during first week of Dec.

It is been a month now for submitting H4 EAD application, but I have neither received receipt notice nor my check is cleared.

Questions:
Is this normal to take more than a month to have a receipt notice?

Was that correct on my part to send H4 EAD application to VSC OR should that have been sent to lockbox? Is this what casing application not being looked after yet?

Now my employer is upgrading H1/4 to PP, however since my EAD receipt is not generated / received yet, what to expect with EAD case in case H1/4 gets approved ?

Appreciate if someone can help with this.

In my case, my H4 EAD Application received by Vermont processing center during first week of December, but no receipt notice yet. I filled G-1145 form too but no notification received, nor my cheque debited...is this normal? Is there anyone been though this can share the experience?

Thanks harshreddy9. Any idea within how many days to expect receipt notice once application is reached at USCIS? My application reached on 7th Dec but no receipt notice yet. We have filed G-1145 form along with the application.

Guys, I was reading on other online forums that if one do not get EAD within 90 days of receipt notice, can request for interim EAD by visiting local USCIS office (InfoPass Appointment). Is that really true? I am reading lot of posts here where folks are waiting for more than 90 days so thinking what I read on other forums may not be true, but just wanted to check.

Thanks. But when I check the status of my AOS and EAD application, both of them shows Application received status and nothing about abandoned / cancelled. My attorney has no clue and has opened service request which may take few weeks to get back and if I were to reapply for EAD it would be waste of time :(

When I checked status of both of my applications (h1 to H4 conversion and H4 EAD), it still shows case received while I was thinking they would have been cancelled since I left the country.

Does anyone have any idea what happens to these cases in this situation? I am more curious to understand if I need to file new H4 EAD application? If so, will there be any problem since earlier application still shows the case received instead of cancelled etc.? OR my earlier H4 EAD application will still be processed without me doing anything and just wait for it?

Appreciate any help / guidance you can provide on this.

Hi folks, i will soon be applying for H4 EAD, could anyone please tell me what is typical processing / approval time for EAD after submitting the application? My application would mostly go to vermont processing center.

I can see vermont processing times @ https://egov.uscis.gov/cris/processingTimesDispl... but not sure which classification corresponds to H4EAD processing time.

Topic: H1B Approval Notice Validity more than Max out....

Hi

I recently got my H1B extended till 12/31/2013. However my max out date is April 2013. I just have my PERM (EB3) Approved and I 140 is yet to be filled.

I wonder why USCIS approved my petition till end of 2013 if my Max out is before that. Also what happens in this case, do I get to stay till end of 2013 or still need to leave the country before max out date assuming my I 140 does not get approved?

Also what would happen if my I 140 gets approved say in next couple of months, do I need to file new H1B extension petition before max out date to extend it up to 3 years?

Appreciate help on this.

Hi Folks,

I have this question that I am struggling with and not getting proper answer from GIT.

I have worked with two other employers before joining CTS. As a proof of my employment, for one employer I have release letter and for other one I have resignation email sent by me to employer. That's all I have to show my experience with those employers. Now for I-140 filling, GIT requested to have previous employer experience letter including the details like, job description, position held, roles and responsibilities etc. and none of these employers are proving these details to me despite follow-ups and requests. Also tried other options suggested by GIT but those are not working either.

Now question that I have is - Is it absolutely necessary to mention/show my previous experience in filling I-140? Because even with producing these experience letters, it does not change my GC category from EB3 to EB2.

However, other thought that crosses my mind is, while applying for Visa extensions or for new Visa petition, I have always mentioned about my previous experience in documentation to USCIS, so USCIS may have that somewhere in their database. if that is the case, me not providing previous experience details/letter may cause RFE/rejection to my I-140.

Has anyone faced similar situation and if so what has finally worked out.

Hi Folks,

What are the odds of getting I-140 approved, in some approx percentage? I know PERM is the stage where most of the cases gets stuck in audit/denial. Is that the same case/rate for I-140 processing? OR is it like once PERM is approved, it is very less likely for someone to get denial on I-140 application.

Also is there any CTS/USCIS criterion for filling I-140 under PP. My max out date is Feb 2013 but want to file I-140 under PP instead long waiting and then converting in PP in case of delay in approval.

Appreciate any help on this.
